A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO
PRELIMINARILY APPROVING THE ASSESSMENT ENGINEER'S REPORT AND DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN THE BARRIO LOGAN COMMUNITY BENEFIT MAINTENANCE ASSESSMENT
DISTRICT.

WHEREAS, the Landscape and Lighting Act of 1972 (the Act), codified at California Streets and Highways Code section 22500, et seq., and the Maintenance Assessment District Ordinance, codified at San Diego Municipal Code section 65.0201, et seq., authorize the creation of maintenance assessment districts and set forth the procedure for the formation a maintenance assessment district; and

WHEREAS, pursuant to the Act and San Diego Municipal Code section 65.0211, the City has ordered the preparation of an engineer's report (Engineer's Report) for a proposed maintenance assessment district in the Barrio Logan neighborhood in the City of San Diego, on file in the Office of the City Clerk as Document No. RR-307736, and has docketed the Engineer's Report for review by the City Council; NOW THEREFORE,

BE IT RESOLVED, by the Council of the City of San Diego (Council) that the
Council proposes and intends to order the formation of a maintenance assessment district to be designated the Barrio Logan Community Benefit Maintenance Assessment District (District) with proposed assessments of $336,431.

BE IT FURTHER RESOLVED, by the Council of the City of San Diego, that
the Engineer's Report submitted in connection with the Barrio Logan Community Benefit Maintenance Assessment District is on file in the office of the City Clerk as Document No. RR-307736, is hereby approved as filed.

BE IT FURTHER RESOLVED, that the Council proposes and intends to levy and collect assessments on parcels within the District to pay a prescribed portion of the costs of future improvements, maintenance, and/or services as described in the Engineer's Report for the District.

BE IT FURTHER RESOLVED, that the improvements, maintenance, and services to be undertaken within the District generally include the improvement, maintenance, and servicing of landscaping; sidewalk and gutter sweeping; sidewalk washing; security patrols for special events; trash removal; and graffiti abatement along portions of streets within the District.

BE IT FURTHER RESOLVED, that the District is generally located in the Barrio Logan neighborhood in the City of San Diego.

BE IT FURTHER RESOLVED, that the Engineer's Report is on file with the Office of the City Clerk as Document No. RR-307736, and contains a full and detailed description of the improvements, maintenance, and services; the boundaries of the District; and the proposed assessments upon assessable lots and parcels of land within the district.

BE IT FURTHER RESOLVED, that notice is hereby given, that November 27, 2012 at 10 a.m., or as soon thereafter as it may be heard, in the City Council Chambers of the City Administration Building, 202 C Street, San Diego, California, is fixed as the time and place where the City Council shall conduct a public hearing on the question of the formation of the District and the levy of the proposed assessments. The public hearing may be continued from time to time as necessary.

BE IT FURTHER RESOLVED, that the City Clerk is directed to cause a notice of the hearing and assessment ballots to be mailed at least forty-five (45) days before the date of the hearing, postage prepaid, to all affected property owners, whose names and addresses appear on the last equalized County Assessment Roll, all in the manner and form provided for in California Government Code sections 53750-53756.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO DECLARING ITS INTENTION TO DESIGNATE AN AREA OF BENEFIT IN SCRIPPS MIRAMAR RANCH TO FINANCE THE COST OF PUBLIC FACILITIES PROJECTS AND
SETTING THE TIME AND PLACE FOR HOLDING A PUBLIC HEARING THEREON.

WHEREAS, the Council of the City of San Diego desires to initiate proceedings for the designation of a facilities benefit assessment area of benefit in Scripps Miramar Ranch pursuant to San Diego Municipal Code section 61.2200 et seq., which area of benefit will specially benefit from the acquisition, improvement and construction of certain public improvements more particularly identified and described in the document titled, “Scripps Miramar Ranch Public Facilities Financing Plan and Facilities Benefit Assessment, Fiscal Year 2013” (Financing Plan) on file in the Office of the City Clerk as Document No. RR-307789; and

WHEREAS, the specific public facilities projects, the cost of which is proposed to be charged to the properties located within the area of benefit, are identified in the Financing Plan; and

WHEREAS, a capital improvement program with respect to the public facilities projects is included in the Financing Plan; and

WHEREAS, the proposed boundaries of the facilities benefit assessment area of benefit are shown in the Financing Plan; and

WHEREAS, the method pursuant to which the cost of the public facilities projects are to be apportioned among the parcels within the facilities benefit assessment area of benefit and the estimated amount of the facilities benefit assessments which will be charged to each such parcel is contained in the Financing Plan; and

WHEREAS, the Council has determined that it is necessary to provide for 4 percent annual automatic increases for Fiscal Year 2014 and each year thereafter in the amount of facilities benefit assessments for landowners who have not paid their facilities benefit assessments without the necessity for further proceedings pursuant to San Diego Municipal Code section 61.2212 in order to reflect increases in the cost of money during the period between the imposition of the facilities benefit assessment, the payment of facilities benefit assessments and completion of the public facilities projects. The annual automatic increase is based on the March to March Construction Cost Index for San Diego/Los Angeles and the June to June Consumer Price Index for San Diego; and

WHEREAS, the amount of contribution or advance which the City or other public entity will make toward the total cost of the public facilities projects is set forth in the Financing Plan; NOW, THEREFORE,

BE IT RESOLVED, by the Council of the City of San Diego, as follows:

1. That the foregoing recitals are true and correct and incorporated fully herein by this reference.

2. Pursuant to San Diego Municipal Code section 61.2200 et seq., the Council declares its intention to designate an area of benefit within Scripps Miramar Ranch to finance the cost of the public facilities projects identified in the Financing Plan, which is incorporated into this Resolution by reference.

3. The Council shall hold a public hearing to consider the designation of the area of benefit as proposed in this Resolution at 10:00 a.m., or as soon thereafter as the matter may be heard, on November 27, 2012, at the Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California.

4. The City Clerk is authorized and directed to give notice of the public hearing described in paragraph 3 of this Resolution by publishing this Resolution in the San Diego Daily Transcript at least two weeks before the date set forth herein and by mailing copies of this Resolution to each owner of property located within the proposed area of benefit at the addresses shown on the last equalized property tax assessment roll, or as otherwise known to the City Clerk pursuant to San Diego Municipal Code section 61.2205.

Subject:       Scripps Memorial Hospital La Jolla: UNIVERSITY COMMUNITY PLAN AMENDMENT; REZONE; PLANNED DEVELOPMENT AND CONDITIONAL USE PERMIT AMENDMENT and PUBLIC EASEMENT VACATION for the development of the Scripps Memorial Hospital La Jolla Master Plan Project (“project”).  The project proposes the expansion of the existing hospital campus. The project is described as follows:
 
The overall proposed project site encompasses approximately 41.4 acres of land located at 9888 Genesee Avenue. The area consists of eight assessor parcels numbers (APNs 343-160-08, 343-160-16, 343-160-18, 343-160-19, 343-160-20, and 343-160-23–26). With current entitlements under Conditional Use Permits (CUP) 1 through 8, the hospital campus is currently approved for 1,682,369 square feet with 814,580 square feet left to be constructed. The proposed project, known as CUP 9, would consist of new construction and renovations totaling 891,350 square feet, and demolition of existing structures totaling 533,725 square feet, for a net increase of 357,625 square feet on the hospital campus. With buildout of CUP 9, the total square footage of the campus would be 2,039,994 square feet.
 
Existing and buildout features of the hospital campus include space for hospital patients and attendants, outpatient medical offices, scientific research facilities, parking structures, physical plant areas, magnetic resonance imaging outbuildings, and other associated development.
 
 
Development is controlled by development-intensity limits established in the University Community Plan. The proposed project would increase the existing 389 beds on the overall campus by 142, for a total of 531 beds, whereas the University Community Plan maximum is 682. The University Community Plan also establishes a maximum total square footage for medical offices for Scripps Memorial Hospital La Jolla, and a community plan amendment would be required to increase the project’s square footage from 332,528 square feet of medical office space to 793,580 square feet of medical office and outpatient space.
 
New construction proposed on site under CUP 9 would include the development of three new seven-story buildings/structures, including a Medical Office Building (9.K), an Outpatient Pavilion (9.B), and a Parking Structure (9.J). In addition, the project would also include construction of a nine-story hospital tower (Tower III, Phase I (9.C) and Phase II (9.D)), a three-story addition for medical office and scientific research use (9.E) adjacent to the existing two-story Schaetzel Building Phase II (9.E), and a single-story Maintenance Shop (9.G) with a landscaped plaza that includes outdoor seating and grass areas above it. The project would also include construction of a second Helistop (9.F) on the roof of previously approved Tower II (8.E), improvement of internal road circulation of the campus, and new landscaping. The main entrance off Genesee Avenue would be widened from five to six lanes and would be straightened to provide a more direct route to the hospital. A public easement vacation is required at the site of a former driveway into the hospital along Genesee Avenue. The public easement was recorded in 1972 to accommodate electrical facilities for a traffic signal at the driveway. The traffic signal no longer exists and the electrical facilities have been removed. The driveway was demolished in 1980 so the public easement is no longer necessary.
