IN THE MATTER OF A COMPLAINT OF CHRISTOPHER AND PATRICIA ELLEFSEN, REGISTERED OWNERS of the 1997 30ft Maxum, HIN BLIA35MKK697, her engines, tackle, apparel, etc., in a cause of Exoneration From Limitation of Liability.
TO CLAIMANT AND HIS ATTORNEY OF RECORD:
WHEREAS, a Complaint was filed in the United States District Court, Southern District of California on the 28th day of April 2003, by plaintiffs, CHRISTOPHER and PATRICIA ELLEFSEN (ELLEFSEN), praying for Exoneration from or Limitation of Liability concerning losses, damages, injuries, and demands occasioned or incurred by reason of the matters or happenings recited in said Complaint, and praying that a Monition issued out of said court citing all persona, natural or otherwise, claiming damages for any and all such losses and injuries to appear before said Court and make due proof of their respective claims and to answer the allegations of said Complaint, and if it shall appear that Plaintiffs are not liable for such claims or demands, it may be so finally judged by this Court, and
WHEREAS Boat US. has pledged security in lieu of surety bond; and
WHEREAS the Court has directed, by an Order made and entered on the date shown below, that a Monition issue against all those claiming losses, injuries, and damages, as hereinafter set forth, citing them to appear before this Court to make due proof of their respective claims on or before the 28th day of July, 2003, and to answer all the allegations of the Complaint herein;
YOU ARE COMMANDED to cite all persons, natural or otherwise claiming any, or asserting any claim for losses, injuries and damages or for any act, matter, or thing done, occasioned or incurred by, in or because of the casualty hereinabove set forth, to appear before said Court and make due proof of their respective claims as the Court shall direct and to answer all the allegations of the complaint herein at or before the 28th day of July, 2003, or within such further time as the Court may grant, and to have and receive such relief as may be due and to give public notice of this Monition by publishing notice thereof in the San Diego Daily Transcript, a newspaper published in the city of San Diego, California once a week for four successive weeks before the 28th day of July, 2003.
