Project Description: CONDITIONAL USE PERMIT (CUP), and SITE DEVELOPMENT PERMIT (SDP), for a Capital Improvement Program (CIP) project to construct a new multi-purpose sports stadium with a permanent seating capacity of up to 68,000 seats, expanding to approximately 72,000 seats for special events, and capable of hosting National Football League (NFL) football games, other professional and amateur sports, entertainment, cultural and commercial events. The new stadium would have a maximum height of 250 feet and would cover an area of approximately 750,000 square feet (approximately 17 acres) with an approximate floor area of 1,750,000 square feet in the north east corner of the site. The existing Qualcomm stadium will be demolished subsequent to construction of the new stadium. The project will also construct associated hardscape and landscape improvements throughout the project site. The project would pursue Leadership in Energy and Environmental Design (LEED) Gold Certification. The developed 166-acre stadium site is located at 9449 Friars Road. The parcel is located in the Mission Valley Community Plan area and is predominantly designated Commercial Recreation and Public Recreation in the Mission Valley Community Plan, with a small section designated Planning Area 8/Floodway in the Mission City Specific Plan. The Site is zoned MVPD-MV-CV (Mission Valley-Commercial Visitor), and MVPD-MV-M/SP (Mission Valley-Multi-use/Specific Plan), and is within the Transit Area Overlay Zone, and the Federal Aviation Administration (FAA) Part 77 Notification Area. The site is adjacent to the Multi-Habitat Planning Area (MHPA) and the San Diego River Park Master Plan River Corridor Area and the River Influence Area extend into the southern portion of the Project site parking lot.

Applicant: City of San Diego Public Works Department on behalf of City of San Diego Real Estate Assets Department.

Recommended Finding: The draft EIR concludes that the project would result in significant environmental impacts to the following areas: Air Quality and Odor, Biological Resources, Hazardous Materials/Human Health/Public Safety, Historical Resources, Hydrology and Water Quality, Land Use, Mobility (Circulation), Noise, Paleontological Resources, Visual Effects and Neighborhood Character, and Cumulative.

BE IT ORDAINED, by the Council of the City of San Diego, as follows:

Section 1. That 43 acres located in Chollas Triangle and legally described as in the boundary description filed in the office of the City Clerk under Document Diagram B-4310, within the Mid-City Communities Plan area, in the City of San Diego, California, as shown on Zone Map Drawing Nos. B-4309, which includes but not limited to the parcels identified in Exhibit A, filed in the office of the City Clerk as Document No. OO-20541-1 and as shown on Zone Map Drawing No. B-4309, filed in the office of the City Clerk as Document No. OO-20541-2, are rezoned from CC-5-3 and IL-2-1 zones to the CC-3-5 and AR-1-1 zones, as the zones are described and defined by San Diego Municipal Code Chapter 13 Article 1. The parcels identified in Exhibit A are subject to Chapter 13 Article 2 Divisions 15. This action amends the Official Zoning Map adopted by Resolution R-301263 on March 14, 2006.

Section 2. That Ordinance No. O-18754 N.S. adopted September 8, 1998, of the ordinances of the City of San Diego is repealed insofar as the same conflict with the rezoned uses of the land.

Section 3. That a full reading of this Ordinance is dispensed with prior to passage, a written copy having been made available to the Council and the public prior to the day of its passage.

Section 4. This Ordinance shall take effect and be in force on the thirtieth day from and after its passage, and no building permits for development inconsistent with the provisions of this ordinance shall be issued unless application therefore was made prior to the date of adoption of this Ordinance.

This ordinance amends the San Diego Municipal Code to comply with recent amendments to the California density bonus statutes, specifically: the term of affordability has been increased from 30 to 55 years for low and very low income households, the affordable for-sale housing requirement now includes low and very low income households, and low or very low income dwelling units displaced by proposed development must be replaced, as specified, in order to be eligible for a density bonus. Other amendments address inconsistency in the use of terms, protection of coastal resources, consistent with density bonus ordinances already certified by the California Coastal Commission as local coastal program amendments, amendments to moderate housing density bonus to reflect state law, and re-organization of Chapter 14, Article 3, Division 7. In addition, this ordinance readopts the existing provisions of Chapter 14, Article 3, Division 7 that are not amended.

This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to passage, a written copy having been available to the City Council and the public prior to the day of its passage.

Prior to becoming effective, this ordinance shall be submitted to the San Diego County Regional Airport Authority (SDCRAA) for a consistency determination.

If the SDCRAA finds this ordinance consistent with the Airport Land Use Compatibility Plans (ALUCP) for San Diego International Airport, Marine Corps Air Station (MCAS) Miramar, Gillespie Field, Montgomery Field, and Brown Field Airports (collectively, Airports), this ordinance shall take effect and be in force as of the date of the finding of consistency by SDCRAA, provided that and not until at least 30 days have passed from the final date of passage, except that the provisions of this ordinance inside the Coastal Overlay Zone, which are subject to California Coastal Commission jurisdiction as a City of San Diego Local Coastal Program amendment shall not take effect until the date the California Coastal Commission unconditionally certifies those provisions as a local coastal program amendment.

If the SDCRAA determines that this ordinance is inconsistent or conditionally consistent, subject to proposed modifications, with the ALUCPs for the Airports, the ordinance shall be submitted to the City Council for reconsideration.

If the SDCRAA determines that this ordinance is conditionally consistent with the ALUCPs for the Airports, but that consistency is subject to proposed modifications, the City Council may amend this ordinance to accept the proposed modifications, and this ordinance as amended shall take effect and be in force on the thirtieth day from and after its final passage, except that the provisions of this ordinance as amended inside the Coastal Overlay Zone, which are subject to California Coastal Commission jurisdiction as a City of San Diego Local Coastal Program amendment shall not take effect until the date the California Coastal Commission unconditionally certifies those provisions as a local coastal program amendment.

A proposed decision by the City Council to overrule a determination of inconsistency or to reject the proposed modifications for a finding of conditional consistency shall include the findings required pursuant to Public Utilities Code section 21670 and require a two-thirds vote; the proposed decision and findings shall be forwarded to the SDCRAA, California Department of Transportation, Division of Aeronautics, and the airport operators for the Airports; and the City Council shall hold a second hearing not less than 45 days from the date the proposed decision and findings were provided, at which hearing any comments submitted by the public agencies shall be considered and any final decision to overrule a determination of inconsistency shall require a two-thirds vote.

This Ordinance amends the San Diego Municipal Code to create a Community Plan Implementation Overlay Zone to implement a new plan for the future development of the Chollas Triangle area of the Mid-Cities Community. The Community Plan Implementation Overlay Zone for the Chollas Triangle area requires a discretionary Site Development Permit for all development within the approximately 43-acre area.

This Ordinance contains a notice that a full reading of this Ordinance is dispensed with prior to passage, a written copy having been made available to the Council and the public prior to the day of its passage.
