NOTICE IS HEREBY GIVEN THAT, subject to confirmation by this Court, on Jul 10 2003, or thereafter within the time allowed by law, the undersigned Personal Representative, in the capacity of Administrator of the Estate of BARBARA J. SIMMONS, deceased, will sell at private sale (acting through Kevin Sheedy, a Licensed real estate broker with Kevin Sheedy Realty located at 7424 Jackson Drive, #10, San Diego, CA 92119, Telephone 619-286-1216) to the highest and best net bidder on the terms and conditions hereinafter mentioned, all right, title, and interest of the decedent at the time of death, and all right, title, and interest that the Estate has acquired in addition to that of the decedent at the time of death, in the following real property located in the City of San Diego, County of San Diego, State of California, more particularly described as:
A 100% interest in a Condominium located in San Diego County, California, commonly known as 1615 Hotel Circle South, Unit D-313, San Diego, CA 92108, which is particularly described as: A Condominium comprised of:
Parcel 1: An undivided 1/2 51st fractional interest as a tenant in common in and to Lot of Mission Village Condominiums, in the City of San Diego, County of San Diego, State of California, according to the map thereof No. 8993, filed in the Office of the County Recorder of San Diego County, California, on October 6, 1978.
Excepting therefrom the following:
All living Units shown upon the First Superceding Mission Village Condominiums Condominium Plan recorded in the Office of the County Recorder of San Diego County, California, on November 7, 1978 as file No. 78-482746 of Official Records; and First Amendments to First Superceding Plan recorded November 1979 as File No. 79-487182 of Official Records.
Also excepting therefrom the right to possession of all those areas designated as Patios and Balconies, shown upon the Condominium Plan above referred to.
Parcel 2: Living Unit No. D-313 as shown upon the Condominium Plan above referred to.
Parcel 3: The exclusive right to possession and occupancy of any Patio or Balcony shown on the Condominium Plan above referred to above as having the same number designation as the Living Unit described in Parcel 2 above. [APN: 443-040-19-71]
The property is to be offered at $249,900.
The sale is subject to current taxes, covenants, conditions, restrictions, reservations, right s of way, and easements of record, with any encumbrances of record to be satisfied from the purchase price.
The property will be sold on an "as is" basis, except for title. Contractor Inspection contingency, if any, to be released by Buyer before the Estate requests a date for Court confirmation.
Separate bids or offers, prepared on the CAR Probate Offer form, are invited for the property and must be in writing and will be received at the office of PAUL C. McEWEN, JR., INC., A Professional Law Corporation, 4909 Murphy Canyon Road, Suite 340, San Diego, CA 92123, Attorney for William E. Polk, Administrator of the Estate of BARBARA J. SIMMONS, deceased, or delivered to attorney McEwen personally, at any time after first publication of this Notice and before any sale is made.
The property will be sold on the following terms: Cash, or cash to new loan, with ten percent (10%) of the amount bid to accompany the offer by certified check, and balance to be paid at the close of escrow.
Real estate taxes, Mission Village Condominium Owners Association monthly fees, and premiums on insurance acceptable to the purchaser shall be probated as of the date of recording of conveyance. Recording of conveyance, transfer taxes, and other miscellaneous expenses associated with the sale are to be allocated between the Buyer and Seller in accordance with the usual custom in San Diego County. The cost of the title insurance policy will be paid by the Estate.
One-half (1/2) of the escrow charges shall be paid by the Buyer and one-half (1/2) shall be paid by the Estate.
No Termite report or clearance will be provided by the Estate; sales are to be in "as is' condition.
The undersigned reserves the right to refuse to accept any bids.
