As a property owner, tenant, or person who has requested notice, please be advised that the City of San Diego Planning Commission will hold a public hearing to either approve, conditionally approve, or deny an application for a Conditional Use Permit (CUP) (Process Four) by AT&T to allow a Wireless Communication Facility (WCF) at Atria located at 101 Market Street in the Marina Neighborhood of the Downtown Community Plan Area.

The public is invited to attend these meetings and express any comments to the review bodies, who will take the comments into consideration in their actions. If you have any questions after reviewing this notice, you can call the CivicSD Project Planner listed above. Copies of the application for the project are available for public review in the offices of CivicSD located at 401 B Street, Suite 400, San Diego, 92101.

The decision of the Planning Commission can be appealed to the City Council. An application for appeal must be filed within 10 business days of the Planning Commission’s decision. In order to appeal any decision to the City Council, you must attend the hearing or express interest in writing to the Project Planner or Planning Commission prior to the hearing date. Any appeals must be submitted to the City of San Diego City Clerk’s Office, 202 C Street, 2nd Floor, San Diego, California, 92101. If you wish to challenge the City of San Diego’s (“City”) action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the public hearings described in this notice, or written correspondence to CivicSD or the City at or before the public hearings.

This activity is covered under the Final Environmental Impact Report (FEIR) for the San Diego Downtown Community Plan, Centre City Planned District Ordinance, and 10th Amendment to the Centre City Redevelopment Plan, certified by the City Council and the Former Redevelopment Agency (“Former Agency”) on March 14, 2006 (Resolution R-301265 and R-04001, respectively) and subsequent addenda to the FEIR, certified by the Former Agency on August 3, 2007 (Former Agency Resolution R-04193), April 21, 2010 (Former Agency Resolutions R-04508 and R-04510), August 3, 2010 (Former Agency Resolution R-04544) and February 12, 2014 (City Council Resolution R-308724). The FEIR is a “Program EIR” prepared in compliance with California Environmental Quality Act (CEQA) Guidelines Section 15168. The proposed WCF is within the scope of the development program described in the FEIR and therefore the environmental impacts were adequately addressed in the FEIR; therefore, no further environmental documentation is required under CEQA.

This information will be made available in alternative formats upon request. To request an agenda in alternative format or to request a sign language or oral interpreter for the meeting, call the Disability Services Coordinator at 236-5979 at least five working days prior to the hearing to insure availability. NOTICE OF ASSUMPTION OF DEPOSITS APPLICATION

Notice is hereby given that an Application will be made with the Office of Comptroller of the Currency (OCC) on April 16, 2014, for approval of the purchase and assumption of certain assets and liabilities of H&R Block Bank, located at One H&R Block Way, Kansas City, Missouri 64105 by BofI Federal Bank, located at 4350 LaJolla Village Drive, San Diego, California 92122.

The liabilities to be assumed by BofI Federal Bank and transferred from H&R Block Bank include all of H&R Block Bank’s deposit accounts. Following the transfer, H&R Block, Inc., through its indirect subsidiary, will market and distribute BofI Federal Bank’s H&R Block-branded financial products and services. H&R Block, Inc. will also remain a consumer tax services provider.

Like H&R Block Bank, BofI Federal Bank (www.bofifederalbank.com) is a nationwide, direct bank operating in all 50 states. BofI Federal Bank expects to maintain and service the transferred deposit accounts following the transfer.

This notice is published pursuant to 12 U.S.C. § 1828 (c) of the Federal Deposit Insurance Act and 12 C.F.R. § 163.22 of the Regulations of the OCC. This notice will appear at approximately one week intervals over a 30 day period beginning April 14, 2014 and ending the week of May 12, 2014.

Anyone may submit written comments in connection with this Application within 30 calendar days of the initial publication date of this notice. Comments should be sent to the District Licensing Office, Office of Comptroller of the Currency, at 1225 17th Street, Suite 300, Denver, Colorado 80202 and to the attention of Eshel Bar-Adon, BofI Federal Bank, at 4350 LaJolla Village Drive, Suite 140, San Diego, California 92122. Written comments in opposition to the Application should address the regulatory basis for such denial and be supported by the information specified in 12 C.F.R. § 116.120(a). You may request a meeting to discuss the Application by including a written statement of such request in your comment to the OCC. Your request should describe the nature of the issues or facts to be discussed and the reasons why written submissions are insufficient to adequately address the facts or issues. The OCC will only grant a meeting request if it determines that written submissions are insufficient to address the facts or issues raised, or that a meeting will be beneficial in its decision making process.
