PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:

Matter of approving, conditionally approving, modifying or denying a vacation of sewer and drainage easements, and street dedications within the Mid-Cities Community Plan area.

The decision of the City Council is final.

COMMUNICATIONS
This item may begin at any time after the time specified. Any interested person may address the City Council to express support or opposition to this issue. Time allotted to each speaker is determined by the Chair and, in general, is limited to three (3) minutes; moreover, collective testimony by those in support or opposition shall be limited to no more than fifteen (15) minutes total per side.

The City of San Diego Land Development Review Division has prepared a draft Mitigated Negative Declaration for the following project and is inviting your comments regarding the adequacy of the document. Subject: 5040 Santa Monica: A Coastal Development Permit (CDP), Planned Development Permit (PDP) and Tentative Map Waiver to demolish an existing storage building (approximately 990 square feet) and existing 2-car garage (approximately 800 square feet), and construct a mixed-use development consisting of four, three-story, two-bedroom, two-bathroom, multi-family residential condominium units and one, two-story commercial condominium unit (approximate total of 10,312 square feet). The applicant is proposing an eight-car, sub-terrain parking garage (approximately 4,531 square feet), and two attached single-car garages with tandem parking (each approximately 222 square feet) located at street grade on a 7,000 square-foot consolidated lot at 5040 Santa Monica Avenue in the CC-4-2 zone of the Ocean Beach Community Plan Area. The CC-4-2 zone requires side and rear setbacks of either zero or ten feet. The applicant is requesting a PDP to deviate from those requirements to permit 5-foot side and rear building setbacks. The proposed project is located in the Coastal Overlay Zone (non-appealable), Coastal Height Limitation Overlay Zone, Parking Impact Overlay Zone, Residential Tandem Parking Overlay Zone, Airport Approach Overlay Zone and the Airport Environs Overlay Zone. Legal Description: Lots 14 and 15, in Block 74, according to map thereof No. 279. The site is not included on any Government Code Listing of hazardous waste sites.

Please be advised that the City of San Diego Solid Waste Local Enforcement Agency (LEA) will be holding an informational public hearing in compliance with Section 44004(h) of the Public Resources Code regarding a proposed revision to the Solid Waste Facility Permit for the Sycamore Landfill. The LEA is certified by the California Integrated Waste Management Board to enforce state laws and regulations at solid waste sites within the City of San Diego, including all active and closed landfills.
Sycamore Landfill is an approximately 491- acre existing landfill site located at 8514 Mast Boulevard in the East Elliott Community Plan area, approximately one mile north of Highway 52 and approximately a mile west of the City of Santee. On June 23, 2006, the LEA accepted for review a Solid Waste Facility Permit (SWFP) application package from Sycamore Landfill, Inc. requesting an increase of 665 tons per day in the maximum daily tonnage of municipal solid waste. The proposed revision to SWFP
# 37-AA-0023 would allow for a total receipt of 3,965 tons per day of municipal solid waste for disposal. The purpose of the change is to accommodate an increase in demand for landfill disposal services. The landfill is currently under an enforcement order by the LEA for exceeding its permitted maximum tonnage. The change in daily tonnage is the only operational change requested to the SWFP under consideration at this time. The SWFP will also be updated to reflect current design documents, capacity calculations, closure date, and eliminate the permitted maximum monthly tonnage limit. The LEA's preliminary determination is that the proposed permit revision be approved. The proposed revision to the SWFP would NOT allow for an increase in traffic, change in land use, or expansion of the landfill.
A draft Negative Declaration was prepared for the Project in conformance with the California Environmental Quality Act (CEQA) and has been circulated for public review. Comments on the draft Negative Declaration must be received by July 16, 2006.
This Public Hearing is for any interested parties to learn more about the proposed SWFP revision and to provide comments to the LEA regarding the proposed action. The decision to approve or deny the SWFP revision will be made by the LEA within 120 days of the date the application was deemed complete as required by State statute, and will be submitted to the California Integrated Waste Management Board (CIWMB) for concurrence at a public meeting. If you wish to be notified of the CIWMB meeting, please notify the LEA in writing no later than July 30, 2006.
A copy of the proposed SWFP revision is available for public review by appointment in the LEA office located at 1010 Second Avenue, 6th floor, San Diego, CA 92101. As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Site Development Permit to allow development on a parcel containing Environmentally Sensitive Lands, and a Neighborhood Development Permit to construct an addition on a previously conforming residential unit, on a

The decision of the Hearing Officer is final unless appealed to the Planning Commission. This project was determined to be categorically exempt from the California Environmental Quality Act on August 31, 2005 and the opportunity to appeal that determination ended September 15, 2005.
