PARATRANSIT ORDINANCE

Notice is hereby given that on November 15, 2012, the San Diego Metropolitan Transit System adopted an amended Ordinance No. 11, entitled:  “An Ordinance Providing for the Licensing and the Regulating of Transportation Services within the City by the Adoption of a Uniform Paratransit Ordinance,” by the following vote:  (Aye) Bragg, Castaneda, Cox, Cunningham, Denny, England, Ewin, Gloria, Mathis, Minto, Ovrom, and Rios.  (Naye) None.  (Absent) Alvarez, Emerald, and McClellan. 
The adopted amendments to Ordinance No. 11 include:
Clarifying administrative procedures, permit holder and driver reporting, no smoking, credit card reporting, use of cellular phones, taxicab and jitney stand updates, and additional service organization requirements. 
The adopted amendments will take effect 30 days from the date of adoption.  A certified copy of the proposed amendment is posted in the MTS lobby at the above address.

Notice is hereby given that the San Diego Metropolitan Transit System (MTS), at its regularly scheduled Board meeting of November 15, 2012, at 9:00 a.m. at 1255 Imperial Avenue, Suite 1000, San Diego, CA, adopted amendments to several sections of Ordinance No. 5 related to for-hire vehicles by the following vote:  (Aye) Bragg, Castaneda, Cox, Cunningham, Denny, England, Ewin, Gloria, Mathis, Minto, Ovrom, and Rios.  (Naye) None.  (Absent) Alvarez, Emerald, and McClellan. 
Adopted amendments to Ordinance No. 5 grant MTS Taxicab Inspectors I & II, Regulatory Specialists and the Taxicab Administrator the ability to enforce misdemeanor California Public Utility Commission (CPUC) violations related to private hire transportation providers.
The adopted amendments will take effect 30 days from the date of adoption.  A certified copy of the proposed amendment is posted in the MTS lobby at the above address.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer of Civic San Diego (CivicSD) will hold a hearing to either approve, conditionally approve or deny an application for a Conditional Use Permit (Process Three) to allow live entertainment at Gaijin Noodle and Sake House located at 627 Fourth Avenue in the Gaslamp Quarter Neighborhood of the Downtown Community Plan Area.

The decision of the CivicSD Hearing Officer is final unless appealed to the CivicSD Board of Directors. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained at the CivicSD Planning Department, 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10) business days of the Hearing Officer's decision. If the Hearing Officer decision is appealed, the decision made by the CivicSD Board of Directors is the final decision.

This activity is covered under the Final Environmental Impact Report (FEIR) for the San Diego Downtown Community Plan, Centre City Planned District Ordinance, and 10th Amendment to the Centre City Redevelopment Plan, certified by the certified by the City Council and the Redevelopment Agency (“Former Agency”) on March 14, 2006 (Resolution R-301265 and R-04001, respectively) and subsequent addenda to the FEIR. The FEIR is a “Program EIR” prepared in compliance with State CEQA Guidelines Section 15168. CivicSD staff has concluded that the proposed activity of adding live entertainment to an existing restaurant is within the scope of the development program described in the FEIR and that the environmental impacts were adequately addressed in the FEIR; therefore, no further environmental documentation is required under CEQA.

If you wish to challenge either CivicSD's or the City's action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written correspondence to CivicSD at or before the public hearing.
