2013 Disparity Study
BUSINESS FACILITATION FORUM

SANDAG, North County Transit District, and Imperial County Transportation Commission are conducting disparity studies in San Diego and Imperial Counties to inform their implementations of the federal DBE program. The disparity studies will include information about experiences of business owners and whether there is evidence of discrimination based on race/ethnicity or gender in the local transportation contracting industry.

Consortium members and BBC Research & Consulting will conduct a business facilitation forum throughout the local area beginning in October 2013. During each meeting, the study team will give a presentation describing the disparity study, including its purpose, methodology, and the study schedule.

Following the presentation, attendees will have the opportunity to submit verbal testimony about their experiences doing work in the local transportation-related contracting industry and to ask questions about the disparity study.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer of Civic San Diego (“CivicSD”) will hold a hearing to approve, conditionally approve, or deny an application for a Conditional Use Permit (CUP) (Process Three) to allow live entertainment at Phantom Lounge and Night Club, a proposed restaurant and night club, to be located at 1014 Fifth Avenue within the Core Neighborhood of the Downtown Community Plan Area.

This activity is covered under the Final Environmental Impact Report (FEIR) for the San Diego Downtown Community Plan, Centre City Planned District Ordinance, and 10th Amendment to the Centre City Redevelopment Plan, certified by the City Council and the Redevelopment Agency (“Former Agency”) on March 14, 2006 (Resolution R-301265 and R-04001, respectively) and subsequent addenda to the FEIR. The FEIR is a “Program EIR” prepared in compliance with California Environmental Quality Act (CEQA) Guidelines Section 15168. CivicSD staff has concluded that the proposed activity of hosting live entertainment at a proposed restaurant and night club is within the scope of the development program described in the FEIR and that the environmental impacts were adequately addressed in the FEIR; therefore, no further environmental documentation is required under CEQA.

The decision of the CivicSD Hearing Officer is final unless appealed to the CivicSD Board of Directors. In order to appeal the decision you must be present at the public hearing and file a speaker's slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained at CivicSD's office located at 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10) business days of the Hearing Officer's decision. If the Hearing Officer's decision is appealed, the decision made by the CivicSD Board of Directors is the final decision.

If you wish to challenge either CivicSD's or the City of San Diego's action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the Public Hearing described in this notice, or written correspondence to CivicSD at or before the Public Hearing.
