NOTICE IS HEREBY GIVEN that the Board of Supervisors of the County of San Diego will conduct a public hearing on General Plan Amendment (GPA) 10-002, which includes the Tiered Winery Use project, the Density Bonus Ordinance project, and the Montecito Ranch project, as follows:

PROJECT/CASE NUMBER(S): GPA 10-002: Item A: Tiered Winery Use GPA and Zoning Ordinance Amendment (GPA 10-003, POD 08-012); Item B: Density Bonus GPA and Zoning Ordinance Amendment (GPA 09-003, POD 08-002); and Item C: Montecito Ranch GPA(GPA 04-013), Specific Plan (SP 01-001), Zone Reclassification (R 04-022), 417 Lot Residential Subdivision (TM 5250 RPL6), Major Use Permits (P 04-045, P 09-023), and Site Plan (S 08-019).

PROJECT DESCRIPTIONS: Item A: The Tiered Winery Use project consists of an amendment to the Agricultural Use Regulations of the Zoning Ordinance (zones A70 and A72) to introduce a new winery classification and revise the regulations for two existing winery classifications. The new “Packing and Processing: Small Winery” use type requires an administrative permit and is subject to specified standards and production limitations. The existing classification “Packing and Processing: Boutique Winery” is revised to allow this use by right, subject to specified standards and limitations. The existing classification “Packing and Processing: Wholesale Limited Winery” is revised to increase the production limitation. In addition, Policy 2 of the Regional Land Use Element of the San Diego County General Plan (GPA 10-003) is revised to exempt the Winery Use classifications from provisions of the (18) Multiple Rural Use and (24) Impact Sensitive Land Use Designation relating to developments which may pose environmental impacts within these designations.
Item B: The Density Bonus project is an amendment to the San Diego County Zoning Ordinance (POD 08-002) to amend provisions related to the County density bonus program and an amendment to the Regional Land Use Element of the San Diego County General Plan (GPA 09-003) to amend Policy 3.6 related to density exceptions for compliance with the density bonus program and to repeal Policy 3.8 related to density bonuses for mobile home parks.
Item C: Montecito Ranch is a residential development project consisting of 417 single family residences, 8.3 acre public park, 11.9 acre historic park, and 571.2 acres of biological open space on a 935.2 acre site. Residential lots would range in size from 20,000 square feet to 1.8-acres in size. The project is subject to Regional Land Use Element Policy 1.3 (EDA) Estate Development Area and General Plan Land Use Designations (21) Specific Planning Area (0.5) and (18) Multiple Rural Use, and is currently zoned (S-88) Specific Plan area and A-70 (Limited Agricultural). The Project site is approximately one mile northwest of the Ramona Town Center. State Route 78 (SR 78) borders the northern Project site boundary, while Montecito Way stems from the southern Project site boundary. The project is located within the Ramona Community Plan area of an unincorporated area of the County of San Diego.

A GPA is proposed to modify the Circulation and Land Use Elements, and the Ramona Community Plan. The Circulation Element Amendment includes (1) Eliminating SA 603 between Pine Street and Rangeland Road; (2) Relocating SA 330 between Sonora Way and Montecito Road to Montecito Way; (3) Revising the classification of Montecito Way and Montecito Road from a Rural Collector to a Rural Light Collector; (4) Adding SA 330 between Sonora Way and Pine Street. The GPA proposes to re-designate a 2.13-acre parcel from (18) Multiple Rural Use Designation to a (21) Specific Planning Area designation. Finally, the amendment proposes to eliminate industrial and agricultural land uses in the Montecito Ranch chapter of the Ramona Community Plan and to identify the proposed park, equestrian facility and Historic Montecito Ranch House site instead.

A Specific Plan is proposed for the systematic implementation of the proposed project which identifies permitted uses and their proper location, project phasing, and site design criteria. Additionally, a Rezone is proposed to establish generalized development regulations that are consistent with the Specific Plan and a Major Use Permit is proposed to identify landscape and design standards for the proposed development.

A Vesting Tentative Map is proposed to subdivide the 935.2-acre site into 417 residential lots, 7 open space lots, 1 lot for the park site, 1 lot for the historical site/equestrian facility and several HOA landscape/utility lots. The associated Site Plan illustrates setback and height regulations to vest the proposed tentative map.

The project would include the construction of Montecito Ranch Road, which would connect Ash Street to Montecito Way, as well as several local neighborhood streets. The project also includes improvement of segments along Ash Street and Montecito Road, as well as six off-site intersections. These intersections include Pine Street/Ash Street, Pine Street/Main Street, Main Street/Montecito Road, Montecito Way/Montecito Road, Highland Valley Road/Dye Road/SR 67, and Archie Moore Road/SR 67.

The proposal also includes two options for wastewater disposal. Option 1 would rely on the Ramona Municipal Water District for sewer service; whereas Option 2 would require the construction and operation of an on-site Wastewater Reclamation Facility. A Major Us

Permit for the Wastewater Reclamation Facility has been proposed if the decision-making body supports Option 2.

LOCATION: Items A and B: The unincorporated county. Item C: The project is located approximately one mile northwest of the Ramona Town Center, south of State Route 78 and west of Ash Street.

ENVIRONMENTAL STATUS: Item A: A Draft Environmental Impact Report (EIR) has been prepared for this project, as well as Section 15091 Findings Regarding Significant Effects of the Project. A Statement of Overriding Considerations has also been prepared. These documents are on file with the Department of Planning and Land Use (DPLU) as Environmental Review Number 08-00-004. Item B: It is recommended that the proposal be determined to be exempt from environmental review under Section 15060(c)(1) of the State California Environmental Quality Act Guidelines, because the proposed amendments are consistent with the requirements and intent of California Density Bonus Law (Government Code 65915 et seq.). Other portions of the project are exempt under Section 15061(b)(3) because it can be seen with certainty that there is no possibility that these actions may have a significant effect on the environment. Item C : An EIR has been prepared for this project, as well as Section 15091 Findings Regarding Significant Effects of the Project. A Statement of Overriding Considerations has also been prepared. These documents are on file with the Department of Planning and Land Use as Log No. 01-09-013.

PLANNING COMMISSION RECOMMENDATION: Item A: On April 30, 2010, the Planning Commission recommended approval of the Tiered Winery Zoning Ordinance Amendment with some additional recommendations and direction to staff regarding specific provisions of the amendment. On June 25, 2010, a motion by the Planning Commission to recommend approval of the related GPA failed (3-2-0 with two members absent). Under Planning Commission Policy Number PC-2, the failure of the motion to receive four votes is deemed to be a recommendation by the Planning Commission that the GPA be disapproved. Item B: On April 30, 2010, the Planning Commission recommended approval of the project. . Item C: On April 2, 2010, the Planning Commission recommended approval of the project, including approval of the Major Use Permit for the on-site Wastewater Reclamation Facility. In addition, the Commission directed staff to work with the resource agencies to resolve concerns regarding trails, side edge effect and habitat preservation and require that the applicant apply to the National Register of Historic Places for designation of the historic ranch house.
