PROJECT DESCRIPTION: The project is a Major Use Permit Modification and Rezone to allow new construction and the reconfiguration of an existing continuing care retirement community known as the Mount Miguel Covenant Village. The 26.5 acre project was originally established in 1965 and currently consists of 275 residential units including 48 assisted living units and 99 skilled nursing beds. The proposed modification would permit 54 additional residential units, or a total of 329 units. The proposed Rezone would change the story limit from 2 to 3 stories for the proposed Village Center building, and would change the current Zoning from RR2 (Rural Residential) to RU 14.5 (Residential Urban), which matches the General Plan density of 14.5 du/acre.
LOCATION: The project address is 325 Kempton Street, south of San Carlos Street, east of Kempton Street, and west of Sacramento Avenue in the Spring Valley Community Planning area, within unincorporated San Diego County.
ENVIRONMENTAL STATUS: The project will rely on a previously certified Environmental Impact Report dated November 2, 2001 and Addendum thereto dated July 23, 2010 on file with DPLU as Environmental Review Number 87-19-056D.

TITLE OF ORDINANCE: “Solar Energy Ordinance” (POD 09-006)

Subject: Zoning Ordinance Amendments related to Solar Energy Systems.


SUMMARY OF ORDINANCE: This project consists of amendments to the San Diego County Zoning Ordinance that would codify the Zoning Ordinance to ensure consistency with current County practices for the permitting of Solar Energy Systems. Solar Energy Systems utilized for on-site energy consumption are currently and would continue to be allowed by-right in the County as an accessory use in all Agricultural, Civic, Commercial, Industrial, and Residential zones upon approval of a building permit. Furthermore, Solar Energy Systems utilized for offsite energy use (power plant) are currently required to obtain a Major Use Permit. The proposed ordinance amendments would continue to require a Major Use Permit for Offsite Solar Energy System for project areas 10 acres or larger and would now require an Administrative Permit for project areas less than 10 acres. As a result, all Offsite Solar Energy Systems would continue to require discretionary review. Furthermore, the proposed amendments would not change the current setback or height regulations applicable to Solar Energy Systems in the Zoning Ordinance. The proposed ordinance amendments are intended to set forth reasonable standards and procedures for the installation and operation of Solar Energy Systems to improve and enhance public welfare and safety, and to implement the San Diego County General Plan.


ENVIRONMENTAL REVIEW: It is recommended that the amendments be found to comply with the California Environmental Quality Act (CEQA) and State and County CEQA Guidelines because a Negative Declaration dated May 20, 2010 on file with the Department of Planning and Land Use as Environmental Review No. 09-00-003 has been prepared, was advertised for public review commencing on May 20, 2010, and is proposed for adoption by the Board of Supervisors.

PROJECT DESCRIPTION: The project is a Major Use Permit to authorize the construction and operation of an unmanned wireless telecommunication facility. The facility would include a total of twelve panel antennas and twenty four transition modifying antennas (TMAs) on two 40-foot tall faux broadleaf elm trees. Four of the twelve antennas would be installed at 35 feet on the tree to be located at the northeast corner of the property, and eight of the twelve antennas would be installed at 35 feet on the tree to be located at the southwest corner of the property. Supporting equipment includes six equipment cabinets mounted on a concrete pad and enclosed by a nine-foot eight-inch high CMU block wall. The project is subject to the General Plan Regional Category of Estate Development Area (EDA), Land Use Designation of (17) Estate Development, and is zoned A70 (Limited Agricultural).
LOCATION: 30230 Yellow Brick Road (APN# 133-400-09-00). The project is located within the Valley Center Community Plan Area that is located in unincorporated San Diego County.
ENVIRONMENTAL STATUS: It has been determined that the project is exempt from environmental review under Section 15303 of the State California Environmental Quality Act Guidelines, because the project proposes the construction and operation of a telecommunication facility that qualifies as small, new equipment and facilities in small structures.

NOTICE IS HEREBY GIVEN, that a meeting of the Commission is scheduled for 9:00 a.m., on August 2, 2010, in Room 302, County Administration Center, 1600 Pacific Highway, San Diego, to consider the above referenced proposal.
The detachment area includes 70 parcels totaling 32.52 acres, known as the La Costa Meadows Unit 3 subdivision and is located North of Alga Road , east of El Camino Real, south of Palomar Airport Road, and west of Melrose Drive (Thos. Bros. pg. 1127/H4-H5). The detachment from the Leucadia Wastewater District (WD) is requested so that the City of Carlsbad can provide sewer service in the proposal area. Leucadia WD is requesting the detachment of these developed parcels because the City of Carlsbad is constructing a new gravity sewer tributary that will serve the proposal area. This project will replace the aging Meadows 3 pump Station, which has been servicing the area.
State Law requires that notification of the proposed detachment be published in a newspaper serving the area, and that property owners and registered voters located in the affected territory and within 300 feet of the exterior boundary of the subject property be individually notified. Unless there is written opposition received regarding the proposal or the Commission's intent to waive protest proceedings, there will be no subsequent protest and election proceedings.
At the hearing, the Commission will hear any person who wishes to speak and will consider the application and report of the Executive Officer. A Rezone and a change to the Specific Plan boundary is also proposed in response to General Plan changes that resulted from passage of Prop A, a landfill initiative, in June 2010. The objective of the Specific Plan is to facilitate development of East Otay Mesa as a major employment area for southern San Diego County by providing adequate land for warehousing, industrial, commercial and technology manufacturing uses.
LOCATION: The EOMSP encompasses an area of approximately 3,300 acres in the Otay Community Planning area in the southwestern portion of unincorporated San Diego County.
