The City of San Diego (City) is requesting proposals from highly qualified civil engineering firms for consultant services for Utilities Undergrounding Program Master Plan (H146088).

It is the policy of the City to provide equal opportunity in its civil engineering professional services contracts. Toward this end, proposals from small local businesses, disadvantaged businesses and disabled veteran, women and minority owned businesses are strongly encouraged. Prime consultants are encouraged to provide subconsultant opportunities or joint venture with these firms. The City endeavors to do business with firms sharing the City's commitment to equal opportunity and will not do business with any firm that discriminates on the basis of race, religion, color, ancestry, age, gender, sexual orientation, disability, medical condition or place of birth.

This project has a voluntary Small Local Business Enterprises (SLBE) / Emerging Local Business Enterprises (ELBE) Participation Level (SLBE/ELBE) goal of 20%. The proposal must address the consultant's knowledge and understanding of: the City and other local agencies' regulations and policies; local environment; and local building codes and other criteria. The proposal must also address how the consultant plans to interface with the City's project management staff and the consultant's workforce in San Diego County.

The City reserves the right to accept or reject any or all proposals received as a result of this RFP. The City also reserves the right to revise this RFP, including but not limited to the pre-proposal meeting date and the proposal due date. If the City revises the RFP, all RFP holders of record will be notified in writing by the City.

SUMMARY SCOPE OF SERVICES

The City of San Diego (City) has a need for professional engineering consultant services to develop a system-wide Utility Undergrounding Program master plan. The scope of services includes assessment of over eleven hundred miles of overhead SDG&E distribution lines, and approximately fifty-five miles of SDG&E 69KV transmission lines. The Consultant shall create criteria in order to prioritize undergrounding blocks. Criteria are to be created in order to underground existing overhead lines in the most cost efficient manner. Consultant shall create criteria for distribution and transmission, to provide the flexibility to underground each system separately. The remainder of the Scope of Services is contained in the Request for Proposal for Utilities Undergrounding Program Master Plan (H146088), as Exhibit A to the Draft Agreement.

AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 7, DIVISION 27
OF THE SAN DIEGO MUNICIPAL CODE TO
REPEAL SECTION 27.2726, RELATING TO RECALL ELECTIONS.

This ordinance would amend Chapter 2, Article 7, Division 27 of the San Diego Municipal Code to repeal Section 27.2726, relating to recall elections. Section 27.2726 prohibits the counting of certain votes in recall elections, stating, “No vote cast for a candidate shall be counted unless the voter also voted on the recall question.” In 2003, a federal district court struck down a virtually identical law in the California Elections Code. The requirement that a voter must vote on both parts of a recall ballot to have his or her vote counted was held by the court to effect “a severe restriction on one's Constitutional right to vote” and to violate voters' First Amendment rights of free expression. Although the federal court decision does not apply to San Diego's election code, it is clear San Diego's similar law would not survive a legal challenge. Thus, this Ordinance would repeal the section.

This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, a written or printed copy having been available to the City Council and the public prior to the day of its passage.

Pursuant to Charter sections 275(c) and 295(d), this ordinance relating to elections may be passed by the Council on the date of its introduction, and shall take effect and be in force on the date of its final passage.

This project is exempt from CEQA pursuant to State CEQA Guidelines Section 15305 (Minor Alterations in Land Use Limitations). This project is not pending an appeal of the environmental determination. The environmental exemption determination for this project was made on December 14, 2012, and the opportunity to appeal that determination ended January 9, 2013.

The final decision by the City of San Diego is not appealable to the California Coastal Commission. If you want to receive a Notice of Final Action, you must submit a written request to the City Project Manager listed above.
