The City of San Diego Land Development Review Division has prepared a draft Mitigated Negative Declaration for the following project and is inviting your comments regarding the adequacy of the document. Your comments must be received by August 28, 2005 to be included in the final document considered by the decision-making authorities. Subject: Stella: COMMUNITY PLAN AMENDMENT, LOCAL COASTAL PROGRAM AMENDMENT, AMENDMENT TO THE PROGRESS GUIDE AND GENERAL PLAN, SITE DEVELOPMENT PERMIT, VESTING TENTATIVE MAP, and REZONE to demolish an existing warehouse building and construct a 30-foot-tall, three-story, approximately 82,045-square-foot, residential, for-sale condominium development. The project would also include an approximately 31,540-square-foot, two-level subterranean parking garage. The eight-six (86) proposed units would include 12 one-bedroom units and 74 two-bedroom units. Thirteen (13) units would be designated as affordable housing units, including 3 one-bedroom units and 10 two-bedroom units. The project site is currently developed with a warehouse building, on an approximately 39,069-square-foot lot. The project proposes to rezone the property from IS-1-1 (Industrial Small Lot) to RM-4-10 (Residential Multi-family) and a Community Plan Amendment, Local Coastal Program Amendment, and Progress Guide and General Plan Amendment to change the community plan designation of the site from industrial to residential use. The project site is located at 2015 Hancock Street within the Midway-Pacific Highway Corridor Community Plan, North Bay Redevelopment, Airport Approach Overlay Zone, and Coastal Height Limit Overlay Zone in Council District 2. As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Map Waiver and Waiver of Undergrounding to convert three residential dwelling units under construction to condominium ownership. The subject property is located at 804 Liverpool Court in the R-S zone of the Mission Beach Planned District and Precise Plan area, the Coastal Overlay Zone (State Jurisdiction), and Coastal Height Limit.
Should the condominium conversion project be approved, tenants may be required to vacate the premises. No units may be sold in this building unless the conversion is approved by the city and until after a public report is issued by the Department of Real Estate. Each tenant has the exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions that such unit will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 90 days from the date of issuance of the subdivision public report pursuant to Section 11018.2 of the Business and Professions Code, unless the tenant gives prior written notice of his or her intention not to exercise the right.
If you are an existing tenant within this project, you may have rights to certain benefits as outlined in San Diego Municipal Code Section 144.0503. The decision of the Hearing Officer is final unless appealed to the Planning Commission. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. To file an appeal to the Planning Commission contact staff at the Planning Department, 202 "C" Street, Fifth Floor, San Diego, California. The appeal must be made within 10 working days of the Hearing Officer's decision.
The certification of an Environmental Impact Report, adoption of a Mitigated Negative Declaration or Negative Declaration, or determination that the project is exempt from the California Environmental Quality may be appealed to the City Council after all other appeal rights have been exhausted. All such appeals must be filed by 5:00 PM within ten (10) business days from the date of the Planning Commission's certification/adoption of the environmental document. The proper forms are available from the City Clerk's Office, located on the second floor of the City Administration Building, 202 C Street, San Diego, CA 92101.
The decision made by the Planning Commission is the final decision by the City.

AN ORDINANCE AMENDING ORDINANCE NO. O-19301 (NEW SERIES), AS AMENDED, ENTITLED "AN ORDINANCE ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR 2004-2005 AND APPROPRIATING THE NECESSARY MONEY TO OPERATE THE CITY OF SAN DIEGO FOR SAID FISCAL YEAR," BY INCREASING GENERAL FUND APPROPRIATIONS IN AN AMOUNT NOT TO EXCEED $318,186 OF SURPLUS GENERAL FUND REVENUE AND INCREASING NON-GENERAL FUND DEPARTMENT APPROPRIATIONS IN AN AMOUNT NOT TO EXCEED $181,814 TO FUND THE UNFUNDED PORTION OF THE FISCAL YEAR 2005 RETIREE HEALTH CARE LIABILITY.
This ordinance amends Ordinance No. O 19301 (New Series), as amended, by increasing General Fund appropriations from projected franchise fee revenues in excess of estimates in an amount not to exceed $318,186 of surplus General Fund revenue and increasing Non-General Fund department appropriations from fund balances or reserves in an amount not to exceed $181,814 to fund the unfunded portion of the Fiscal Year 2005 retiree health care liability.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, since a written or printed copy will be available to the City Council and the public a day prior to its final passage.
This ordinance shall take effect and be in force on the thirtieth day from and after its passage.
A complete copy of the Ordinance is available for inspection in the Office of the City Clerk of the City of San Diego, 2nd Floor, City Administration Building, 202 "C" Street, San Diego, CA 92101.
