As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Map Waiver to convert four existing residential units to condominiums on a 0.16-acre site and waive the requirement to underground existing overhead utilities. The property is located at 4128-4132 Oregon Street in the
MR-1250B Zone of the Mid-City Communities Planned District within the Greater North Park Community Plan, Council District 3.
Should the condominium conversion project be approved, tenants may be required to vacate the premises. No units may be sold in this building unless the conversion is approved by the city and until after a public report is issued by the Department of Real Estate. Each tenant has the exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions that such unit will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 90 days from the date of issuance of the subdivision public report pursuant to Section 11018.2 of the Business and Professions Code, unless the tenant gives prior written notice of his or her intention not to exercise the right.

The decision of the Hearing Officer is final unless appealed to the Planning Commission. The appeal application may be obtained at the Development Services Department, Project Management Section, Reception Desk; located at 1222 First Avenue, 3rd Floor, San Diego, CA. The appeal must be made within 10 working days of the Hearing Officer's decision.
This project was determined to be categorically exempt from the California Environmental Quality Act on November 3, 2005 and the opportunity to appeal that determination ended November 18, 2005.
The decision made by the Planning Commission is the final decision by the City.

AN ORDINANCE AMENDING CHAPTER 8, ARTICLE 3, DIVISION 1, OF THE SAN DIEGO MUNICIPAL CODE RELATING TO PEDICAB BY AMENDING
SECTIONS 83.0102 THROUGH 83.0104, 83.0106, 83.0117, 83.1023 THOUGH 83.1025, 83.1028, 83.0130, AND 83.1033; REPEALING SECTIONS 83.0108, 83.0109, 83.0121, 83.0131, AND 83.0132; RENUMBERING 83.0110 AND 83.0111.

This ordinance makes changes to the City of San Diego's laws regulating pedicabs. It contains amendments pertaining to procedures and standards for obtaining operating permits. It clarifies that a valid permit is required to operate a pedicab, and adds a provision invalidating an operating permit if it altered, defaced, forged, or counterfeited. It authorizes the City Manager to develop a Code of Conduct designating certain manners of operating pedicabs as unacceptable and requires the submission of a signed Code of Conduct as part of the application process. It modifies the requirement of a valid driver's license to require a valid California driver's license,.
This ordinance amends the list of equipment that must be installed on a pedicab to include seatbelts and a unique, nontransferable identification number, and deletes the requirement for side mirrors. It also authorizes the City Manager to develop regulations specifying the size, format, and location of the required fare schedule.
This ordinance adds prohibitions as to where pedicabs may be parked, stopped or left standing, makes it unlawful to operate a pedicab in violation of the Code of Conduct, and makes it unlawful to operate pedicabs on the Martin Luther King promenade.
This ordinance consolidates the grounds for the denial, suspension or revocation of operating permits or decals into one section, clarifies the procedures for notifying pedicab owners or operators of action by the City Manager regarding the denial, suspension or revocation of an operating permit or decal, and adds additional pre-deprivation procedures regarding the suspension or revocation of an operating permit or decal.
The ordinance also contains minor amendments to conform this division to modern Municipal Code conventions.

REDEVELOPMENT PROJECT.
This ordinance amends the Redevelopment Plan for the College Community Redevelopment Project Area [Project Area] by (i) extending the Redevelopment Agency's eminent domain authority within the Project Area for an additional twelve years, (ii) excluding the following buildings/parcels from the Project Area: University Towers (formerly El Conquistador); and 5702 Hardy Avenue (APN 466-031-09 and 466-050-11), and (iii) language amendments pertaining to specific land use/development restrictions within the Redevelopment Plan by deleting specific land use/development allotments and, alternatively, defaulting to applicable state and local codes, plans, and laws to dictate allowable buildings types, size, heights and amounts.
