As a property owner, tenant, or person who has requested notice, please be advised that the Civic San Diego (CivicSD) Hearing Officer will hold a hearing to either approve, conditionally approve or deny an application for Coastal Development Permit (CDP) No. 2011-55 to allow various street, right-of-way, and intersection improvements to facilitate the Park Boulevard/Harbor Drive at-grade vehicular crossing and the connection of Harbor Drive to Park Boulevard in the East Village District of the Downtown Community Plan area. This project requires approval of a CDP (Process Three). The decision of the Hearing Officer can be appealed to the City of San Diego (City) Planning Commission. An appeal must be made no later than 10 business days after the date of the Hearing Officer's decision. In order to appeal the Hearing Officer's decision to the Planning Commission, you must express interest in writing to the Project Planner. Any appeals must be submitted to the CivicSD Planning Department, 401 B Street, Suite 400, San Diego, California, 92101. The decision of the Planning Commission is the final action on the application under the authority of the City.
Portions of the project are also located within the appealable area of the Coastal Zone. Therefore, this application is also appealable to the California Coastal Commission pursuant to Coastal Act Section 30603. Appeals may be filed with the Coastal Commission after the decision by the Hearing Officer and within ten (10) working days following Coastal Commission receipt of a Notice of Final Action. Appeals must be submitted in writing to: California Coastal Commission, San Diego Area Office, 7575 Metropolitan Drive, Suite 103, San Diego, CA 92108, and Phone No. (619) 767-2370.
This project is covered under the Supplemental Environmental Impact Report (SEIR) for the Ballpark and Ancillary Development Project as well as the Final Master Environmental Impact Report (MEIR) for the Centre City Redevelopment Project certified by the Former Redevelopment Agency and City Council on April 28, 1992 (Resolution Nos. 2081 and 279875 respectively).
An Environmental Secondary Study (ESS) dated February 20, 2002, was prepared in accordance with California Environmental Quality Act (CEQA), State, and local guidelines. Based on the ESS, it was reaffirmed that (i) the proposed project would not have any significant effect on the environment beyond those identified in the MEIR and SEIR, (ii) no additional information or data has become available regarding new significant environmental impacts, and (iii) no further environmental documentation is therefore required under CEQA.
