PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:
Matter of approving, conditionally approving, modifying or denying an application for Irrevocable Offer to Dedicate (IOD) public street vacations on Lots 6 and 7 of Vista Alegre, Map 13309 located at 7994 and 8004 Eclipse Road, and the IOD public street vacation and slope easement abandonment in Parcels 10 and 29, Map 17922, located at 12608 and 12588 Senda Panacea, both within the Rancho Penasquitos Community Plan Area.

The decision of the City Council is Final.

Subject: SOUTHVIEW. TENTATIVE MAP/REZONE/SITE DEVELOPMENT PERMIT (TM/RZ/SDP) to allow for 21.1-acres of a 42.6-acre site to be subdivided into three legal lots. The remaining 21.5-acres are not a part of the current project. The project also proposes to construct full width improvements of Caliente Avenue along it's frontage south of Airway Road which consists of a 5-lane major road (3-lanes northbound and 2-lanes southbound); north of Airway Road the project would be required to construct a 4-lane collector road to Otay Mesa Road (2-lanes north and south); full build-out intersection improvements at Airway Road and Caliente Avenue and construction of a 4-lane major road along Airway from Caliente Avenue to the easterly project boundary. The project also includes the construction of two storm water conveyance systems which would drain into two detention basins. The proposed project site is located on the east side of Caliente Avenue, south of Otay Mesa Road and west of Spring Canyon within the Otay Mesa Community Planning Area. The site is not included on any Government Code Listing of hazardous waste sites.

Matter of the appeal by the Pacific Beach Community Planning Committee and by Richard S. Pearson of the Planning Commission's decision to approve an application for a Coastal Development Permit and Planned Development Permit to demolish the existing commercial building on site for the construction of a mixed-use development containing 18 residential units and seven commercial retail spaces located on a 21,856-square-foot site. The proposed project will conform to the Council Policy 900-14 criteria by generating more than 50% of the projected total energy consumption on site through renewable energy resources (i.e. photovoltaics). The property is located at 4105 and 4135 Mission Boulevard, on the northeast corner of Mission Boulevard and Pacific Beach Drive, in the CV-1-2 zone within the Pacific Beach Community Planning Area, Coastal Overlay (non-appealable Area 2), Coastal Height Limitation, Parking Impact, Transit Area Overlay zones, and Council District 2.

RESOLUTION NUMBER R- 301576

A RESOLUTION PURSUANT TO SECTION 147(f) OF THE INTERNAL REVENUE CODE OF 1986 APPROVING THE ISSUANCE OF BONDS BY THE HOUSING AUTHORITY OF THE CITY OF SAN DIEGO FOR THE STUDIO 15 APARTMENTS.

WHEREAS, the Housing Authority of the City of San Diego [Authority] adopted a resolution that constituted a declaration of official intent to issue an amount not to exceed $25,000,000 aggregate principal amount of multifamily housing revenue bonds for the Studio 15 Apartments [Bonds] to finance the acquisition and construction of approximately 275 units of multifamily rental housing to be located at 70 15th Street in the City of San Diego, as described in the form of notice of public hearing on file in the Office of the City Clerk as Exhibit A, and
WHEREAS, in order for the interest on the Bonds to be tax-exempt, section 147(f) of the Internal Revenue Code of 1986, as amended [Code] requires that the issuance of the Bonds by the Authority be approved by the City Council of the City of San Diego [City] as the applicable elected representative with respect to the Authority, after a public hearing regarding the Project and the Bonds following reasonable public notice; and
WHEREAS, notice of a public hearing with respect to the proposed issuance of the Bonds was published in a newspaper of general circulation in the City on May 29, 2006; and
WHEREAS, a public hearing was held by the City Council on June 13, 2006 and, at the public hearing, an opportunity was provided for interested persons to express their views on the issuance of the Bonds and on the nature, location, and operation of the Project; NOW THEREFORE,
BE IT RESOLVED, by the City Council of the City of San Diego that this City Council, as the applicable elected representative with respect to the Authority under section 147(f) of the Code, approves the issuance of the Bonds by the Authority for the purpose of financing the Project.
BE IT FURTHER RESOLVED, that the City does not warrant the creditworthiness of the Bonds or guarantee, in any way, the payment of the Bonds. No moneys of the City will be pledged or applied to the repayment of the Bonds.
