Draft San Diego Regional Analysis of Impediments to Fair Housing Choice

Under Title 1 of the Housing and Community Development Act of 1974, as amended, The City of San Diego invites citizens to participate in the preparation of the San Diego Regional Analysis of Impediments to Fair Housing Choice (AI). The AI is an analysis that represents conclusions about impediments to fair housing choice, as well as actions necessary to address any identified impediments.
Notice is hereby given that the AI is available for a 30-day public review from July 1, 2010 through July 30, 2010. The purpose of the review is to provide the public with an opportunity to comment on the analysis, conclusions on impediments to fair housing choice and solutions to mitigate or remove such impediments.
The draft document will be available in the reference section of all City of San Diego libraries and at the CDBG Program office located at 1200 Third Avenue, Suite 1400, San Diego, CA 92101. The plan will also be available for review on the City's CDBG Program website (www.sandiego.gov/cdbg/general/) and the Housing Commission's website (www.sdhc.org.).
A schedule of community meetings in which the draft AI will be presented is listed in the City's CDBG Program website. Public comments may be provided at these meetings or can be submitted in writing to the CDBG Program office in person, via mail, or via e-mail (CDBG@sandiego.gov). All information and updates regarding this process will be posted on the City's CDBG website.

AN ORDINANCE AMENDING CHAPTER 6, ARTICLE 3, DIVISION 0 OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 63.20.5, RELATING TO WASTE, REFUSE, AND FIRES IN BEACH AREAS.
This ordinance amends Chapter 6, Article 3, Division 0 of the San Diego Municipal Code relating to waste, refuse and fires in beach areas. On November 4, 2008, the voters of the City of San Diego passed Proposition D, which amended San Diego Municipal Code section 56.54 to make consumption of alcohol unlawful 24 hours a day at City beaches, Mission Bay Park, and all coastal parks. This ordinance enacts minor amendments to the Code that are necessary for purposes of clarity and consistency with the provisions of Proposition D.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its passage, since a written or printed copy will be available to the City Council and the public prior to the day of its passage.
This ordinance shall take effect and be in force on the thirtieth day from and after its final passage.

AN ORDINANCE AMENDING CHAPTER 5, ARTICLE 6, DIVISION 0 OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 56.54 AND ITS APPENDICES BY ADDING BALBOA PARK TO THE 24 HOUR BAN, EXCEPT FOR DESIGNATED LAWN AREAS, AND REPEALING SECTIONS 56.70, 56.71, AND 56.72, ALL RELATING TO ALCOHOLIC BEVERAGE CONSUMPTION PROHIBITED IN CERTAIN AREAS.
This ordinance amends Chapter 5, Article 6, Division 0 of the San Diego Municipal Code relating to the prohibition of alcoholic beverage consumption in certain areas of Balboa Park. The amendments delete that portion of Balboa Park bounded by Upas Street on the north, Highway 163 on the west, Interstate 5 on the south and Park Boulevard on the east from the 12 Hour Ban, add that portion of Balboa Park to the 16 Hour Ban, and limit alcohol consumption within that portion to nine designated lawn areas. With the exception of these nine designated lawn areas, all of Balboa Park will now be included in the 24 Hour Ban.

This ordinance creates the Consolidated Plan Advisory Board (Board) by amending Chapter 2, Article 6 of the San Diego Municipal Code by adding Division 21, sections 26.2101, 26.2102, 26.2103, 26.2104, 26.2105, 26.2106, 26.2107, 26.2108, 26.2109, 26.2110, 26.2111, 26.2112, and 26.2113 to the San Diego Municipal Code. The formation of the Consolidated Plan Advisory Board is necessary in order to comply with City Council Policy No. 700-02, the City's efforts to reform the City's administration of the Community Development Block Grant (CDBG) Program, and the fair distribution of CDBG and other federal entitlement grant funds to eligible organizations. The purpose of the Board is to provide advice and recommendations to the Mayor, City Council, and City Manager on all policy issues related to the United States Department of Housing and Urban Development's Consolidated Plan, the Annual Action Plan, the Emergency Shelter Grant (ESG) Program, the HOME Partnership Program, and the Housing Opportunities for Persons with AIDS (HOPWA) Program. The ordinance establishes the selection process and qualifications for the nine members of the Board. It also sets forth the length of terms and the process for filling vacancies. In addition, the ordinance imposes conflict of interest disclosure requirements and lobbying restrictions on Board members. The duties and functions of the Board include providing recommendations regarding actions and goals associated with the Consolidated Plan, ensuring the greatest possible participation in this process, and making funding recommendations to the City Council through the open and impartial evaluation of applications for CDBG and ESG funding. The ordinance also requires the Board to provide a report to the Public Safety and Neighborhood Services Committee twice a year.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, a written or printed copy having been available to the City Council and the public prior to the day of its passage.
This ordinance shall take effect and be in force on the thirtieth day from and after its final passage.

AN ORDINANCE AMENDING CHAPTER 8, ARTICLE 6, DIVISION 00, OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 86.06 RELATED TO THE STOPPING, STANDING, AND PARKING OF VEHICLES.
WHEREAS, the San Diego Municipal Code was amended on September 11, 2009 to revise regulations concerning the operation of pedicabs within the City; and
WHEREAS, these regulations include provisions on the parking of pedicabs within the City; and
WHEREAS, this amendment to the San Diego Municipal Code will authorize the City Manager to designate areas within the City as Pedicab Parking Zones and Pedicab Resting Zones; NOW, THEREFORE,
BE IT ORDAINED, by the Council of the City of San Diego, as follows:
Section 1. That Chapter 8, Article 6, Division 00, of the San Diego Municipal Code is amended by amending section 86.06, to read as follows:
§86.06 Parking, Standing, Loading Zones, Street Sweeping Zones
Except as provided in section 75.0604 of this Municipal Code for
establishment of jitney holding zones, the City Manager is hereby authorize
to determine the location of Loading Zones, Passenger Loading Zones,
Bus Loading Zones, Taxi Zones, prohibited Standing or Parking Zones,
Time-Limited Parking Zones of 30 Minutes or Less, Time-Limited Parking
Zones for Ballpark Event Residential Permit Parking Districts, Safety Zones,
Disabled Persons Parking Zones, Alley Parking Zones, Consular Parking
Zones, Street Sweeping Zones, Pedicab Resting Zones, and Pedicab
Parking Zones. Such zones shall be effective when appropriate signs or
curb markings giving notice thereof are erected upon such zones.
Section 2. That a full reading of this ordinance is dispensed with prior to its passage, a written or printed copy having been available to the City Council and the public prior to the day of its passage.
Section 3. That this ordinance shall take effect and be in force on the thirtieth day from and after its final passage.
