Subject: SITE DEVELOPMENT PERMIT (SDP) and COMMUNITY PLAN AMENDMENT for the adoption of the Black Mountain Open Space Natural Resources Management Plan (NRMP). The Plan would provide guidance for the present and future use and maintenance of the Park, as well as Area Specific Management Directives (ASMDs) which satisfy the requirements of the City’s MSCP Implementing Agreement for Black Mountain Open Space. The NRMP contains a proposal to revise the existing trail system on Black Mountain through closure of 11.9 miles of existing trails and development of 3.45 miles of new trail segments, which would result in impacts to biological resources.  The site is not included on any Government Code listing of hazardous waste sites.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Coastal Development Permit and Site Development Permit (due to the site containing Environmentally Sensitive Lands) to demolish a single-dwelling structure with various site improvements on and off the premises and construction of an approx. 7,517-square-foot, two-story, residential single-dwelling unit, with a three car garage, pool / spa and retaining walls on a 17,825-square-foot property. A Mitigated Negative Declaration (MND) No. 130699 was prepared and certified for the original project on Oct. 28, 2009. This extension of time (EOT) was reviewed by the Environmental Analysis Section and it was determined that, in accordance with the California Environmental Quality Act (CEQA) Guidelines Section 15162(a): (1) no substantial changes are proposed to the project which would require major revisions of the previous MND; (2) no substantial changes occur with respect to the circumstances under which the project is undertaken that would require any revisions to the previous MND; and (3) there is no new information of substantial importance that was not known and could not have been known at the time the previous MND was certified. Therefore, no subsequent environmental document is needed for this EOT, as all of the impacts were adequately addressed and disclosed in MND No. 130699.
The final decision by the City of San Diego is not appealable to the California Coastal Commission. If you want to receive a Notice of Final Action, you must submit a written request to the City Project Manager listed above.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Site Development Permit to work within in Environmentally Sensitive Lands and remove and replace an existing deteriorated 24-inch corrugated metal pipe (CMP) with a new 250-foot long 24-inch reinforced concrete pipe installed within the existing storm drain alignment. The project would also restore and revegetate an eroded portion of the canyon slope adjacent to the pipe alignment caused by a break in the CMP storm drain occurring as a result of deterioration and undermining of the soil beneath the CMP. The project is located just north of 5731 Fontaine Street in the RS-1-7 zone within the Navajo Community Plan.
