On motion of Member Grosch, seconded by Member Schwandt, the following Resolution is adopted:
WHEREAS, Section 81400 of the California Education Code provides for the San Diego Community College District to make certain elections regarding joint-occupancy facilities; and
WHEREAS, the Board of Trustees is desirous of expanding and improving the San Diego Miramar College Advanced Transportation complex as a joint-occupancy facility; and
WHEREAS, the Board of Trustees proposes to approve and to issue a Request for Proposal (RFP), as required by law, for this purpose; and
WHEREAS, Sections 81390 through 81402 of the California Education Code requires certain considerations to be made; and
WHEREAS, the location and characteristics of the proposed facility are described in the RFP Document;
NOW, THEREFORE, BE IT RESOLVED, FOUND AND DETERMINED by the San Diego Community College District, in regular session assembled on July 25, 2006, that;
The San Diego Community District elects to expand and improve the Automotive Program and the Advanced Transportation Training Facility at Miramar College as a joint us facility; and
IT FURTHER RESOLVES, to approve and to issue an RFP to secure proposals from interested parties for this purpose; and
IT FURTHER RESOLVES, that the location of the site is San Diego Miramar College at 10440 Black Mountain Road, San Diego 92126, and that the uses proposed for the facilities to be occupied by the District are instructional and support services, all as more fully described in said RFP; and
IT FURTHER RESOLVES, to authorize and delegate the Vice Chancellor, Facilities Management, San Diego Community College District, to receive and consider all plans, proposals and documents required by said RFP, and to present those proposals deemed to fulfill the requirements of said RFP to the Board of Trustees at a time to be determined by the Vice Chancellor, Facilities Management, which is not less than 90 days after adoption of this resolution,

Each proposal shall be accompanied by a certified or cashier's check payable to the District, in the amount of $30,000.00 (Thirty Thousand and No/100 Dollars). The check shall be given as a guarantee that the Proposer shall execute the contract (Exclusive Negotiating Agreement), if it be awarded to him, in conformity with the RFP. These checks will be returned to all unsuccessful Proposers after the San Diego Community College District enters into a contract for the accomplishment of this work, or if all proposals are rejected by the San Diego Community College District.
The proposal must be signed in the name of the Proposer and must bear the signature in longhand of the person or persons duly authorized to sign the proposal. The proposals determined by the Vice Chancellor, Facilities Management, to fulfill the requirements of the RFP shall be presented to the Board of Trustees of the San Diego Community College District at a time to be determined by the Vice Chancellor, Facilities Management.
A nonrefundable fee of $25.00
(Twenty-Five and No/100 Dollars) will be charged for each copy of the Request for Proposal document.

All meals of every type will meet the minimum standards set by the United States Department of Agriculture for Child and Adult Care Food Program meals of that type.
The Contract will be awarded to the responsible bidder whose bid is responsive to this invitation and is most advantageous to the Casa Pacifica ADHC Center, price and other factors considered.
Any or all bids may be rejected when it is in the interest of Casa Pacifica ADHC Center to do so.
