Bids shall be received in the office of the Grossmont Union High School District, Purchasing Department located at 1100 Murray Drive, El Cajon, CA 92020. The Purchasing office contains the official time clock. The bids shall be opened and publicly read aloud at the above-stated time and place. Parking is limited adjacent to the office. Bidders should plan accordingly.
Each bid must conform and be responsive to the contract documents, copies of which are now on file and may be obtained on August 16, 2005, at the Purchasing Department of the Grossmont Union High School District located at 1100 Murray Drive, El Cajon, CA. 92020. A $350 refundable deposit will be collected for each set of specifications and drawings.
Each bid shall be accompanied by the security referred to in the contract documents, the non-collusion affidavit, the list of proposed subcontractors, and all additional documentation required by the Instructions to Bidders.
In contracts involving an expenditure in excess of $25,000, the successful bidder shall file a payment bond issued by an admitted Surety approved to conduct business in the State of California approved by the District in the form set forth in the contract documents.*
The District reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding.
The lowest bid shall be the lowest total of the bid prices on the base contract as set forth in the bid form.
The Director of Industrial Relations has determined the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the contract which will be awarded to the successful bidder, copies of which are on file and will be made available to any interested party upon request. It shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all workers employed by them in the execution of the contract.
This bid is subject to Disabled Veteran Business Enterprise requirements. Minority, women, and disabled veteran contractors are encouraged to submit bids.
*A payment bond must be filed for a contract involving an expenditure in excess of $25,000 (Civil Code section 3247(a)) and may be required for contracts involving smaller expenditures at the option of the District.
This contract is subject to a LABOR COMPLIANCE PROGRAM, as described in subdivision (b) of Section 1771.5 of the Labor Code.
Pursuant to Labor Code section 1771.7, the District implemented and shall enforce a Labor Compliance Program (LCP) approved by the Department of Industrial Relations on March 6, 2003, for this Project.
It shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all workers employed by them in the execution of the contract.

Mandatory pre-bid meetings have been scheduled for these Bid Packages:
C6438 Earthwork; C6451 Electrical; C6440 Site Utilities; C6449 Plumbing; and C6448 Mechanical/HVAC on August 18, 2005 or August 19, 2005 at 10:00 AM (contractors choice as to which one to attend).
The pre-bid meetings will take place just North of the site of the new Communication Arts Building, adjacent to the gymnasium in Modular Trailer R410 on the Cuyamaca Campus. The P.O.C. for all matters is John Miller: phone 619-660-4604 @ Cuyamaca Campus. Representatives of the District, Construction Manager, Architect and consulting engineers will be present to answer any questions bidders have regarding this project. Bidders for the packages identified above, C6438, C6451, C6440, C6449, and C6448 must attend one of the mandatory pre-bid meetings and sign a certificate of attendance. Bidders for all other bid packages are strongly encouraged to attend either one of these pre-bid meetings, however, attendance is not mandatory.
All bids shall be accompanied by the security referred to in the Contract Documents, the non-collusion affidavit, the list of proposed subcontractors, and all additional documentation required by the Instructions to Bidders.
The successful prime contractor will later be required to furnish the District with Payment and Performance Bonds equal to 100% of the Prime Contract. All bonds are to be secured from a surety company that meets all of the State of California bonding requirements, as defined in Code of Civil Procedure Section 995.120, is authorized by the State of California, and all documents required by Code of Civil Procedure Section 995.660, to the extent required by law.
In addition, each subcontractor providing goods and services in excess of $100,000 shall be required to provide a Performance Bond equal to 100% of his subcontract with his Prime contractor. All prime contractors bidding on this project must specify the requirement regarding subcontractor bonds, in their written or published request for subcontractor bids. All Material Only Vendors shall not be required to provide bonds. All subcontractor bonds are to be secured from a surety company that meets all of the State of California bonding requirements, as defined in Code of Civil Procedure Sections 995.120, and is authorized by the State of California.
Pursuant to the provisions of Public Contract Code Section 22300, the successful bidder may substitute certain securities for funds withheld by the District to ensure his performance under the contract. At the request and expense of successful bidder, securities equivalent to any amount withheld shall be deposited at the discretion of the District, with either the District or a state or federally chartered bank, as the escrow agent, who shall then pay any funds otherwise subject to retention to the successful bidder. Upon satisfactory completion of the contract, the securities shall be returned to the successful bidder.
California Law requires that the District have a participation goal for Disabled Veteran Business Enterprises (DVBE) of at least three percent (3%) per year of the overall dollar amount of funds allocated to the District by the State Allocation Board pursuant to the Leroy F. Green School Facilities Act of 1998, for new construction or modernization, expended each year by the District. In accordance with Education Code Section 17076.11, the District requires that this Project have a DVBE participation goal of three percent (3%). Failure to comply with the DVBE Bid requirements will cause a bid to be deemed nonresponsive and ineligible for award of this contract.

The Director of Industrial Relations has determined the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the Contract which will be awarded to the successful bidder, copies of which are on file and will be made available to any interested party upon request at the District's office located at 8800 Grossmont College Drive, El Cajon, CA 92020-1799. A copy of these rates shall be posted at the job site.
In accordance with the provisions of the California Labor Code, contractors or subcontractors may not perform work on a public works project with a subcontractor who is ineligible to perform work on a public project pursuant to Section 1777.1 or Section 1777.7 of the California Labor Code. Any contract on a public works project entered into between a contractor and a debarred subcontractor is void as a matter of law. A debarred subcontractor may not receive any public money for performing work as a subcontractor on a public works contract.
It shall be mandatory upon the bidder to whom the Contract is awarded, and upon any subcontractor under him, to comply with all Labor Code provisions, which include, but are not limited to the payment of not less than the said specified rates to all workers employed by them in the execution of the contract, employment of apprentices, hours of labor and debarment of contractors and subcontractors.
Each bidder shall be a licensed contractor pursuant to the Business and Professions Code and shall be licensed in the appropriate classification(s) of contractor's license(s), for the work bid upon, and must maintain the license throughout the duration of the contract.
Award of Contract: The District shall award the contract for the Project to the bidder submitting the lowest bid, and is deemed responsible by the District.
No bidder may withdraw his bid for a period sixty (60) days after the date set for the opening of bids.

Stuart Mesa Fence Installation
Notice is hereby given that sealed bids will be received by the North San Diego County Transit Development Board (ÒNCTDÓ) at the NCTD offices, 810 Mission Avenue, Oceanside, CA 92054, up to 2 p.m., Tuesday, August 30, 2005 for the Stuart Mesa Fence Installation Project.
Project Description: Remove existing fence and replace with new.
NOTE: The above descriptions are for general information. The Scope of Work in Section 07 and Contract Drawings provide a complete and detailed description of the project scope.
ContractorÕs License: The successful bidder shall possess, at the time the contract for the Project is awarded, the California ContractorÕs License Classification C-13. Pursuant to California Public Contract Code section 20103.5, no bid submitted shall be invalidated by NCTD for failure of the bidder to be licensed in accordance with the laws of this state at the time of bid submittal. Failure of the successful bidder to obtain proper and adequate licensing for award of the contract for the Project shall constitute a failure to execute the contract, and shall result in the forfeiture of its Bid Security, as required herein.
This work is valued by NCTD to be within this cost range: $130,000.00 to $150,000.00.

BidderÕs Security: All bids must be submitted shall be presented under sealed cover and shall be accompanied by bidderÕs security in the form specified in the General Instructions For Bidders portion of this IFB.
Subcontract Limitations:
The successful bidder shall perform not less than thirty-five percent (35%) of the Work with its own forces without subcontracting. This requirement refers to the work whose value will not be less than thirty-five percent (35%) of the Contract Price.
Bid Opening Process: Bids are required for the entire work described in the specifications. The bids will be opened and bid prices will be read aloud at the time and place listed above unless amended by addendum. The bids will be evaluated and a report will be made to the NCTD Board of Directors at a regularly scheduled meeting following the final evaluation of the bids.
Basis for Award of Contract: The basis for award of a contract will be the lowest priced responsive and responsible bidder complying with the Contract Documents, Technical Specifications and Contract Drawings, as determined from the Bid Price Form in Section 09.
Compliance with Labor Code Requirements/Prevailing Wages: It has been determined that the work herein described falls into the category of public works construction projects for Federal and State requirements. The successful bidder will be required to comply with all of the terms and conditions (including Federal and State General Prevailing Wage requirements) prescribed for contractors performing public works construction projects. The latest General Prevailing Wage determinations for crafts associated with public works construction projects shall apply. In all instances where Federal and State Prevailing Wages for a given craft differ, the higher Prevailing Wage shall be paid. It shall be mandatory upon the successful bidder and all subcontractors to pay not less than the said specified rates to all workers employed by them in the performance of this contract. Copies of the Prevailing Wage Rates are on file at the NCTD Contracts Department located at 810 Mission Avenue, Oceanside, CA and are available upon request. Requests must specifically state which prevailing wage rates are required.
It shall also be mandatory upon the successful bidder and all subcontractors to comply with all other California Labor Code or Federal requirements, which include, but are not limited to, the employment of apprentices, hours of labor, retention of payroll records and debarment of contractors and subcontractors, to the extent applicable.
The successful bidder will be required to comply with all applicable Equal Employment Opportunity Laws and Regulations.
Bonds: The successful bidder will be required to furnish NCTD with Performance and Payment (Labor and Material) Bonds in an amount equal to 100% of the successful bid prior to execution of the contract for the Project. All bonds are to be secured from a surety company that meets all of the State of California Bonding requirements, as defined in California Code of Civil Procedure section 995.120, and is authorized by the State of California, and all documents required by California Code of Civil Procedure section 995.660, to the extent required by law.
