The City of San Diego Land Development Review Division has prepared a draft Negative Declaration for the following project and is inviting your comments regarding the adequacy of the document. Your comments must be received by June 25, 2006 to be included in the final document considered by the decision-making authorities. Subject: Wat Lao Buddhist Temple CONDITIONAL USE PERMIT (CUP) and SOUTHEASTERN SAN DIEGO DEVELOPMENT PERMIT to maintain a Buddhist Temple within a single-family residence. The proposed project would also construct a nun's residence, a monk's residence, a Buddha Hall, an assembly building and several ancillary improvements. The project site would be graded to accommodate the new structures and the creation of 176 vehicular parking spaces.

Recommended Finding:
The recommended finding that the project will not have a significant effect on the environment is based on an Initial Study. As such, neither mitigation nor an EIR would be required.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a wireless communication facility consisting of three panel antennas proposed on the penthouses behind RF screening that will replace a small section of the building exterior where the antennas are located. As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for Coastal Development Permit (CDP) and Map Waiver (MW) application to waive the requirements for a Tentative Map to convert four existing residential units to four condominiums, including a request to waive the undergrounding of the existing utilities, on a 0.18-acre site. The property is located at 2256-2262 Seaside Street in the RM-1-1 Zone, Coastal Overlay Zone (non-appealable area), Coastal Height Limit Overlay Zone, Airport Environs Overlay Zone, and Airport Approach Overlay Zone, Beach Parking Impact Overlay Zone within the Peninsula Community Plan and Local Coastal Program and Council District 2.
Should the condominium conversion project be approved, tenants may be required to vacate the premises. No units may be sold in this building unless the conversion is approved by the city and until after a public report is issued by the Department of Real Estate. Each tenant has the exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions that such unit will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 90 days from the date of issuance of the subdivision public report pursuant to Section 11018.2 of the Business and Professions Code, unless the tenant gives prior written notice of his or her intention not to exercise the right.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN DIEGO APPROVING THE FORM AND AUTHORIZING THE EXECUTION AND DELIVERY OF THE SALE AGREEMENT; APPROVING AND ACKNOWLEDGING THE FORM OF THE DECLARATION AND AGREEMENT OF TRUST, THE INDENTURE, THE
PURCHASE CONTRACT, THE CONTINUING DISCLOSURE UNDERTAKING AND THE PRELIMINARY OFFERING CIRCULAR; APPROVING A FINAL OFFERING CIRCULAR; AND AUTHORIZING, ACKNOWLEDGING AND APPROVING
CERTAIN OTHER DOCUMENTS AND ACTIONS IN CONNECTION THEREWITH.
This ordinance authorizes the City of San Diego Tobacco Settlement Revenue Corporation [Corporation] to issue Bonds in an initial principal amount not to exceed $115 million. It approves the form and authorizes the execution and delivery of the Sale Agreement between the City and Tobacco Corporation whereby the City will sell the City's Sold City Tobacco Assets to the Corporation. It approves and acknowledges the form of the Declaration and Agreement of Trust, the Indenture, the Purchase Contract, the Continuing Disclosure Undertaking and the Preliminary Offering Circular and approves the Final Offering Circular. Finally, it authorizes, acknowledges and approves certain other documents and actions in connection with the sale of the Sold City Tobacco Assets and the issuance by the Corporation of the Bonds.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, since a written or printed copy will be available to the City Council and the public a day prior to its final passage.
This ordinance shall take effect and be in force on the thirtieth day from and after its final passage.
