As a property owner, tenant or person who has requested notice, you should know that the Planning Commission will hold a public hearing to approve, conditionally approve, or deny an application for a Tentative Map to convert 28 existing residential units to condominiums including a request to waive the requirement to underground existing overhead utilities on a 0.43 acre site at 4654 33rd Street in the RM-1-2 Zone of the Central Urbanized Planned District within the Normal Heights Neighborhood of the Mid City Communities Plan Area between Adams Avenue and Madison Avenue.
Should the condominium conversion project be approved, tenants may be required to vacate the premises. No units may be sold in this building unless the conversion is approved by the city and until after a public report is issued by the Department of Real Estate. Each tenant has the exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions that such unit will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 90 days from the date of issuance of the subdivision public report pursuant to Section 11018.2 of the Business and Professions Code, unless the tenant gives prior written notice of his or her intention not to exercise the right.

The decision of the Planning Commission is final unless appealed to the City Council. To file an appeal, contact the City Clerk at 202 "C" Street, Second Floor. The appeal must be made within 10 working days of the Planning Commission decision. If you wish to challenge the City's action on the above proceedings in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written in correspondence to the City at or before the public hearing.

NOTICE IS HEREBY GIVEN that the City Council of the City of San Diego (the "City Council") and the Redevelopment Agency of the City of San Diego (the "Agency") will hold a joint public hearing, and the City Council will hold a concurrent public hearing, on September 20, 2005 at the hour of 10:00 A.M. or as soon thereafter as the matters can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et seq.), and the San Diego Municipal Code, for the purpose of considering the proposed sale of certain property in the Centre City Redevelopment Project area to Ballpark Village LLC, a California limited liability company (the "Participant"), and a variance to the CityÕs Inclusionary Housing Ordinance as provided by Section 142.1304(c) of the Ordinance in the form of a proposed Affordable Housing Agreement.
The proposed sale of property to the Participant will be made in accordance with the California Community Redevelopment Law and pursuant to the proposed Owner Participation Agreement (including a Master Plan for development) between the Agency and the Participant subject to covenants, conditions and restrictions necessary to carry out the Redevelopment Plan for the Centre City Redevelopment Project and pursuant to the proposed Affordable Housing Agreement by and between the Agency, the Participant and the San Diego Housing Commission.
1. The proposed sale of the Agency Sales Parcel by the Agency to the Participant;
2. The proposed Owner Participation Agreement between the Agency and the Participant (including a Master Plan for
development); and
3. A variance to the CityÕs Inclusionary Housing Ordinance in the form of the proposed Affordable Housing Agreement by and
between the Agency, the Participant and the San Diego Housing Commission.
The following documents are available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the offices of the City Clerk, 202 "C" Street, City Administration Building, 2nd Floor, San Diego, California 92101 and at the offices of Centre City Development Corporation, 225 Broadway, Suite 1100, San Diego, California 92101:
As the agency responsible for carrying out the Redevelopment Plan for the Centre City Redevelopment Project, the Agency has previously prepared, and the Agency (Resolution No. 2081) and City Council (Resolution No. 279875) have certified, the Final Master Environmental Impact Report for the Centre City Redevelopment Project (the "MEIR"). In order to further evaluate the possible environmental effects of implementation activities in the Redevelopment Project, the Agency has prepared, and the Agency (Resolution No. 3063) and the City Council (Resolution No. 292369) have certified, on October 26, 1999, the Final Subsequent Environmental Impact Report to the MEIR for the Centre City Redevelopment Project and Addressing the Centre City Community Plan and Related Documents for the Proposed Ballpark and Ancillary Development Projects, and Associated Plan Amendments (the "SEIR"). The sale of the Agency Sales Parcel and the redevelopment contemplated pursuant to the proposed Owner Participation Agreement is a redevelopment implementation activity whose environmental impacts are assessed in the MEIR, as supplemented by the SEIR (collectively, the ÒMEIR/SEIRÓ), and encompassed within the certifications, findings and approvals of the above referenced resolutions of the Agency and City Council. Further, in connection with its consideration of the proposed Owner Participation Agreement (including the Master Plan and Affordable Housing Agreement), the Agency has prepared an Addendum to the SEIR to determine if the development thereunder will have additional significant effects on the environment to those covered in the MEIR/SEIR. The Addendum to SEIR will be considered by the City Council and Agency at the time of the joint public hearing on the Owner Participation Agreement (including the Master Plan and Affordable Housing Agreement) and by the City Council at the time of the concurrent public hearing on the variance to the CityÕs Inclusionary Housing Ordinance pursuant to Section 142.1304(c) of the Ordinance.
At any time before the date and time set forth above for the joint public hearing by the City Council and Agency and the concurrent public hearing by the City Council, any written comments on or objections to the proposed Agreements or to the proposed sale of the property or to the variance may be filed with the City Clerk. Comments may also be submitted during such period on the summary report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the joint and concurrent public hearings will be given an opportunity to appear and be so heard. If you challenge the approval of the proposed Agreements or the variance, or any of the matters related thereto as referred to in this Notice, you may be limited to raising only those issues addressed at the hearing described in this Notice or in written correspondence delivered to the City Clerk at, or prior to, the hearing.
