 AN AGREEMENT FOR AMENDMENT
 OF OPTION AGREEMENT
 BETWEEN SAN DIEGO UNIFIED PORT DISTRICT
 AND SEAPORT VILLAGE OPERATING CO., LLC,
 AMENDMENT NO. 3

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.That the Option to Lease Agreement dated 11 January 2005 between the San Diego Unified Port District and Seaport Village Operating Co., LLC, a Delaware limited liability company, is hereby amended in accordance with Agreement For Amendment of Option Agreement Between San Diego Unified Port District and Seaport Village Operating Co., LLC, Amendment No. 3, on file in the office of the District Clerk as Document No. 50781.
Section 2.This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners..

 AN ORDINANCE GRANTING A LEASE
 TO BARTELL HOTELS,
 A CALIFORNIA LIMITED PARTNERSHIP

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.That lease agreement between the San Diego Unified Port District (District) and Bartell Hotels, a California limited partnership, on file in the office of the District Clerk as Document No. 50744, leasing certain premises located at 4875 North Harbor Drive (Holiday Inn Bayside) in the City of San Diego, is hereby approved and granted.
  Section 2. The Executive Director or his authorized representative is hereby directed to execute the said lease agreement with Bartell Hotels on behalf of the District.
Section 3.This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners..

 AN ORDINANCE ADOPTING THE ANNUAL BUDGET
 FOR FISCAL YEAR 2006-2007 AND APPROPRIATING
 THE NECESSARY MONEY TO OPERATE THE
 SAN DIEGO UNIFIED PORT DISTRICT FOR SAID FISCAL YEAR

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.The final budget of the San Diego Unified Port District for the Fiscal Year 2006-2007, as set forth in Document No. 50783, on file in the office of the District Clerk, is hereby adopted as the Annual Budget for said Fiscal Year.
  Section 2. There is hereby appropriated for expenditure out of the Revenue Fund of said District the following amounts:
Ordinary Annual Expenses                  $ 119,176,400
  Capital Outlay                                     $ 36,235,000
  Equipment Outlay                                 $ 1,077,300
  Debt Service - Principal                         $ 3,781,600
  Public Art Projects                                $ 1,250,100

  All unexpended monies remaining in said Fund on June 30, 2006, together with monies transferred to said Fund or received in connection with said Fund during the 2006-2007 Fiscal Year in excess of the requirements shown above, are hereby appropriated for the uses authorized in the San Diego Unified Port District Act.
Section 3.This ordinance is declared to take effect upon its publication, pursuant to the provisions of Section 21 of the San Diego Unified Port District Act.

Section 4. That Ordinance 2368 entitled "An Ordinance Establishing a Schedule of Compensation for Officers and Employees of the San Diego Unified Port District" is hereby further amended by amending Section 26.b) to read as follows:
  "Section 26.  RETIREMENT CONTRIBUTION:

  "b) The District shall pay seven percent (7%) of a full-time employee's compensation subject to retirement contribution, as defined in sub-paragraph a), above, in addition to the District's employer and administrative contributions, into the Retirement System for each District general member employee.  This amount is known as the offset.  For each safety member, those employees in Group E - Peace Officer, and Class A2011-UE03 (Harbor Police Captain), the District shall pay eight and eight-tenths percent (8.8%) of a full-time employees's compensation subject to retirement contribution into said Retirement System.  For those employees in Group A-1 Principal Administrators, Unclassified, the District shall pay an additional one and one-half percent (1-1/2%).  Furthermore, the District  will  continue  to  pay  the  additional  one  and  one-half  percent (1-1/2%) for those employees who are moved from Group A-1 - Principal Administrators, Unclassified, to other classifications as directed by the Executive Director.  Said amounts so paid and contributed shall be credited to the District's account in the said  Retirement System and not to the account of any employee.  The District shall not contribute to the Retirement System for part-time employees."
  Section 5. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.
