ORDINANCE 2673

ORDINANCE ADOPTING THE ANNUAL BUDGET
FOR FISCAL YEAR (FY) 2012/2013
 

            WHEREAS, the San Diego Unified Port District (District) is a public corporation created by the Legislature in 1962 pursuant to Harbors and Navigation Code Appendix I, (Port Act); and
            WHEREAS, Section 46 of the Port Act requires that on or before the 15th day of June each year the District shall estimate and determine the amount of money required by the District and shall adopt a preliminary budget; and
            WHEREAS, Section 47 of the Port Act, requires the Board of Port Commissioners (Board) is to meet for the purposes of fixing the final budget; and
            WHEREAS, Section 47 of the Port Act requires that on or before the 15th day of June of each year, the Board shall publish a notice stating:
(1)   That the preliminary budget has been adopted and is available at a time and at a place within the District specified in the notice for inspection by interested taxpayers; and
(2)   That on a specified date not less than one month after the publication of the notice and at specified time and place, the District's Board will meet for the purpose of fixing the final budget, and that any taxpayer may appear and be heard regarding the increase, decrease or omission of any item in the budget, or for the inclusion of additional items.
WHEREAS, in compliance with the provisions of the Port Act, the Board adopted Resolution 2012-68 the FY 12/13 preliminary budget on May 8, 2012; and
WHEREAS, District staff recommends that environmental-related projects and activities that are included in the FY 12/13 final budget totaling approximately $2.0 million receive funding from the Environmental Fund; and
WHEREAS, pursuant to BPC Policy 609 a fund designated as the Public Art Fund into which shall be deposited the Annual Office Budget of $1.2 million in funds as the Board shall appropriate for the Public Art Office, District staff recommends that the Board waive BPC Policy 609 and authorize a reduction in the FY 12/13 annual deposit for the Public Art Fund from $1.2 million to $0.2 million and authorize use of the $1.0 million difference to partially fund the FY 12/13 budget; and
WHEREAS, District staff requests the Board authorize use of $0.7 million from the FY 11/12 estimated surplus to fund the budget; and
WHEREAS, in compliance with the provisions of the Port Act a public hearing was conducted on June 12, 2012 to adopt the FY 12/13 final budget; and
NOW THEREFORE, the Board of Port Commissioners of the San Diego Unified Port District does ordain as follows: 
Section 1.        That approximately $2,000,000 in environmental-related projects and activities included in the FY 12/13 Budget shall receive funding from the Environmental Fund, BPC Policy 609 shall be waived, the annual deposit of $1,200,000 to the Public Art Fund shall be reduced to $200,000, and $700,000 from projected surplus for FY 11/12 budget shall be used to balance the budget.  Further, any reimbursements received for the following expenditures paid from the Environmental Fund shall be added back to the Environmental Fund:
 
1.      Goodrich South Campus Investigation;
2.      Site Investigation & Marine Biology;
3.      SDG&E Energy Program; and
4.      SBPP Site Investigation.
 
Section 2.        The final budget for FY 12/13, as set forth in the document on file in the Office of the District Clerk, is hereby adopted as the Annual Budget for said Fiscal Year.
Section 3.        There is hereby appropriated for expenditure out of the Revenue Fund of said District the following amounts:
 
Ordinary Annual Expenses.......................................... $ 134,555,500

TMP Capital Projects.................................................. $  1,091,500
Capital Major Maintenance......................................... $  7,336,400
Equipment Outlay....................................................... $  1,603,100
Debt Service - Principal.............................................. $  3,698,300
Total Requirements ................................................... $ 182,100,800
 
All unexpected monies remaining in said Fund on June 30, 2012, together with monies transferred to said Fund or received in connection with said Fund during the 2012/2013 Fiscal Year in excess of the requirements shown above, are hereby appropriated for the uses authorized in the San Diego Unified Port District Act.
Section 4.        This ordinance is declared to take effect upon its publication, pursuant to the provisions of Section 21 of the San Diego Unified Port Act.
