TO ALL PERSONS INTERESTED IN THE MATTER OF THE VALIDITY OF A LOAN AGREEMENT AND AN INDENTURE TO BE ENTERED INTO BY THE CALIFORNIA MUNICIPAL FINANCE AUTHORITY AND THE PROCEEDINGS TAKEN BY SUCH AUTHORITY IN CONNECTION THEREWITH INCLUDING THE ISSUANCE OF REVENUE BONDS, THE PROCEEDS OF WHICH WILL BE USED TO FINANCE OR REFINANCE VARIOUS EDUCATIONAL FACILITIES OWNED BY THE ROMAN CATHOLIC BISHOP OF ORANGE AND OPERATED BY SERRA CATHOLIC SCHOOL, WHICH REVENUE BONDS WILL BE PAYABLE SOLELY FROM CERTAIN REVENUES DERIVED FROM THE OPERATION OF SERRA CATHOLIC SCHOOL, SUCH REVENUES TO BE HELD IN A SEGREGATED FUND ON DEPOSIT WITH A BOND TRUSTEE AND (B) THE EXECUTION AND DELIVERY OF VARIOUS ANCILLARY AGREEMENTS TO BE ENTERED INTO IN CONNECTION WITH THE ISSUANCE OF THE REVENUE BONDS AND THE OBLIGATIONS REPRESENTED THEREBY.
PLEASE TAKE NOTICE that a complaint has been filed by Plaintiff, the CALIFORNIA MUNICIPAL FINANCE AUTHORITY, against you pursuant to Section 860 et seq. of the California Code of Civil Procedure and Section 53510 et seq. of the California Government Code for the purpose of validating (A) the proposed Loan Agreement (the “Loan Agreement”) to be entered into by the California Municipal Finance Authority (the “Authority”) and The Roman Catholic Bishop of Orange (the “Corporation”), the proposed Indenture (the “Indenture” and together with the Loan Agreement, the “Agreements”) to be entered into by the Authority and a bank or financial institution with trust powers and an office in the State of California (the “Trustee”), the proposed revenue bonds to be issued under and pursuant to the Indenture (the “Bonds”), the proceeds of which Bonds will be loaned to the Corporation pursuant to the Loan Agreement and used to finance or refinance various educational facilities to be owned by the Corporation and operated by Serra Catholic School, which Bonds will be payable solely from certain revenues derived from the operation of Serra Catholic School to be pledged to the payment of the Bonds pursuant to the Indenture, which Agreements and Bonds when executed, delivered and issued, as applicable, will constitute valid, legal and binding obligations of the Authority in accordance with their respective terms and (B) that all proceedings and actions taken and to be taken by the Authority in connection with the authorization, execution, delivery, performance and issuance, as applicable, by the Authority of the Agreements and the Bonds, including, without limitation, the adoption by the Authority of its Resolution No. 08-38 relating thereto are in conformity with the applicable provisions of all laws and enactments at any time in force or controlling upon such documents and proceedings, whether imposed by constitution, statute, regulation or otherwise. If you wish to contest the legality or validity of this lawsuit you must appear and answer said complaint by filing a written pleading in response to said complaint not later than the 7th day of July, 2008, which date is at least 10 days after completion of publication of this summons. Your pleading must be in the form required by the California Rules of Court. Your original pleading must be filed in this Court with proper filing fees and proof that a copy thereof was served on Plaintiff's attorneys.
Unless you do so, your default will be entered upon application by the Plaintiff, and the plaintiff may apply to the court for the relief demanded in the complaint. PERSONS WHO CONTEST THE LEGALITY OR VALIDITY OF THE MATTER WILL NOT BE SUBJECT TO PUNITIVE ACTION, SUCH AS WAGE GARNISHMENT OR SEIZURE OF THEIR REAL OR PERSONAL PROPERTY.
