As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for Coastal Development Permit (CDP) to add 847 square-feet to an existing 1,589 square-foot single family residence, and 395 square-feet to an existing 412 square-foot garage on a 10,805 square-foot site. The site is located at 733 Sunset Cliffs Boulevard in the RS-1-7 Zone, Coastal Overlay Zone (appealable-area), Coastal Height Limit Overlay Zone, and the Beach Parking Impact Overlay Zone within the Peninsula Community Plan and Local Coastal Program, Council District 2.
The decision of the Hearing Officer is final unless appealed to the PLANNING COMMISSION. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. To file an appeal to the Planning Commission contact staff at the Planning Department, 202 "C" Street, Fifth Floor, San Diego, CA. The appeal must be made within 10 working days of the Hearing Officer's decision.
The determination that the project is exempt from the California Environmental Quality Act may be appealed to the City Council after all other appeal rights have been exhausted. All such appeals must be filed by 5:00 PM within ten (10) business days from the date of the Planning Commission's certification/adoption of the environmental document. The decision made by the PLANNING COMMISSION is the final decision by the City.
Appeals to the Coastal Commission must be filed with the Coastal Commission at 7575 Metropolitan Drive, Suite 103, San Diego, CA 92108. NOTICE OF JOINT PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF SAN DIEGO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN DIEGO ON THE PROPOSED SALE OF CERTAIN PROPERTY LOCATED ON A PORTION OF THE BLOCK BOUNDED BY ISLAND AVENUE AND 14TH, 15TH AND J STREETS IN THE CENTRE CITY REDEVELOPMENT PROJECT AREA TO PINNACLE INTERNATIONAL DEVELOPMENT, INC.
NOTICE IS HEREBY GIVEN that the City Council of the City of San Diego (the "City Council") and the Redevelopment Agency of the City of San Diego (the "Agency") will hold a joint public hearing on October 11, 2005 at the hour of 10:00am or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et seq.), for the purpose of considering the proposed sale of certain property in the Centre City Redevelopment Project area to Pinnacle International Development, Inc., a California corporation (the "Developer").
The proposed sale of property to the Developer will be made in accordance with the California Community Redevelopment Law and pursuant to the proposed Owner Participation Agreement between the Agency and the Developer subject to covenants, conditions and restrictions necessary to carry out the Redevelopment Plan for the Centre City Redevelopment Project.
The property proposed to be sold to the Developer consists of that property located in the Centre City area of the City of San Diego which is illustrated as the Sales Parcel on the Map accompanying this Notice. Prior to the AgencyÕs conveyance of the Sales Parcel to the Developer, the Developer shall have acquired the Participating Parcel which is illustrated on the Map accompanying this Notice. Concurrently with the AgencyÕs conveyance of the Sales Parcel to the Developer, the Developer shall convey a Park Easement to the Agency as illustrated on the Map accompanying this Notice. The Developer shall then construct on that portion of the block not subject to the Park Easement approximately 619 residential condominium units, and approximately 22,000 square feet of commercial retail space in the podium level of the condominium towers and in a free standing structure at the corner of 14th Street and Island Avenue. The free-standing structure shall be a food and beverage-related use and shall contain joint use public restrooms open to the general public daily at least from 6 A.M. to 9 P.M. The Developer may construct a below-grade parking structure under a portion of the Park Easement. The Agency shall construct, or cause the construction of, a public park on the Park Easement, and the Developer, or the DeveloperÕs successors in interest, shall maintain the public park, pursuant to the terms of the Owner Participation Agreement.
The joint public hearing will be held to consider:
1. The proposed sale of the Sales Parcel by the Agency to the Developer.
2. The proposed Owner Participation Agreement submitted to the Agency in the form desired by the Developer, which provides for the proposed sale of such real property by the Agency to the Developer, the terms for the DeveloperÕs conveyance of the Park Easement to the Agency, and the terms for construction and maintenance of a public park.
The following documents are available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the offices of the City Clerk, 202 "C" Street, City Administration Building, 2nd Floor, San Diego, California 92101 and at the offices of the Centre City Development Corporation, 225 Broadway, Suite 1100, San Diego, California 92101:
1. A copy of the proposed Owner Participation Agreement.
2. A summary report which describes and specifies:
a. The costs to be incurred by the Agency under the proposed Owner Participation Agreement;
b. The estimated value of the interest to be conveyed by the Agency pursuant to the proposed Agreement determined at the highest and best uses permitted under the Centre City Redevelopment Plan;
c. The estimated value of the interest to be conveyed by the Agency at the use and with the conditions, covenants and development costs required by the sale;
d. The compensation to be paid to the Agency by the proposed transaction;
e. An explanation of the difference, if any, between the compensation to be paid to the Agency and the fair market value at the highest and best use consistent with the Centre City Redevelopment Plan; and
f. An explanation of why the sale and development of the Sales Parcel will assist with the elimination of blight.
As the Agency responsible for carrying out the Redevelopment Plan for the Centre City Redevelopment Project, the Agency has previously prepared, and the Agency (Resolution No. 2081) and City Council (Resolution No. 279875) have certified, the Final Master Environmental Impact Report for the Centre City Redevelopment Project (the "MEIR"). In order to further evaluate the possible environmental effects of implementation activities in the Redevelopment Project, the Agency has prepared, and the Agency (Resolution No. 03058) and the City Council (Resolution No. 292363) have certified, the Final Subsequent Environmental Impact Report to the MEIR for the Proposed Ballpark and Ancillary Development Projects, and Associated Plan Amendments (the "SEIR"). The sale of the property and the construction of the mixed use development and a public park pursuant to the provisions of the proposed Agreement is a redevelopment implementation activity whose environmental impacts are assessed in the MEIR, as supplemented by the SEIR (collectively, the ÒMEIR/SEIRÓ), and encompassed within the certifications, findings and approvals of the above referenced resolutions of the Agency and City Council. In connection with its consideration of the proposed Agreement, the Agency has prepared a Secondary Study to determine if the development thereunder will have additional significant effects on the environment to those covered in the MEIR/SEIR. As a result of the Secondary Study, no negative declaration and no subsequent environmental impact report or supplement or addendum to the MEIR/SEIR has been prepared with respect to the proposed Agreement. The MEIR/SEIR will be considered by the City Council and Agency at the time of the public hearing on the Agreement. Copies of the Secondary Study, the MEIR and the SEIR are available for public inspection and copying in the offices of the City Clerk and Centre City Development Corporation in the places and times specified hereinabove.
At any time before the date and time set forth above for the joint public hearing by the City Council and Agency, any written comments on or objections to the proposed Agreement or to the proposed sale of the property may be filed with the City Clerk. Comments may also be submitted during such period on the summary report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the joint public hearing will be given an opportunity to appear and be so heard. If you challenge the approval of the proposed Agreement, or any of the matters related thereto as referred to in this Notice, you may be limited to raising only those issues addressed at the hearing described in this Notice or in written correspondence delivered to the City Clerk at, or prior to, the hearing.
