Sealed bids will be received and publicly opened at the Metropolitan Wastewater Department, 9192 Topaz Way, San Diego, California until 1:30 p.m., on the 31ST day of August 2006, for work pertaining to the General Requirements Contract 2006A (also referenced herein as “the Contract”), Bid #K06118. The Bids will then be opened and read aloud that same day and time in conference room 1D of the Metropolitan Wastewater Department at said location.
OBTAINING CONTRACT DOCUMENTS: Contract Documents, Specifications and Plans may be obtained from the Records Management Unit of the Metropolitan Wastewater Department at the above address or by calling (858) 292-6493 upon a non-refundable payment of $25.00 (TWENTY-FIVE Dollars) for each set of documents.
PRE-QUALIFICATION OF CONTRACTORS: As of February 1, 2003 Contractors who intend to bid on Public Works Projects over $250,000 for the City of San Diego must be pre-qualified. Bids from Contractors who have not been pre-qualified will not be considered.
DESCRIPTION OF WORK:
This Notice Inviting Bids is for the General Requirements Contract, a competitively bid, firm, fixed priced, indefinite quantity contract. The scope of work includes a collection of detailed repair and construction tasks and specifications that have pre-established unit prices listed in a Unit Price Book (UPB). The UPB pricing incorporates the use of experienced labor, high quality materials, local activity, climate and geographic factors. All work under this Contract will be performed for the Metropolitan Wastewater Department, City of San Diego. The work will involve the repair, alteration, modernization, maintenance, rehabilitation, reconstruction, or construction of public buildings, streets, utilities, and other public works. Under this Contract, the Contractor furnishes all management, documentation, design and incidental drawings (as required), labor, materials and equipment needed to perform the work.
LOCATION OF WORK: Work will be distributed throughout the boundaries of the County of San Diego, California. All work under this Contract will be performed for Public Works for the Metropolitan Wastewater Department, City of San Diego, except for Emergency Work declared by the City Manager in accordance with the Municipal Code.
EQUAL OPPORTUNITY CONTRACTING: The City of San Diego will not discriminate with regard to race, color, sex, national origin or disability in the award of contracts. The City will ensure that full access to programs, services, meetings, and activities comply with section 504 Title V of the Rehabilitation Act and the Americans with Disabilities Act (ADA) 1990, Public Law 101-336. Bids from DBE/DVBE contractors are particularly encouraged. Contractors are STRONGLY ENCOURAGED to utilize DBE/DVBE subcontractors and/or Joint Ventures with DBE/DVBE's.
MANDATORY PRE-BID CONFERENCE: There will be a MANDATORY pre-bid conference to discuss the scope of the project, bidding requirements and the City's Equal Opportunity Program requirements and reporting procedures in the Metropolitan Wastewater Department Conference Room 1D of 9192 Topaz Way, San Diego, CA, at 9:30 a.m., on the 10th day of August 2006. Because of the distinct nature of the work and the type of contract (Firm-Fixed-Price, Indefinite-Quantity), the City encourages Project Managers and Estimators and other Key Personnel to attend the Pre-bid conference; however, the Principal whose signature appears on the Bidding Documents will be required to attend the pre-bid conference in order for their prospective bid to be accepted. Important information will be disseminated regarding the scope of the contract, bidding requirements, and the City's Equal Opportunity Program requirements and reporting procedures. To request a copy of the agenda in an alternative format, or to request a sign language or oral interpreter for this meeting, call the Metropolitan Wastewater Department, Services and Contracts Division at telephone number (858) 292-6300 at least five working days prior to the meeting to ensure availability.
CONTRACTOR'S LICENSE CLASSIFICATION: In accordance with the provisions of California Law, the City has determined that the Contractor shall possess a valid "Class A" license at the time that the bid is submitted. The successful bidder will be required to self perform 50% of the Maximum Contract Amount. This self-performed work shall include, at a minimum, all pipeline work until the 50% requirement is satisfied. Failure to possess the specified license at the time of the submission of the bid shall render the bid non-responsive and the bid will be rejected.
SAN DIEGO LICENSE: All Contractors, including Subcontractors, not already having a City of San Diego license for the work contemplated will be required to secure the appropriate license from the City Treasurer, City Operations Building, Community Concourse, before a contract can be awarded.
BID SECURITY: Each Bid shall be accompanied by a certified or cashier's check or Bid Bond in the amount of $25,000 (TWENTY FIVE THOUSAND Dollars) payable to the City of San Diego as a guarantee that the Bidder: (1) will provide the information required within the time specified in the - BID FORMS of the package if the Bidder is the Apparent Low Bidder; and (2) will promptly execute the Agreement if its Bid is accepted. A bid shall not be considered unless one of the forms of Bidder's security is enclosed with it.
STATE WAGE RATE DETERMINATION: The general prevailing rate of wages, as determined by the Director of the California Department of Industrial Relations, are applicable to this contract as specified in Volume 1 of the Contract Documents.
SECURITIES DEPOSIT IN LIEU OF RETENTION: Pursuant to Section 22300 of the Public Contract Code of the State of California, the Contractor has the option to deposit securities with an escrow agent as a substitute for retention earnings required to be withheld by this contract.
ACCEPTANCE OF BIDS: The City reserves the right to cancel this Notice Inviting Bids at any time, and further reserves the right to reject all submitted bids, without giving any reason for such action, at its sole discretion and without liability. All costs incurred by bidders as a result of preparing bids under this Notice Inviting Bids shall be the sole responsibility of each bidder. TOBACCO PRODUCTS AT PUBLIC PARKS AND BEACHES

Existing sections of the San Diego Municipal Code prohibit the use of tobacco in public places except in designated areas. This ordinance makes it illegal to smoke in beaches and parks owned or controlled by the City of San Diego except in clearly-marked smoking areas authorized by the City of San Diego.
Existing law prohibits the improper disposal of boxes, waste paper, remains of meals, newspaper, or rubbish of any kind at public parks or beaches, except in trash receptacles. This ordinance would make it similarly unlawful at public parks and beaches to dispose of tobacco or any remains of material capable of being smoked except in trash receptacles.

AN ORDINANCE OF THE CITY OF SAN DIEGO APPROVING THE TRANSFER OF A SOLID WASTE COLLECTION FRANCHISE FROM EXPRESS WASTE & ROLL OFF SERVICES, LLC, TO EXPRESS WASTE & RECYCLING, INC; AUTHORIZING THE EXECUTION OF A CLASS I NON-EXCLUSIVE SOLID WASTE COLLECTION FRANCHISE WITH EXPRESS WASTE & RECYCLING, INC; AND FINDING NO ENVIRONMENTAL IMPACT BY THIS ACTION.

WHEREAS, by Ordinance No. O-18849, adopted on September 18, 2000, the City Council approved the award of a non-exclusive solid waste collection franchise to Express Waste & Roll Off Services, LLC; and
WHEREAS, Express Waste & Recycling, Inc., has applied for, and Express Waste & Roll Off Services, LLC has consented to, the transfer of the franchise to Express Waste & Recycling, Inc., which transfer is in the best interests of the City; NOW, THEREFORE,
BE IT ORDAINED, by the Council of the City of San Diego, as follows:
Section 1. That the transfer of a non-exclusive solid waste collection franchise from Express Waste & Roll Off Services, LLC, to Express Waste & Recycling, Inc. is heeby approved.
Section 2. That the Mayor is hereby authorized to execute, for and on behalf of the City, a Class I non-exclusive solid waste collection franchise agreement with Express Waste & Recycling, Inc., under the terms and conditions set forth in the Franchise Agreement, on file in the office of the City Clerk as Document Number OO-19517.
Section 3. That this activity is not subject to the California Environmental Quality Act pursuant to CEQA guideline 15060(c)(2) because this activity will not result in a direct or reasonably foreseeable indirect physical change in the environment.
Section 4. That a full reading of this ordinance is dispensed with prior to its final passage, a written or printed copy having been available to the City Council and the public a day prior to its final passage.
Section 5. That this ordinance shall take effect and be in force on the thirtieth day from and after its final passage.

AN ORDINANCE CALLING A MUNICIPAL SPECIAL ELECTION IN THE CITY OF SAN DIEGO ON TUESDAY, NOVEMBER 7, 2006, FOR THE PURPOSE OF
SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY ONE OR MORE
BALLOT PROPOSITIONS; AND CONSOLIDATING THE MUNICIPAL SPECIAL ELECTION WITH THE CALIFORNIA STATE GENERAL ELECTION TO BE
HELD ON THE SAME DATE.

BE IT ORDAINED, by the Council of the City of San Diego, as follows:
Section 1. A Municipal Special Election is hereby called and ordered to be held in the City of San Diego on November 7, 2006.
Section 2. Pursuant to Section 223 of the Charter of the City of San Diego, Section 3(b) of Article XI of the Constitution of the State of California, and Section 9255(a)(2) of the California Elections Code, all dealing with Charter Amendments; and, pursuant to Section 23 of the Charter of the City of San Diego and Section 27.1001 of the San Diego Municipal Code pertaining to initiative measures submitted by petition or by action of the City Council, the Council of the City of San Diego by separate ordinances may submit to the qualified voters of the City one or more ballot propositions at the November 7, 2006 Municipal Special Election.
Section 3. The propositions shall be presented and printed upon the ballot and submitted to the voters in the manner and form set out in the separate ordinances placing the propositions on the November 7, 2006, ballot.
Section 4. The propositions submitted by separate ordinances for placement on the November 7, 2006, ballot, if any, shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the proposition as provided in California Elections Code section 13116.
Section 5. City propositions to be submitted to the voters at the November 7, 2006, Municipal Special Election, if any, shall appear, pursuant to San Diego Municipal Code section 27.0507, on the ballot in the following order:
(a) Initiative measures, including both measures placed on the ballot by petition and measures placed on the ballot by action of the City Council pursuant to San Diego Municipal Code section 27.1001, in the order in which the ordinances placing the initiatives on the ballot are adopted by the City Council;
(b) Bond measures in the order in which the ordinances placing them on the ballot are adopted by the City Council;
(c) Charter amendments in the order in which the ordinances placing them on the ballot are adopted by the City Council;
(d) Other legislative measures in the order in which the ordinances placing them on the ballot are adopted by the City Council;
(e) Referendum measures in the order in which the ordinances placing them on the ballot are adopted by the City Council; and
(f) Advisory matters in the order in which the ordinances placing them on the ballot are adopted by the City Council.

Section 6. The polls for this Municipal Special Election shall be open from 7:00 a.m. (local time) on November 7, 2006, and remain open continuously until 8:00 p.m. (local time) on the same day. The polls shall close at 8:00 p.m., except as provided in California Elections Code section 14401.
Section 7. The Municipal Special Election called for November 7, 2006, in the City of San Diego is hereby ordered consolidated with the California State General Election to be held on the same date. Within the City of San Diego precincts, polling places and officers of the election for the Municipal Special Election shall be the same as those provided for the California State General Election.
Section 8. The Registrar of Voters of the County of San Diego is hereby authorized to canvass returns of this Municipal Special Election. The Registrar of Voters shall communicate the results of the canvass to the San Diego City Clerk, who shall in turn certify the results to the Council of the City of San Diego. The City Council shall then declare the results of the Municipal Special Election by resolution.
Section 9. Within the City of San Diego only one form of ballot shall be used.
Section 10. Since this election is to be consolidated with the California State General Election, and since the County Registrar of Voters is authorized to canvass the returns of this Municipal Special Election, and since only one form of ballot is authorized, the method of voting upon the propositions shall be provided in the California Elections Code.
Section 11. Except as otherwise provided in this ordinance, the Municipal Special Election called for November 7, 2006, shall be conducted as provided by law for other Municipal Elections in the City of San Diego.
Section 12. The City Clerk shall cause this ordinance to be published once in the official newspaper of the City of San Diego. No other notice of the election need be given.
Section 13. Pursuant to Section 275(c), 295(b) and 295(d) of the Charter of the City of San Diego, this ordinance relating to elections may be passed by the City Council on the date of introduction, which date shall be deemed the date of final passage, and is not subject to veto by the Mayor.

A RESOLUTION DECLARING THE RESULTS OF THE
MUNICIPAL PRIMARY ELECTION HELD IN THE CITY OF
SAN DIEGO ON JUNE 6, 2006.

WHEREAS, a municipal primary election was held in the City of San Diego on Tuesday, June 6, 2006, pursuant to the provisions of Ordinance No. O-19463 (New Series), adopted February 6, 2006, for the purpose of nominating candidates and, if any candidate received a majority of all votes cast, for the purpose of electing that candidate; and
WHEREAS, a copy of the certificate of the Registrar of Voters of San Diego County canvassing the returns of the municipal primary election, as certified to the City Clerk, has been duly received; and
WHEREAS, a canvass of these elections has been completed and the City Clerk has certified the results to the City Council; and
