NOTICE IS HEREBY GIVEN that the City of San Diego will receive bids for work listed below. Plans and specifications can be obtained from the Purchasing and Contracting Department, Contracting Division, 1200 Third Avenue, Suite 200, San Diego, California, where bids are to be submitted prior to time specified.
A pre-bid meeting and/or pre-bid visit to the work site will be held, if indicated, at the time and place specified in the contract documents.  Prospective bidders are encouraged to attend these sessions.

 Subject:    COASTAL DEVELOPMENT PERMIT and SITE DEVELOPMENT PERMIT to demolish an existing 2,256 square-foot, two-story single-family structure and construct a 4,965-square-foot, two-story single-family dwelling-unit.  In addition, the project would include an approximate 705-square-foot garage, a 128-square-foot covered patio, a 480-square-foot roof deck (includes stairs), swimming pool, landscape, retaining walls, and associated hardscape improvements.  The 20,525-square-foot project site is located at 12904 Long Boat Way within the RS-1-6 zone of the Torrey Pines Community Plan area(Legal Description: Lot 345 of Del mar Hills Unit No. 13 in the City of Del Mar, Map No. 6874, March 17, 1971).  The site is not included on any Government Code listing of hazardous waste sites.

ORDINANCE NUMBER O-19776 (NEW SERIES)

AN ORDINANCE SUBMITTING TO THE QUALIFIED
VOTERS OF THE CITY OF SAN DIEGO AT THE MUNICIPAL SPECIAL ELECTION CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 4, 2008, ONE PROPOSITION AMENDING THE CITY CHARTER BY AMENDING ARTICLE V, BY ADDING SECTION 55.2, DESIGNATING THE USE OF LEASE REVENUE FROM MISSION BAY PARK.

This ordinance places one proposition on the ballot for the November 4, 2008 Municipal Special Election. If adopted, this proposition will amend the Charter to require that annual lease revenue generated in Mission Bay Park exceeding $23 million initially, and decreasing to $20 million after 5 years, be appropriated 75 percent for capital improvements in Mission Bay Park and 25 percent for capital improvements in Chollas Lake, Balboa, Mission Trails, Otay River Valley, Presidio and San Diego River Parks; open space parks; coastal beaches and contiguous coastal parks; and future regional parks. If approved by the voters, Section 55.2 would take effect and be in force on July 1, 2009 and will expire on June 30, 2039. Before the expiration of Section 55.2, the City Council would place on the ballot no later than the last regularly scheduled election prior to June 30, 2039, a measure to amend the Charter to extend the effect of the section for an additional 30 years.
If approved by the voters, Section 55.2 also would create the Mission Bay Park Improvement Fund Oversight Committee and the San Diego Regional Parks Improvement Fund Oversight Committee. The two committees would meet at least quarterly to audit and review the implementation of this Charter section, to recommend priorities for expenditures and capital improvements and to verify the appropriate funds are collected, segregated, retained and allocated according to the intent of the Charter section, and spent as prioritized.
Pursuant to Section 295(b) and 295(d) of the San Diego City Charter, this ordinance relating to elections takes effect on July 28, 2008, which is the day of its introduction and passage.

AN ORDINANCE SUBMITTING TO THE QUALIFIED
VOTERS OF THE CITY OF SAN DIEGO AT THE MUNICIPAL SPECIAL ELECTION CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 4, 2008, ONE PROPOSITION AMENDING
CHAPTER 5, ARTICLE 6, DIVISION 0, OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 56.54, RELATING TO ALCOHOL CONSUMPTION IN CERTAIN AREAS.

This ordinance places one proposition on the ballot for the November 4, 2008 Municipal Special Election. If adopted, the People of the City of San Diego would amend San Diego Municipal Code section 56.54 to make the consumption of alcohol unlawful at City beaches, Mission Bay Park, and coastal parks. It would be unlawful for any person to consume any alcoholic beverage at any time, upon all public beaches, including any sidewalks, boardwalks, alleys, plazas, piers, jetties, on or against seawalls, upon public rights-of-way at any beach or coastal bluff, and all coastal access, view point and bluff rights-of-way, and including the adjacent coastal public parks and areas listed in the ballot proposition. The prohibition would not apply to Mission Bay Golf Course and Torrey Pines Golf Course; to locations for which the City Manager or designee has issued a special event permit; if otherwise permitted under the terms of a lease agreement with the City of San Diego; or as otherwise provided in the proposition. If approved by the voters, these amendments to the Municipal Code would be effective as of January 15, 2009.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO DIRECTING THE CITY ATTORNEY TO PREPARE A BALLOT TITLE, SUMMARY AND IMPARTIAL ANALYSIS; DIRECTING THE MAYOR TO PREPARE A FISCAL ANALYSIS; AND ASSIGNING AUTHORSHIP OF THE BALLOT ARGUMENT TO COUNCILMEMBERS FRYE AND FAULCONER; ALL REGARDING THE BALLOT MEASURE ON MISSION BAY LEASE REVENUE.

WHEREAS, Chapter 2, Article 7, Division 5, of the San Diego Municipal Code allows the City Council to give direction to the City Attorney to prepare a ballot title, summary, and an impartial analysis of any proposed ballot measure; and
WHEREAS, Chapter 2, Article 7, Division 5, of the San Diego Municipal Code allows the City Council to direct the Mayor to prepare a fiscal impact analysis of any proposed legislative act; and
WHEREAS, Chapter 2, Article 7, Division 5, of the San Diego Municipal Code allows the City Council to assign authorship and signing of the ballot argument to one or more Councilmembers; and
WHEREAS, at a meeting held on July 28, 2008, the City Council adopted Ordinance No. O-19776, placing the proposition to amend Article V of the San Diego City Charter, by adding section 55.2 regarding the use of lease revenue from Mission Bay Park, on the November 4, 2008 ballot; and
WHEREAS, this resolution pertaining solely to elections and procedures related to a ballot measure to be placed on the ballot by the City Council is not subject to veto by the Mayor; NOW, THEREFORE,
BE IT RESOLVED, by the Council of the City of San Diego, as follows:
1. That the City Attorney is directed to prepare a ballot title and summary of the proposed ballot measure for inclusion in the voter pamphlet and to deliver the ballot title and summary to the Office of the City Clerk, Elections Section, no later than August 18, 2008.
2. That the City Attorney is directed to prepare an impartial analysis of the proposed ballot measure for inclusion in the voter pamphlet and to deliver said analysis to the Office of the City Clerk, Elections Section, no later than August 18, 2008.
3. That the Mayor is directed to prepare, in consultation with the Independent Budget Analyst, a fiscal impact analysis of the proposed ballot measure for inclusion in the voter pamphlet and to deliver said analysis to the Office of the City Clerk, Elections Section, no later than August 18, 2008.
4. That Councilmembers Donna Frye and Kevin Faulconer are authorized to sign and file a written argument in support of the ballot measure for inclusion in the voter pamphlet and to deliver said argument to the Office of the City Clerk, Elections Section, no later than August 21, 2008.
