Please accept this as a notice to inform you, as a property owner, tenant or interested citizen, you should know that the Council of the City of San Diego will conduct a public hearing to approve, conditionally approve, or deny amendments to the San Diego Municipal Code Chapter 10, Article 3, Division 4, Gaslamp Quarter Planned District; and to adopt the Gaslamp Quarter Design Guidelines, formerly called the Urban Design and Development Manual, for the Gaslamp Quarter Sub Area of the Centre City Redevelopment Project area.
The amendments to the Gaslamp Quarter PDO and Design Guidelines include the following changes:
1. Expanding the period of significance from 1880-1910.
2. Adding guidelines for signage, automatic teller machines, sidewalk cafes, cellular phone antennas and satellite dishes, and painting exterior facades.
3. Allow additional stories up to 26 feet with setbacks above the current maximum height of 75 feet north of Island Avenue on parcels 20,000 square feet or more and containing no historic structures.
4. Section 103.0408 of the PDO was reorganized to permit certain uses only above or below the first floor, maximum ground floor area and Section 103.0408f.3 alcohol sales.
Copies of the proposed amendments to the Gaslamp Quarter PDO and all other pertinent documents are available for public review and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the offices of CCDC, 225 Broadway, Suite 1100, San Diego. The proposed changes can also be viewed on CCDCÕs website at www.ccdc.com. As the Agency responsible for carrying out the Redevelopment Plan for the Centre City Redevelopment Project, the Agency has previously prepared, and the Agency (Resolution No. 2081) and City Council (Resolution No. 279875) have certified on April 28, 1992, the Final Master Environmental Impact Report for the Centre City Redevelopment Project (the "MEIR"). In order to further evaluate the possible environmental effects of implementation activities in the Redevelopment Project, the Agency has prepared, and the Agency (Resolution No. 03058) and the City Council (Resolution No. 292363) have certified on October 26, 1999, the Final Subsequent Environmental Impact Report to the MEIR for the Proposed Ballpark and Ancillary Development Projects, and Associated Plan Amendments (the "SEIR"). The proposed amendments is a redevelopment implementation activity whose environmental impacts are assessed in the MEIR, as supplemented by the SEIR (collectively, the ÒMEIR/SEIRÓ), and encompassed within the certifications, findings and approvals of the above referenced resolutions of the Agency and City Council. In connection with its consideration of the proposed Amendments, the Agency has prepared a Secondary Study to determine if the development thereunder will have additional significant effects on the environment to those covered in the MEIR/SEIR. As a result of the Secondary Study, an Addendum to the MEIR was prepared to analyze potential environmental effects from the proposed amendments to the Gaslamp Quarter PDO (Chapter 10, Article 3, Division 4 of the San Diego Municipal Code) and the Design Guidelines. The Final Addendum found no substantial changes or no new information of substantial importance to the Redevelopment Project has become available which was not known or could have been known at the time the MEIR/SEIR for the Redevelopment Project was certified as complete and which shows the Redevelopment Project will have any significant effects not discussed or examined or would be substantially more severe than shown in the MEIR/SEIR or that any new mitigation measures or alternatives not previously considered are necessary. No additional environmental reviews are necessary. The Final Addendum to the MEIR for the Proposed Amendments to the Gaslamp Quarter PDO and Design Guidelines will be considered by the City Council at the time of the public hearing. Copies of the Secondary Study, Final Addendum, the MEIR and the SEIR are available for public inspection and copying in the offices of the City Clerk and Centre City Development Corporation in the places and times specified hereinabove.
At any time before the date and time set forth above for the public hearing by the City Council, any written comments on or objections to the proposed Amendments may be filed with the City Clerk, City Administration Building, 202 C Street, San Diego, CA 92101, Mail Station 2A, or email at hearings1asandiego.gov or fax at 619-533-4045. All communications will be forwarded to the Mayor and Council. Comments may also be submitted during such period on the summary report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the public hearing will be given an opportunity to appear and be so heard. If you challenge the approval of the proposed Amendments, or any of the matters related thereto as referred to in this Notice, you may be limited to raising only those issues addressed at the hearing described in this Notice or in written correspondence delivered to the City Clerk at, or prior to, the hearing.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Coastal Development Permit and Map Waiver application to waive the requirements of a Tentative Map to create 3 residential condominium units (under construction), also with a requested waiver of the requirement to under ground utility lines, on a 4,835 square-foot or 0.11 acre property. The project site is located at 3302 Bayside Walk, in the R-S Zone of Mission Beach Planned District, Coastal Overlay Zone (appealable), Coastal Height Limit Overlay Zone, Beach Parking Impact Overlay Zone, and within the Mission Beach Community Plan Area.
Should the condominium conversion project be approved, tenants may be required to vacate the premises. No units may be sold in this building unless the conversion is approved by the city and until after a public report is issued by the Department of Real Estate. Each tenant has the exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions that such unit will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 90 days from the date of issuance of the subdivision public report pursuant to Section 11018.2 of the Business and Professions Code, unless the tenant gives prior written notice of his or her intention not to exercise the right.

The decision of the Hearing Officer is final unless appealed to the Planning Commission. To file an appeal to the Planning Commission contact staff at the Planning Department, 202 "C" Street, Fifth Floor, San Diego, CA; The appeal must be made within 10 working days of the Hearing Officer's decision.
The certification of an Environmental Impact Report, adoption of a Mitigated Negative Declaration or Negative Declaration, or determination that the project is exempt from the California Environmental Quality may be appealed to the City Council after all other appeal rights have been exhausted. All such appeals must be filed by 5:00 PM within ten (10) business days from the date of the Planning Commission's certification/adoption of the environmental document. The proper forms are available from the City Clerk's Office, located on the second floor of the City Administration Building, 202 C Street, San Diego, CA 92101.
The decision made by the Planning Commission is the final decision by the City.
Appeals to the Coastal Commission must be filed with the Coastal Commission at 7575 Metropolitan Drive, Suite 103, San Diego, CA 92108. (Phone: 619-767-2370) Appeals must be filed within 10 working days of the Coastal Commission receiving a Notice of Final Action from the City of San Diego, Development Services Department.
