AN ORDINANCE AMENDING LEASE AGREEMENT BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND THE CITY OF CORONADO
 
WHEREAS, pursuant to Ordinance 2356, adopted 6 September 2005, the  Board of Port Commissioners of the San Diego Unified Port District (District) authorized, approved and accepted a lease agreement from the City of Coronado, a municipal corporation, as Trustee of State of California tidelands, to the District, leasing to the District approximately 5.633 acres of tideland and water area located on the northeast side of Strand Way, southeast of Pomona Avenue, in the City of Coronado, to be used only and exclusively for public park, recreation, open space, parking and aquatic support and for other purposes whatsoever; and
WHEREAS, the District and the City of Coronado desire to enter into an Agreement for Amendment of Lease, Amendment No. 1, to extend the date for the completion of construction of the Linear Park Project from June 30, 2008, to June 30, 2010, and  for the City of Coronado to qualify for reimbursement of previously approved funds,  NOW, THEREFORE,
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.   That lease agreement dated 6 September 2005 from the City of Coronado, a municipal corporation, as Trustee of State of California tidelands, to the San Diego Unified Port District, a public corporation, is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No. 1, on file in the office of the District Clerk, and said Amendment No. 1 is hereby authorized, approved and accepted as recommended by the Executive Director. Section
2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE GRANTING AMENDMENT NO. 1 TO SUBLEASE BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND THE CITY OF CORONADO
 
WHEREAS, pursuant to Ordinance 2356, adopted 6 September 2005, the  Board of Port Commissioners of the San Diego Unified Port District (District) authorized, approved and accepted a lease agreement from the City of Coronado, a municipal corporation, as Trustee of State of California tidelands, to the District, leasing to the District approximately 5.633 acres of tideland and water area located on the northeast side of Strand Way, southeast of Pomona Avenue, in the City of Coronado, to be used only and exclusively for public park, recreation, open space, parking and aquatic support and for other purposes whatsoever; and
  WHEREAS, pursuant to Ordinance 2357, adopted 6 September 2005, the District subleased to the City of Coronado, a municipal corporation, (Sublessee) its entire leased premises consisting of said approximately 5.633 acres of tideland and water area located on the northeast side of Strand Way, southeast of Pomona Avenue, in the City of Coronado, commonly known as Coronado Linear Park, to be used only and exclusively for a public park, recreation, open space, parking and aquatic support and for no other purposes whatsoever, for a term of Thirty (30) years commencing 1 July 2004 and ending 30 June 2034; and
  WHEREAS, the District and the City of Coronado desire to enter into an Agreement for Amendment of Sublease, Amendment No. 1, to extend the date for the completion of construction of the Linear Park Project from June 30, 2008, to June 30, 2010, and  for the City of Coronado to qualify for reimbursement of previously approved funds,  NOW, THEREFORE,
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  1. That all of the conditions contained in said Ordinance 2357 (consent to the original sublease) shall continue in full force and effect.
  2. The date for completion of construction of the Linear Park Project has been extended from June 30, 2008, to June 30, 2010, in accordance with Paragraph 3, Sub-Paragraph (d), of said Amendment No. 1.

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.   That lease agreement dated 21 October 1997 between the San Diego Unified Port District and Ferry Landing Associates, LLC, a California limited liability company, is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No. 3, on file in the office of the District Clerk.
Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE AMENDING  OPTION TO LEASE AGREEMENT BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND LANE FIELD SAN DIEGO DEVELOPERS, LLC
 
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. That Option to Lease Agreement dated 5 December 2006 between the San Diego Unified Port District and Lane Field San Diego Developers, LLC, a Delaware limited liability company, (Lane Field South Hotel Site) is hereby amended in accordance with Agreement for Amendment of Option to Lease Agreement, Amendment No. 1, including without limitation the extension of the dates provided in Paragraph 15, Force Majeure, to Three Hundred Sixty Five (365) days in the aggregate, in accordance with the terms, covenants and conditions contained in said Agreement for Amendment of Option to Lease Agreement, Amendment No. 1, on file in the office of the District Clerk.
Section 2. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE AUTHORIZING AN OPTION TO LEASE AGREEMENT WITH ISLAND PARTNERS, LLC
 
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. The San Diego Unified Port District hereby grants an Option to Lease  Agreement and authorizes the Executive Director or his authorized representative to execute said Option to Lease Agreement with Island Partners, LLC, a California limited liability company, to lease certain District premises of approximately 27,291 square feet of land area and approximately 47,420 square feet of water area located on Shelter Island Drive in the City of San Diego, for the purpose of a marine sales and service facility, consisting of a single two-story building with approximately 10,850 square feet of building area and approximately twenty five (25) marina slips and related uses.  The Option to Lease Agreement shall commence on June 11, 2008, and end on September 30, 2009, subject to earlier termination, provided, however, said term may be extended by up to Ninety (90) Days in accordance with the terms, covenants and conditions contained in said Option to Lease Agreement, on file in the office of the District Clerk.  Further, in the event any of the events listed in Paragraph 14, Force Majeure, cause delay, said Option to Lease Agreement may be extended for no more than One Hundred Eighty (180) days.
Section 2.   Upon timely performance and exercise of said Option to Lease Agreement, the Executive Director or his authorized representative is hereby directed to execute the Lease with Island Partners, LLC, which is attached to said Option to Lease Agreement.
Section 3.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners; provided, however, in the event Island Partners, LLC does not satisfy the conditions set forth in Paragraph 5 of the Option to Lease Agreement, entitled Conditions Precedent, said Option to Lease Agreement shall be null and void and of no further force or effect.

AN ORDINANCE AUTHORIZING AN OPTION TO LEASE AGREEMENT WITH
SUNROAD HARBOR ISLAND, INC.
  
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. The San Diego Unified Port District hereby grants an Option to Lease Agreement and authorizes the Executive Director or his authorized representative to execute said Option to Lease Agreement with Sunroad Harbor Island, Inc., a California corporation, to lease certain District premises located at 880 Harbor Island Drive in the City of San Diego, for the purposes of the operation of Two (2) restaurants and related activities.  The Option to Lease Agreement is for a term of Eighteen (18) months commencing June 11, 2008, and ending on December 10, 2009, subject to earlier termination; provided, however, said term may be extended by up to Ninety (90) Days in accordance with the terms, covenants and conditions contained in said Option to Lease Agreement, on file in the office of the District Clerk.  Further, in the event any of the events listed in Paragraph 14, Force Majeure, cause delay, said Option to Lease Agreement may be extended for no more than Two Hundred Forty (240) days.
  Section 2.   Upon timely performance and exercise of said Option to Lease Agreement, the Executive Director or his authorized representative is hereby directed to execute the Lease with Sunroad Harbor Island, Inc., which is attached to said Option to Lease Agreement.
  Section 3.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners; provided, however, in the event Sunroad Harbor Island, Inc. does not satisfy the conditions set forth in Paragraph 5 of the Option to Lease Agreement, entitled Conditions Precedent, said Option to Lease Agreement shall be null and void and of no further force or effect.

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.   That lease agreement dated 1 March 1999, between the San Diego Unified Port District and The San Diego Mooring Company, LLC, a California Limited Liability Company, is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No.  8, on file in the office of the District Clerk.
Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.
