Buyer approves of all property conditions including but not limited to; permits, boundaries, zoning, easements, access and all other aspects of property prior to acceptance.
3. Buyer acknowledges that they have physically been to property and are removing all contingencies. 4. Title to be with First American Title. Escrow to be with Heritage Escrow (Jesse Warner, Escrow Officer). 5. Property to be sold As-Is, without condition, representation, warranty or covenant of any kind, express or implied. 6. No personal property is included. 7. No termite report and no clearance will be provided by seller. 8. No credits or price reductions will be granted. 9. Seller will not pay for nor do any repairs. 10. No utilities to the property will be available. 11. Only mandated disclosures will be issued by the Seller (No TDS, no seller questionnaires; SP, SSD, VLQ, etc.). 12. Buyer to deposit into escrow remainder of purchase price plus any additional buyer costs necessary to close escrow within 7 days after court confirmation/order confirming sale to buyer. 13. Escrow to close within 10 days of court confirmation/order confirming sale to buyer. 14. Buyer to pay for all government requirements and retrofits, including but not limited to purchase/installation costs of: smoke and carbon monoxide detectors, water heater bracing, etc., additionally, buyer to pay the cost of compliance with any other minimum mandatory government retrofit standards, inspections, reports, certificates, etc. as required. 15. Natural hazard zone disclosure report to be prepared by disclosure source.
B. Purchase price due in cash in lawful money of the United States. C. Seller to pay commission from proceeds of sale to the listing broker and purchaser's broker in the sum of 5% divided equally between them, but subject to court confirmation or adjustment. D. Buyer and Seller will split the escrow fees equally and are subject to normal prorates.
E. Bids or offers for this property must be made in writing and directed to the Executor in care of Steven D. Ludwig, PO Box 87742, San Diego, CA 92138-7742 or may be filed with the Clerk of the Superior Court at any time after publication of this notice and before the sale. Bids will be received at the aforesaid office at any time after the first publication hereof and before date of sale.
The executor reserves the right to reject any and all bids or offers. Bids or offers need not be considered unless they substantially comply with the terms of this notice.
