The City of San Diego Land Development Review Division has prepared a draft Negative Declaration for the following project and is inviting your comments regarding the adequacy of the document. Your comments must be received by September 14, 2006 to be included in the final document considered by the decision-making authorities. A 1,271-square-foot second story and various ground floor additions (a 20-sqaure-foot addition to the first floor and a 109-sqaure-foot addition to the garage) are proposed. The 8,880-square-foot lot is located at 331 Sea Ridge Drive within the Coastal Zone and the La Jolla Community Planning Area. AN ORDINANCE ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR 2006-2007 AND APPROPRIATING THE NECESSARY MONEY TO OPERATE THE CITY OF SAN DIEGO FOR SAID FISCAL YEAR.

This ordinance adopts the annual budget for the City of San Diego for fiscal year 2006-2007. It appropriates and allocates the necessary money to operate the City for said fiscal year and provides for the various internal, enterprise and special funds and departments of the City. It also makes appropriate and necessary provision for transfer of funds by the City Auditor and Comptroller when directed by the Chief Financial Officer and/or the Financial Management Director and further provides for crediting of revenues and interest earnings to various specified funds. Finally, the ordinance authorizes and allocates funds for Capital Improvement Program projects.

REDUCING THE REQUIRED VOTES FOR DESIGNATION FROM 8 TO 6, AND REDUCING THE MAXIMUM NUMBER OF APPOINTMENTS THAT EXPIRE IN ANY YEAR FROM 8 TO 6.

This ordinance makes changes to the City of San Diego's laws pertaining to the number of seats and voting requirements for the Historical Resources Board. Specifically, it contains amendments to the Land Development Code Section 111.0206 thereby reducing the number of seats on the Historical Resources Board from 15 to 11. It also amends that section of the Land Development Code pertaining to the quorum requirement, proportionally reducing it from 8 to 6 for the transaction of business. It also reduces the required votes for the designation of an historical resource from 8 to 6. Finally, it reduces the maximum number of Historical Resources Board member appointments that expire in any year from 8 to 6.

AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 2, DIVISION 13, OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTIONS 142.1304, 142.1305 AND 142.1310, ALL RELATING TO INCLUSIONARY HOUSING.

The purpose of this ordinance is to clarify the regulations and provide further flexibility in the variance and waiver provisions of the Inclusionary Affordable Housing Regulations (Ordinance No. O-19189 New Series, adopted June 3, 2003).
The City Council desires to clarify that the regulations provide protection to applicants under the case of Home Builders Association of Northern California v. City of Napa, et al., 90 Cal.App.4th 188 (2001), and desires to change the timing of the in lieu fee payment.

A RESOLUTION PURSUANT TO SECTION 147(F) OF THE INTERNAL REVENUE CODE OF 1986 APPROVING THE ISSUANCE OF BONDS BY THE HOUSING AUTHORITY OF THE CITY OF SAN DIEGO FOR THE BROADWAY SQUARE APARTMENTS

WHEREAS, the Housing Authority of the City of San Diego [Authority] intends to issue not to exceed $40,000,000 aggregate principal amount of multifamily housing revenue bonds [Bonds] to finance the development of a multifamily rental housing project in the City of San Diego described in the notice of public hearing on file in the Office of the City Clerk as Exhibit A [Project]; and
WHEREAS, in order for interest on the Bonds to be tax-exempt, section 147(f) of the Internal Revenue Code of 1986 requires that the Bonds be approved by the City Council as the applicable elected representative after a public hearing following reasonable public notice; and
WHEREAS, notice of a public hearing with respect to the proposed issuance of the Bonds was published in a newspaper of general circulation in the City on July 24, 2006; and
WHEREAS, the public hearing was held on August 8, 2006, and an opportunity was provided for interested persons to express their views on the issuance of the Bonds and on the nature and location of the Project; NOW THEREFORE,
BE IT RESOLVED, by the City Council of the City of San Diego that this City Council, as the applicable elected representative under section 147(f) of the Code, approves the issuance of the Bonds by the Authority.
BE IT FURTHER RESOLVED, that the City does not warrant the creditworthiness of the Bonds or guarantee, in any way, the payment of the Bonds. No moneys of the City will be pledged or applied to the repayment of the Bonds.
