NOTICE OF JOINT PUBLIC HEARING
BY THE REDEVELOPMENT AGENCY OF THE CITY OF SAN DIEGO AND THE CITY COUNCIL OF THE CITY OF SAN DIEGO ON A PROPOSED CONDITIONAL USE PERMIT AND PUBLIC RIGHT-OF-WAY VACATION AND THE PROPOSED DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN VIETNAM VETERANS OF SAN DIEGO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN DIEGO
NOTICE IS HEREBY GIVEN that the Redevelopment Agency (the AAgency@) and the City Council of the City of San Diego (the ACity Council@) will hold a joint public hearing on September 2, 2003, at the hour of 10:00 a.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 AC@ Street, San Diego California, pursuant to the Community Redevelopment Law of the State of California, Section 99 of the Charter of the City of San Diego and the San Diego Municipal Code, to consider the Agency entering into a disposition and development agreement with Vietnam Veterans of San Diego (the ADeveloper@) for the disposition of real property in the North Bay Redevelopment Project Area by the Agency to the Developer, for the development and operation of a state of the art living and support facility for the treatment of homeless veterans. The City Council will also consider a Conditional Use Permit (amendment to CUP 90-1127) and proposed public right-of-way vacations for portions of Pacific Highway, Kurtz Street and Witherby Street . The project is located on approximately 5 acres in land area on property bounded by Witherby Street, Pacific Highway, Couts Street and the railroad tracks east of Kurtz Street, within the IS-1-1 zone, Airport Approach and Coastal Height Limit Overlay zones and Midway/Pacific Highway Corridor community plan area, within the City of San Diego, State of California. The project, to be completed in three phases, will expand the existing use on the site from the current 87 beds to approximately 224 early treatment beds, 24 three bedroom transitional housing units, administrative offices, employment training and counseling facilities, donation warehouse and required parking. The agreement sets forth the conditions and procedures for the proposed development.
A Mitigated Negative Declaration (MND No. 42-0378), has been prepared for the project in accordance with State of California Environmental Quality Act (CEQA) Guidelines. A Mitigation, Monitoring and Reporting Program has been prepared and will be implemented which will reduce the effects of Geology, Water Quality, Hydrology, Air Quality, Health and Safety and Historical Resources (Archaeology) to a level of insignificance. The Mitigated Negative Declaration and the Mitigation Monitoring and Reporting Program will be considered by the City Council and the Agency at the time of the public hearing on the proposed agreement.
The following documents are available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the office of the City Clerk, 202 AC@ Street, City Administration Building, 2nd Floor, San Diego, California 92101:
1. A copy of the proposed agreement and attachments.
2. A copy of the environmental documents.
3. A summary report which describes and specifies certain economic terms and conditions of the proposed agreement, proposed development plans and related material
Copies of the documents are also available for viewing at the offices of the Redevelopment Agency 600 "B" Street, Suite 400, San Diego, 92101. Copies may be purchased for the cost of reproduction at the office of the Redevelopment Agency.
At any time before the date and time set forth above for the public hearing by the City Council and Redevelopment Agency written comments on or objections to the proposed agreement may be filed with the City Clerk. Comments may also be submitted during such period on the summary report, and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the public hearing will be given an opportunity to appear and be so heard. The decision of the City Council is final. If you later desire to challenge actions of the City Council and/or the Agency in connection with this transaction, you could be limited to raising issues you or someone else raised at the public hearing, or in written correspondence to the City Council and/or the Agency at or prior to the public hearing. All correspondence should be delivered to the City Clerk at the above address to be included in the record of the proceedings. As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, modify or deny an application for an application for a Conditional Use Permit and a Coastal Development Permit to demolish two dwellings, remodel the existing church structure and add an approximately 1,800 square-foot, 2-story addition, and add parking and landscaping to a 18,429 square-foot, RM-1-1 zoned site addressed as 1074 Loring Street within the boundaries of the Pacific Beach Community Plan area. The property is within the California Coastal Zone and subject to the City's Coastal Height Overlay Zone.
The decision of the Hearing Officer is final unless appealed to the PLANNING COMMISSION. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. To file an appeal to the Planning Commission, contact staff at the Planning Department, 202 "C" St., Fifth Floor, San Diego, California. The appeal must be made within 10 working days of the Hearing Officer's decision.
The decision made by the PLANNING COMMISSION is the final decision by the City.
