ORDINANCE NUMBER O-20517 (NEW SERIES)
AN EMERGENCY ORDINANCE AMENDING CHAPTER 6, ARTICLE 7, DIVISION 38 OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTIONS 67.3802, 67.3803, 67.3804, 67.3805, 67.3806, AND 67.3807, ALL RELATING TO
EMERGENCY WATER REGULATIONS.
This amendment to the San Diego Municipal Code will add the definitions of Cascading Fountain, Ornamental Fountain, Recreational Fountain and Rain Event in section 67.3802 in order to restrict the use of fountains that waste water and to restrict lawn irrigation after a defined rain event.
The amendments to section 67.3803 (d) through (i) will clarify the mandatory prohibitions and prohibit non-recirculating fountains. Section 67.3803 (c) will forbid the use of a running hose to clean paved areas except for health and safety conditions, and prevent all such cleaning water from entering the storm drain system. Amendments to sections 67.3803 (j), 67.3805 (c)(3) and (6), 67.3806 (b)(4) and 67.3807 (b)(1) will change watering times to only before 10:00 a.m. and after 6:00 p.m. year around.
The amendment to section 67.3804 (g) adds a provision allowing the Park and Recreation Department to operate fountains and irrigate parks according to a schedule set by the City Manager, consistent with section 67.3801.
The amendments to sections 67.3806 (b)(1) and (2) restrict irrigation to five minutes per watering station and no more than two days per week. The amendments to section 67.3807 (b)(1) restricts watering to five minutes per station and eliminates winter watering restrictions of only one day per week. In addition, it allows a maximum of 18 minutes per assigned watering days when using non-standard spray heads.
The addition of section 67.3807 (b)(4)prohibits the use of cascading and recreational fountains during Level 3.
The City Council finds that these changes are required for the immediate preservation of the public peace, property, health, or safety pursuant to San Diego Charter section 295(e).
This emergency ordinance shall take effect and be in force on the day of its final passage pursuant to San Diego Charter section 280(a)(3).
