PROPOSED MITIGATED NEGATIVE DECLARATION

A draft Mitigated Negative Declaration has been prepared by the City of San Diego Land Development Review Division for the project listed below. Written comments regarding the adequacy of this draft Mitigated Negative Declaration must be received by the Land Development Review Division at the address below by August 21, 2003. This notice was/will be published in the SAN DIEGO DAILY TRANSCRIPT and distributed on July 22, 2003.
Subject:Lomas Santa Fe: CONDITIONAL USE PERMIT and SITE DEVELOPMENT PERMIT to construct, operate and maintain an unmanned, wireless communication facility. The proposed microcell facility consists of a new 30-foot wooden pole, a subterranean vault containing the telecommunications equipment, and an above grade power back-up metering distribution (PBMD) cabinet. The proposed pole 30-foot pole would carry two forty-inch by seven-inch flush-mounted panel antennas, painted to match the pole. The project support equipment would be located within a subterranean vault and the only visible elements would be a flush-mounted lid and two vent pipes. The above-grade cabinet would be painted dark green to blend with the existing and proposed landscaping. The project site is located within the public right-of-way of San Dieguito Road (located at the easterly end of the Fairbanks Ranch Country Club golf course. Applicant: Sprint-Telephony PCS, L.P.

NOTICE IS HEREBY GIVEN that the City Council of the City of San Diego (the "City Council") and the Redevelopment Agency of the City of San Diego (the "Agency") will hold a joint and concurrent public hearing on July 29, 2003 at the hour of 10:00 a.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et seq.), for the purpose of considering the proposed disposition of property in the Centre City Redevelopment Project area pursuant to a Disposition and Development Agreement with Lankford and Associates, Inc. (the "Developer").
The proposed disposition of property to the Developer or its assignee will be made in accordance with the California Community Redevelopment Law and pursuant to a proposed Disposition and Development Agreement between the Agency and the Developer, and subject to covenants, conditions and restrictions necessary to carry out the Redevelopment Plan for the Centre City Redevelopment Project.
The property proposed to be conveyed to the Developer or its assignee consists of that property located in the Centre City area of the City of San Diego which is illustrated and designated as the "Site" on the Site Map accompanying this Notice. The property will be sold by the Agency to the Developer or its assignee, and will be developed with a mixed-use development consisting of two structures including: (1) a five-story office building containing approximately 111,000 gross square feet (consisting of approximately 85,000 gross square feet of office space and approximately 19,000 gross square feet of retail space); and (2) a 19-story residential building containing approximately 264,000 gross square feet (consisting of approximately 299 residential condominiums and 9,000 square feet of retail space).
The joint public hearing will be held to consider:
1.The proposed sale of such real property in the Centre City Redevelopment Project area (with an option to purchase) by the Agency for the development described in this Notice; and
2.The proposed Disposition and Development Agreement submitted to the Agency in the form desired by the Developer, which provides for the proposed sale (and purchase option) of the property by the Agency to the Developer's assignee.
The following documents are available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the offices of the City Clerk, 202 C Street, City Administration Building, 2nd Floor, San Diego, California 92101 and at the offices of the Centre City Development Corporation, 225 Broadway, Suite 1100, San Diego, California 92101:
1. A copy of the proposed Disposition and Development Agreement.
2. A summary report which describes and specifies:
a.The costs to be incurred by the Agency under the Disposition and Development Agreement;
b. The estimated value of the interests to be conveyed pursuant to the Disposition and Development Agreement, determined at the highest and best uses permitted under the Centre City Redevelopment Plan;
c. The estimated value of the interests to be conveyed pursuant to the Disposition and Development Agreement, determined at the use and with the conditions, covenants and development costs required by the Disposition and Development Agreement;
d. The compensation which the Developer will be required to pay pursuant to the Disposition and Development Agreement;
e. If the total consideration is less than the fair market value of the interests to be conveyed, determined at the highest and best use consistent with the Centre City Redevelopment Plan, an explanation of the reasons for the difference;
f. An explanation of why the conveyance of the property will assist in the elimination of blight.
At any time before the date and time set forth above for the joint public hearing by the City Council and Agency, any written comments on or objections to the proposed Disposition and Development Agreement, or to the proposed conveyance of the property pursuant thereto, may be filed with the City Clerk. Comments may also be submitted during such period on the summary report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on any or all such matters at the joint public hearing will be given an opportunity to appear and be so heard. If you later desire to challenge actions of the Agency or City Council in connection with this transaction, you could be limited to raising issues you have raised at or before the public hearing.
