NOTICE IS HEREBY GIVEN that on November 15, 2012, or thereafter within the time allowed by law, F.S. Ricky Maveety (aka Fredrica S. Maveety), administrator of the Estate of THOMAS JOHN BELZONE, will sell the property described below at private sale to the highest and best bidder, on the terms and conditions described below, subject to confirmation by the Court.
The property to be sold consists of all right, title, and interest of the decedent at the time of his death and all right, title, and interest that the estate has acquired in addition to that of the decedent at the time of his death, if any, in and to the real property located in San Diego County, California, described as follows:
Single family residence located in San Diego County and commonly known as: 210 Wallace Lane, Vista, CA 92083.
More particularly described as follows:
PARCEL 1: That portion of Lot 342 of Rancho Vista Tract No. 3, in the City of Vista, County of San Diego, State of California, according to Map thereof No. 2020, filed in the Office of the County Recorder of San Diego County, on May 4, 1927, described as follows:
Beginning at a point in the South line of said lot, distant thereon South 88š52' East 145.00 feet from the Southwesterly Corner thereof; thence North 13š39' West 223.87 feet to the most Easterly Corner of the land conveyed to Charles C. Wallace and wife by Deed dated April 10, 1956 and recorded in Book 6061, Page 59 of Official Records, being also the True Point of Beginning; thence retracing South 13š39' East 118.00 feet; thence North 73š53'11” East 164.80 feet to the Easterly line of said Lot 342; thence along said Easterly line North 0š08'13” East 146.71 feet to the Northeasterly Corner of said lot; thence South 66š51'47” West 177.46 feet; thence South 71š46' West 25.17 feet, more or less to the True Point of Beginning.
PARCEL 2: An easement for road and public utility purposes over a strip of land of the uniform width of 20.00 feet lying within Lots 341 and 342 of said Rancho Vista Tract No. 3, the Southerly line thereof being described as follows:
Beginning at a point in the Westerly line of said Lot 342 distant thereon 20.30 feet Southerly from the Northwesterly Corner of said lot, said point being the Southwesterly Corner of the land described in Deed to Charles C. Wallace and wife, dated April 10, 1956 and recorded in Book 6061, Page 59 of Official Records; thence Easterly along the Southerly line of the land so described in said deed to the most Easterly Corner thereof; thence along the Northerly line of the first above described land North 71š42' East 20.00 feet.
EXCEPTING THEREFROM any portion lying within Parcel 1 herein above described. The easement above described is hereby declared to be appurtenant to and for the use and benefit of the present or future owner or owners of all or any portion of Parcel No. 1, hereinabove described.

The sale is subject to easements of record, restrictions, reservations, covenants, conditions, rights of way and current taxes with any encumbrances of record to be satisfied from the purchase price.
The property is in poor condition and is to be sold on an “as is” basis, with no warranties given by seller. Written bids or offers are invited for this property. They will be received at the office of F.S. Ricky Maveety, Administrator, at Zeldes & Haeggquist, LLP, 625 Broadway, Suite 906, San Diego, CA 92101. Such bids or offers may also be filed with the Clerk of Court at 1409 4th Ave., San Diego, CA 92101, or delivered to F.S. Ricky Maveety personally at any time after first publication of this notice and before the sale.
The terms of sale are purchase price of $215,000 payable as all cash at closing. The offer must be accompanied by a certified check for ten (10%) of the offer and the balance shall be paid within 72 hours of court confirmation. Taxes, rents, operating and maintenance expenses, and premiums on insurance shall be prorated as of the date of recording of conveyance. Examination of title, recording of conveyance, and transfer taxes shall be at the expense of the purchaser. Title insurance policy shall be at the expense of seller. Purchaser and seller shall split equally the costs of escrow.
