As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer of Civic San Diego (”CivicSD”) will hold a hearing to approve, conditionally approve, or deny an application for a Conditional Use Permit/Neighborhood Use Permit (CUP/NUP) No. 2013-25 (Process Three) for the rehabilitation and conversion of Historical Resources Board (HRB) Site No. 1132 (Bay View Hotel) located at 509 Park Boulevard into a 69-unit senior living facility. The project includes the reconstruction of two original tower elements and a rear third-floor addition original to the historical building as well as the construction of a new rooftop addition and sunroom. The total area of new construction is approximately 5,861 square feet. Implementation of the project requires approval of a CUP to allow the senior housing and to allow residential uses on the ground level along Park Boulevard; a designated Commercial Street under the Centre City Planned District Ordinance (CCPDO). The project also requires approval of an NUP to allow the expansion of a previously conforming structure.
Development within the Downtown Community Plan (DCP) area is covered under the Final Environmental Impact Report (FEIR) for the DCP, CCPDO, and 10th Amendment to the Centre City Redevelopment Plan, certified by the Former Redevelopment Agency (”Former Agency”) and City Council on March 14, 2006 (Resolutions R-04001 and R-301265, respectively) and subsequent addenda to the FEIR certified by the Former Agency on August 3, 2007 (Former Agency Resolution R-04193), April 21, 2010 (Former Agency Resolutions R-04508 and R-04510), and August 3, 2010 (Former Agency Resolution R-04544). The environmental impacts of the Project were adequately addressed in the FEIR and the project is within the scope of the development program described in the FEIR, therefore, no further environmental documentation will be required under the California Environmental Quality Act.
The decision of the CivicSD Hearing Officer is final unless appealed to the CivicSD Board of Directors. In order to appeal the decision you must be present at the public hearing and file a speaker’s slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained at the CivicSD office located at 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10) business days of the Hearing Officer’s decision. If the Hearing Officer’s decision is appealed, the decision made by the CivicSD Board of Directors is the final decision.
If you wish to challenge either CivicSD’s or the City of San Diego’s action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written correspondence to CivicSD at or before the public hearing.
