Notice of Intent to Adopt 2013 San Diego IRWM Plan

The San Diego County Water Authority, City of San Diego, and County of San Diego, in collaboration with a Regional Advisory Committee, have prepared a 2013 San Diego Integrated Regional Water Management Plan (2013 IRWM Plan). The 2013 IRWM Plan is an effort to improve water resources management through collaborative regional actions. The 2013 IRWM Plan complies with State requirements and enhances eligibility for State grants.

All interested stakeholders were invited to participate in the 2013 IRWM Plan. A final 2013 IRWM Plan is now available at: www.sdirwmp.org. The San Diego County Water Authority Board of Directors, City of San Diego City Council, and County of San Diego Board of Supervisors are scheduled to adopt the 2013 IRWM Plan in September and October 2013. A schedule of adoption hearings is available at: www.sdirwmp.org.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer of Civic San Diego (“CivicSD”) will hold a hearing to approve, conditionally approve, or deny an application for a Conditional Use Permit (CUP) (Process Three) to allow live entertainment at Lucky Bastard Saloon, a restaurant and bar within the ground floor and basement of the historic San Diego Hardware Building located at 840 Fifth Avenue in the Gaslamp Quarter Neighborhood of the Downtown Community Plan Area.

This activity is covered under the Final Environmental Impact Report (FEIR) for the San Diego Downtown Community Plan, Centre City Planned District Ordinance, and 10th Amendment to the Centre City Redevelopment Plan, certified by the City Council and the Redevelopment Agency (“Former Agency”) on March 14, 2006 (Resolution R-301265 and R-04001, respectively) and subsequent addenda to the FEIR. The FEIR is a “Program EIR” prepared in compliance with California Environmental Quality Act (CEQA) Guidelines Section 15168. CivicSD staff has concluded that the proposed activity of the addition of live entertainment at a restaurant and bar is within the scope of the development program described in the FEIR and that the environmental impacts were adequately addressed in the FEIR; therefore, no further environmental documentation is required under CEQA.

The decision of the CivicSD Hearing Officer is final unless appealed to the CivicSD Board of Directors. In order to appeal the decision you must be present at the public hearing and file a speaker's slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained at CivicSD's office located at 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10) business days of the Hearing Officer's decision. If the Hearing Officer's decision is appealed, the decision made by the CivicSD Board of Directors is the final decision.

If you wish to challenge either CivicSD's or the City of San Diego's action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the Public Hearing described in this notice, or written correspondence to CivicSD at or before the Public Hearing.
