ORDINANCE GRANTING A 21-YEAR AND NINE MONTH UTILITY EASEMENT TO SAN DIEGO GAS & ELECTRIC COMPANY TO PROVIDE UTILITY SERVICES TO BAE SYSTEMS, SAN DIEGO SHIP REPAIR, INC. FOR THE PIER 4 PROJECT IN SAN DIEGO
 
WHEREAS, the San Diego Unified Port District (District) is a public corporation created by the Legislature in 1962 pursuant to Harbors and Navigation Code Appendix I (Port Act); and
WHEREAS, Section 87(b) of the Port Act grants authority to the District to lease the tidelands or submerged lands, or parts thereof, for limited periods, not exceeding 66 years, for purposes consistent with the trusts upon which those lands are held, by the State of California; and
WHEREAS, at its August 14, 2012 meeting, the Board of Port Commissioners (BPC) approved the new BAE Systems, San Diego Ship Repair, Inc. (BAE Systems) Pier 4 project which requires new electrical infrastructure and a new utility easement; and
WHEREAS, BAE Systems has coordinated with San Diego Gas & Electric Company (SDG&E) to design the proposed new electrical service to accommodate the Pier 4 project's increase future electrical demand; and
WHEREAS, the proposed easement will allow SDG&E to construct, operate, maintain, and repair the new electrical equipment which will connect existing electrical facilities in Belt Street at Sampson Street to the Pier 4 project within the BAE Systems leasehold; and
WHEREAS, the term of the subject easement is for 21 years nine months commencing December 1, 2012 and ending August 31, 2034, coterminous with BAE Systems' lease; and
WHEREAS, the easement benefits the District and District tenants, therefore no rent is applicable.
NOW, THEREFORE, the Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
     Section 1. The Easement between the San Diego Unified Port District, a public corporation and San Diego Gas & Electric Company, a California corporation for subsurface electrical equipment to provide utility services to BAE Systems, San Diego Ship Repair, Inc. for the Pier 4 project in San Diego.
Section 2. The Executive Director or his designated representative is hereby directed to execute said Easement with the San Diego Gas & Electric Company on behalf of the San Diego Unified Port District for a term of 21 years and nine months expiring on August 31, 2034.
Section 3. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

ORDINANCE GRANTING A 10-YEAR LEASE WITH ONE 5-YEAR OPTION EXTENSION TO THE UNITED STATES GENERAL SERVICES ADMINISTRATION FOR THE NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION VESSEL BERTHING AND RELATED WAREHOUSE AND OFFICE SPACE AT CROSBY STREET PIER SOUTH OF THE TENTH AVE MARINE TERMINAL
 
WHEREAS, the San Diego Unified Port District (District) is a public corporation created by the Legislature in 1962 pursuant to Harbors and Navigation Code Appendix I (Port Act); and
WHEREAS, Section 87(b) of the Port Act grants authority to the District to lease the tidelands or submerged lands, or parts thereof, for limited periods, not exceeding 66 years, for purposes consistent with the trusts upon which those lands are held, by the State of California; and
WHEREAS, San Diego Bay is the most efficient port in California for the National Oceanic and Atmospheric Administration (NOAA) regarding the availability of vessel berthing facilities and related landside requirements; and
WHEREAS, San Diego's co-location to other marine research organizations and the infrastructure required to support this field makes it an ideal location for this vessel berthing opportunity; and
WHEREAS, District staff has conducted several tours at the Crosby Street Pier and adjacent land area with NOAA staff including its Rear Admiral and Director of NOAA's Commissioned Officer Corps; and
WHEREAS, on October 27, 2011 and on February 13, 2012, the United States General Services Administration (GSA) released a Solicitation for Lease Proposals and Request for Lease Proposals, respectively; and
WHEREAS, the District responded to the GSA's Solicitation for Lease Proposals and Request for Lease Proposals and in July of 2012 GSA notified the District that it was the successful respondent; and
WHEREAS, the annual rental revenue that the District anticipates receiving in the initial lease years is approximately $150,000 with rent increases of 4% every five years; and
WHEREAS, over the 15-year lease term, the District anticipates receiving approximately $2.3 million in rental revenue; and
WHEREAS, the rent is comprised of both reimbursable tenant improvements and rental revenue based on the District's Tariff rates; and
NOW, THEREFORE, the Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.    That a 10-year Lease with One 5-year Lease Term Option Extension to the United States General Services Administration for the National Oceanic and Atmospheric Administration vessel berthing and related warehouse and office space at Crosby Street Pier south of the Tenth Avenue Marine Terminal is hereby approved and granted.
Section 2.    The Executive Director or his designated representative is hereby directed to execute said 10-year Lease with One 5-year Lease Term Option Extension to the United States General Services Administration for the National Oceanic and Atmospheric Administration.
Section 3.    This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

Notice is hereby given that the General Services & Procurement Department, General Services Building, First Floor, of the San Diego Unified Port District will receive electronic bids at 1400 Tidelands Avenue, National City, California, until 2:00 P.M. on the 20th day of December 2012 for:

TENTH AVENUE MARINE TERMINAL
CROSBY ST. PIER MODERNIZATION
SAN DIEGO, CALIFORNIA

The Work includes installation of electrical (480V 2 x 400 Amps), water, sewer, telecommunication connections from Crosby Street Pier to Water Street at Tenth Avenue Marine Terminal in order to accommodate future tenant(s) as shown on the drawings and as described in the specifications. All proposed work described above shall be done by an appropriately licensed Contractor.

The Engineer's Construction estimate for this work is $600,000.00. The total contract duration is 135 calendar days.

The bidder must possess a valid California State Contractors License, General Engineering License A and/or General Building Contractor, License B at the time the contract is submitted.

Bids will be opened in public at or about that hour at 1400 Tidelands Avenue, National City, California, all as more particularly contained in Document No. 58954 on file in the office of the Clerk of the District. No Bidder may withdraw a bid after the date set for bid opening.

Questions or comments regarding this solicitation must be submitted electronically to our eBid system where the specification was downloaded and must be received by District no later than December 12, 2012, at 1:00 p.m. All electronic questions must be received by the date stated above. Responses from District will be communicated via the electronic eBid system to all recipients of this solicitation. Inquiries received after the date and time stated above will not be accepted.

Bidder shall submit their original Bid Proposal Package to the General Services & Procurement Department, 1400 Tidelands Avenue, National City, California 91951 within the date stated on the Contract Documents page after electronic bidding (See Section 4.0, Instruction to Bidders).

A pre-bid conference will be conducted at 2:00 p.m. on December 4, 2012, in the District Training Room, Port of San Diego Administration Building, 3165 Pacific Highway, San Diego, California 92101. The District's representative will be present at the pre-bid conference to receive questions. An addendum will be issued, if necessary, to respond to questions raised. At the end of the conference, interested parties may visit the job site or, if indicated in the Supplementary Requirements, make an appointment to visit the site. Submission of a Bid Proposal Package shall be evidence that the bidder has visited the jobsite and is satisfied with the conditions to be encountered if awarded the contract.

In accordance with the provisions of the California State Labor Code, the District has obtained the general prevailing rate of wages (which rate includes employer payments for health and welfare, vacation, pension and similar purposes) applicable to the work to be done, for straight time, overtime, Saturday, Sunday and holiday work. All labor employed on this project shall be paid no less than such minimum rates of wages. These wage rates are available for inspection at the office of the General Services & Procurement Department of the San Diego Unified Port District.

It is the policy of the San Diego Unified Port District that certified Small Business Enterprises (SBEs) shall have the maximum opportunity to participate in the performance of District Contracts. Certified SBEs with qualifying experience are encouraged to respond to the request for proposals/bids/quotes, etc.

Award of the contract, if made, will be within 120 calendar days after bid opening date. A bid guarantee in accordance with Subsection 5.6.2 of the General Condition is required with submission of a bid. No Bidder may withdraw a bid after the date set for bid opening.

Bidder shall file the bonds as required by the Contract and Civil Code section 3247. The provisions of Public Contract Code section 22300 apply to this Contract.

In the public interest, the District reserves the right to reject any or all bids, or to waive any informality in a bid.
