NOTICE IS HEREBY GIVEN that the City of San Diego will receive bids for work at the Public Works Department, Public Works Contracting Group, 1010 Second Avenue, Suite 1400, San Diego, California, where bids are to be submitted prior to time specified. Plans and specifications can be obtained from The City of San Diego's website: http://www.sandiego.gov/bids-contracts. A pre-bid meeting and/or pre-bid visit to the work site will be held, if indicated, at the time and place specified in the contract documents. Prospective bidders are encouraged to attend these sessions.

PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:

To consider a final decision to overrule the San Diego County Regional Airport Authority in accordance with SDMC Section 132.1555. On March 18, 2014, the San Diego City Council adopted the mobile food truck ordinance (O-20357), which established regulations to allow food trucks to legally operate in the public right-of-way and on private property under specific time, place, and manner limitations. On June 5, 2014, the Airport Authority determined the City's ordinance to be inconsistent for failing to include a specific limitation in the mobile food truck ordinance relating to the MCAS Miramar Accident Potential Zone I (APZ I).

On July 15, 2014, the City Council voted 7-2 to propose a decision to overrule the San Diego County Regional Airport Authority and to set a hearing for a final decision to overrule in order to allow the adopted ordinance to become effective. Motion by Councilmember Sherman, second by Councilmember Zapf, to set a hearing to overrule the San Diego County Regional Airport Authority's determination (that the food truck ordinance is inconsistent with the Airport Land Use Compatibility Plan for MCAS Miramar) and uphold the City's adopted mobile food truck ordinance (O-20357) based on the findings that the proposed ordinance will not be detrimental to the public health, safety, and welfare; the proposed ordinance will minimize the public's exposure to excessive noise and safety hazards to the extent feasible; and the ordinance will meet the purpose and intent of California Public Utilities Code Section 21670. Passed by a vote of 7-2 with Council Districts 2, 3, 4, 5, 6, 7, and 9 voting yes; and Council Districts 1 and 8 voting no.

The adopted MCAS Miramar Airport Land Use Compatibility Plan (ALUCP) and federal Air Installations Compatible Use Zones (AICUZ) for MCAS Miramar allow for low intensity retail as a permitted use within APZ I (maximum 25 people per acre). The APZ I applies to a light industrial zoned area (IL-2-1 base zone) in the Mira Mesa community plan area that is identified as prime industrial lands. The City's Airport Land Use Compatibility Overlay Zone applies to all property within the MCAS Miramar airport influence area, including APZ I, and is sufficient to limit mobile food truck activity in APZ I. Within APZ I, mobile food trucks are limited to serving occupants at existing businesses in order to maintain a low intensity (25 people per acre) consistent with the MCAS Miramar ALUCP and AICUZ.

Project materials and proposed findings to support the overrule action are available for public review at the City of San Diego, Development Services Department, 1222 First Avenue, San Diego, CA 92101, 5th Floor. The public hearing on the final decision to overrule the determination of inconsistency shall include consideration of any comments received from the SDCRAA and the California Department of Transportation, Division of Aeronautics regarding the proposed overrule. A final decision to overrule the determination of inconsistency shall be made by a minimum of two-thirds vote. A final decision of the City Council to overrule will make the mobile food truck ordinance effective immediately outside the coastal zone. The ordinance will not be effective in the coastal zone until the California Coastal Commission unconditionally certifies the amendment

* Unless otherwise noticed or stated on the record at the hearing, if an ordinance is approved and introduced by the City Council, it will automatically be scheduled for a hearing by the City Council for final passage at 10:00 a.m. on the Tuesday two weeks after the subject hearing.

The decision of the City Council is final.

This item may begin at any time after the time specified. Any interested person may address the City Council to express support or opposition to this issue. Time allotted to each speaker is determined by the Chair and, in general, is limited to three (3) minutes; moreover, collective testimony by those in support or opposition shall be limited to no more than fifteen (15) minutes total per side.

The City of San Diego (City) is requesting proposals from highly qualified traffic engineering firms for consultant services for As-Needed Traffic Engineering Services (H156316).

It is the policy of the City to provide equal opportunity in its traffic engineering professional services contracts. Toward this end, proposals from small local businesses, disadvantaged businesses and disabled veteran, women and minority owned businesses are strongly encouraged. Prime consultants are encouraged to provide subconsultant opportunities or joint venture with these firms. The City endeavors to do business with firms sharing the City's commitment to equal opportunity and will not do business with any firm that discriminates on the basis of race, religion, color, ancestry, age, gender, sexual orientation, disability, medical condition or place of birth.

This project has a voluntary Small Local Business Enterprises (SLBE) / Emerging Local Business Enterprises (ELBE) Participation Level (SLBE/ELBE) goal of 20%. The proposal must also address how the consultant plans to interface with the City's project management staff and the consultant's workforce in San Diego County.

The City also reserves the right to revise this RFP, including but not limited to the pre-proposal meeting date and the proposal due date. If the City revises the RFP, all RFP holders of record will be notified in writing by the City.

SUMMARY SCOPE OF SERVICES

A professional traffic engineering consultant is needed to support Planning Department staff on an as-needed basis. Task orders will include traffic engineering services which include, but may not be limited to, the following: Collect Data, Assess Existing Conditions and Mobility, Identify Opportunities and Constraints, Develop Travel Forecasting Model, Provide Conceptual Streetscape Design, Prepare Planning Level Cost Estimates, Analyze Future Conditions, Analyze Transportation/Parking CEQA. The remainder of the Scope of Services is contained in the Request for Proposal for As-Needed Traffic Engineering Services (H156316), as Exhibit A to the Draft Agreement.
