CIVIC SAN DIEGO BOARD OF DIRECTORS

As a nearby property owner, occupant, or person who has requested notice, you are hereby notified that the Civic San Diego ("CivicSD") Board of Directors ("Board") will hold a public hearing to either approve, conditionally approve, or deny Centre City Development Permit / Centre City Planned Development Permit / Neighborhood Use Permit / Neighborhood Development Permit (CCDP/CCPDP/NUP/NDP) No. 2014-72 for 330 13th ("Project"). This proposed Project is a 22 story (240-foot tall) mixed use development comprised of approximately 226 dwelling units and approximately 8,215 square feet of commercial space, with approximately 319 automobile parking spaces. This Project site is located on a 38,846 square-foot premises on the south portion of the block bounded by Park Boulevard and 13th, J, and K streets in the East Village neighborhood of the Downtown Community Plan area. Implementation of this Project will require consideration of a NUP for consideration of outdoor use areas, NDP for consideration of encroachments into the Public Right-Of-Way, and a CCPDP to allow seven deviations from the development regulations and standards in the Centre City Planned District Ordinance (CCPDO) and two deviations from the development regulations and standards of the Land Development Code (LDC), including: Street Wall Frontage, Minimum Street Wall Height, Ground-Floor Heights, Transparency, Commercial Space Depth, Maximum Tower Dimensions, Subterranean Garage and Basements, Vehicular Circulation Within Parking Facilities, and Size of Refuse and Recycling Material Storage Areas.

CivicSD Board meetings are held at the CivicSD office located at 401 B Street, Suite 400, San Diego, California 92101. The decision of the CivicSD Board is final unless appealed to the City of San Diego Planning Commission ("Planning Commission"). In order to appeal the decision you must be an "Interested Person" as defined in the LDC, requiring that you be present at the public hearing and file a speaker's slip concerning the application or have expressed interest by writing to the CivicSD Board before the close of the public hearing. The appeal must be made within ten (10) business days of the CivicSD Board decision. If the CivicSD Board decision is appealed, the decision made by the Planning Commission is the final decision and not appealable.

This Project will also be presented at the Downtown Community Planning Council (DCPC) meeting on Wednesday, July 15, 2015 at 5:15 p.m. for a recommendation to the CivicSD Board. DCPC meetings are held at the CivicSD office located at 410 B Street, Suite 400, San Diego, California 92101.

Development within the Downtown Community Planning area is covered under the Final Environmental Impact Report (FEIR) for the San Diego DCP, CCPDO, and 10th Amendment to the Centre City Redevelopment Plan, certified by the former Redevelopment Agency ("Former Agency") and the City Council on March 14, 2006 (Resolutions R-04001 and R-301265, respectively) and subsequent addenda to the FEIR certified by the Former Agency on August 3, 2007 (Former Agency Resolution R-04193), April 21, 2010 (Former Agency Resolution R-04510), and August 3, 2010 (Former Agency Resolution R-04544), and certified by the City Council on February 12, 2014 (City Council Resolution R-308724) and July 14, 2014 (City Council Resolution R-309115). The FEIR is a "Program EIR" prepared in compliance with California Environmental Quality Act (CEQA) Guidelines Section 15168. Consistent with best practices suggested by Section 15168, an FEIR Consistency Evaluation has been completed for the project. The Evaluation concluded that the environmental impacts of the project were adequately addressed in the FEIR, the project is within the scope of the development program described in the FEIR, and that none of the conditions listed in Section 15162 exist; therefore, no further environmental documentation is required under CEQA.
