BRADY D. BUNTE, an individual, in personam, and M/Y “EL GALLO,” a vessel of the United States, U.S. Official No. 1171462, and all of Her Engines, Tackle, Accessories, Equipment, Furnishings and Appurtenances, in rem;
Defendants.
The United States Marshal for the Southern District of California has arrested the Motor Yacht “EL GALLO,” U.S. Official No. 1171462, together with her engines, machinery, etc. in the Port of San Diego, California, in the above cause, civil and maritime, on September 24, 2013, for claims of damages for breach and default of a Preferred Ship Mortgage and related maritime lien in the amount of $1,277,763.45 plus interest, costs and attorneys fees as set forth in the Complaint on file herein.
Pursuant to Federal Rules of Civil Procedure Supplemental Admiralty Rule C(6)(a), all claims of persons entitled to possession must be filed with the Clerk of the District Court and served on the attorney for the Plaintiff within fourteen (14) days after date of publication, and Answers to Plaintiff’s Complaint must be filed and served within twenty-one (21) days thereafter, or within such additional time as may be allowed by a judge; in lieu thereof, default may be noted and condemnation ordered. Applications for Intervention under Rule 24 of the Federal Rules of Civil Procedure, by persons claiming maritime liens or other interests may be untimely if not filed within the time allowed for claims to possession.
