NOTICE IS HEREBY GIVEN that the City of San Diego will hold a public hearing on Monday, September 16, 2013, at 2:00 p.m. or sometime thereafter to receive comments on the Consolidated Annual Performance and Evaluation Report (CAPER) for Fiscal Year 2013.

A brief report on the CAPER will be presented to the San Diego City Council in the City Administration Building (202 'C' Street, San Diego, CA 92101- Council Chambers on the 12th floor) as Item-200 on the agenda of September 16, 2013, at 2:00 p.m. or sometime thereafter. The agenda and time for this meeting is posted on the CDBG Program's website at http://www.sandiego.gov/cdbg/index.shtml and on the City Clerk's Office's website at http://www.sandiego.gov/city-clerk/index.shtml. Public comments will be welcomed at this meeting.

The CAPER is prepared on an annual basis for submittal to the United States Department of Housing and Urban Development (HUD) and is required as part of the annual funding granted to the City as part of the following federal programs: Community Development Block Grant (CDBG); HOME Investment Partnerships Program (HOME); Emergency Solutions Grants (ESG); and Housing Opportunities for Persons with AIDS (HOPWA).

The CAPER provides an assessment of the City's progress toward meeting its goals and high priority needs for these federal programs. The CAPER reports on how funds were spent for the reporting period and on the beneficiaries of the community development, social services, and housing activities undertaken.

The Draft FY 2013 CAPER is available for public review at the CDBG Program office (1200 Third Avenue, Suite 1400, San Diego, CA 92101), the CDBG Program's website (http://www.sandiego.gov/cdbg/general/plansreports.shtml), the San Diego Housing Commission's website (http://www.sdhc.org), and select City facilities and community centers from September 4, 2013, through September 18, 2013. Written comments may be submitted during this period to the CDBG Program office by mail (1200 Third Avenue, Suite 1400, San Diego, CA 92101) or via e mail (CDBG@sandiego.gov).

ORDINANCE NUMBER O-20293 (NEW SERIES)

AN ORDINANCE AMENDING CHAPTER 12, ARTICLE 6, DIVISION 1 OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 126.0115; AND AMENDING CHAPTER 14, ARTICLE 3, DIVISION 1 BY AMENDING SECTION 143.0110, ALL RELATING TO ACCEPTING THE CALIFORNIA COASTAL COMMISSION'S
SUGGESTED MODIFICATIONS TO THE 7th UPDATE TO THE LAND
DEVELOPMENT CODE.

This ordinance accepts the California Coastal Commission's suggested modifications to the 7th Update to the Land Development Code, adopted by the City in 2011, but not yet effective in the Coastal Overlay Zone. The suggested modifications will require findings to be made to grant tolling provisions for coastal development permits. In addition, the suggested modifications provide that within the Coastal Overlay Zone, development on a premises that contains environmentally sensitive lands but complies with listed criteria, including no encroachment into environmentally sensitive lands, will not be eligible for the exemption from the requirements to obtain a Neighborhood Development Permit or Site Development Permit, that otherwise applies to development outside of the Coastal Overlay Zone.

This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, a written or printed copy having been available to the City Council and the public prior to the day of its passage.

That this ordinance shall not take effect until the date the California Coastal Commission unconditionally certifies these provisions as a Local Coastal Program amendment, or until the thirtieth day from and after its final passage, whichever occurs later.
