The City of San Diego Development Services Department has prepared a draft Mitigated Negative Declaration Report for the following project and is inviting your comments regarding the adequacy of the document.  The draft Mitigated Negative Declaration and associated technical appendices have been placed on the City of San Diego web-site at http://clerkdoc.sannet.gov/Website/publicnotice/pubnotceqa.html.  Your comments must be received by 1/7/13, to be included in the final document considered by the decision-making authorities.  Please send your written comments to the following address:  Jeffrey Szymanski, Environmental Planner, City of San Diego Development Services Center, 1222 First Avenue, MS 501, San Diego, CA 92101 or e-mail your comments to DSDEAS@sandiego.gov  with the Project Name and Number in the subject line.
 
General Project Information:  Project Name:  Pump Station 77 A/B Force Main Inspection, Project No. 264948
Community Plan Area:  San Pasqual and Rancho Bernardo Community Planning Areas.  Council District:  5
 
Subject: SITE DEVELOPMENT PERMIT (SDP) to allow for the excavation of nine exploratory test pits directly over an existing sewer force main.  The test pits would be used to and identify force main conditions that may lead to liner failure, pipe leakage, interruption of service, and force main failures. The nine (9) locations would implement B-Scan ultrasonic testing to determine the wall thickness of the pipe. The external surface of the pipe would also be inspected to determine the presence of external pitting. Each site would then be backfilled, restored to original grade, and revegetated with native species. Since none of the activities require the force main to be out of service, normal operational procedures will not be impacted. The project is expected to last 2-3 months. The site is not included on any Government Code listing of hazardous waste sites. Applicant: City of San Diego Public Utilities Department.
Recommended Finding:  The recommended finding that the project will not have a significant effect on the environment is based on an Initial Study and project revisions/conditions which now mitigate potentially significant environmental impacts in the following area(s):  Biological Resources and Land Use (MHPA Adjacency)

Subject:  SITE DEVELOPMENT PERMIT (SDP), to remove and mitigate for sensitive vegetation at 12516 Del Vino Court in the AR-1-2 Zone within the Del Mar Mesa Community Plan in Council District 1. The SDP application is filed in response to a Notice of Violation issued by the Neighborhood Code Division of the Development Services Department (DSD) for unpermitted grading activity. The approximate 4.80-acre property (Assessor Parcel Numbers 308-020-6000 & 7500) is located at the southwest corner of the intersection of Del Vino Court and Rancho Toyon Place, within the Del Mar Mesa Specific Plan Area (DMMSPA), AR-1-2 Zone (Agricultural Residential, one dwelling unit per acre), San Diego, CA 92130, San Diego, CA 92130.
 
The site is not included on any Government Code listing of hazardous waste sites.

Determination and Recommended Finding:  The City of San Diego Advance Planning and Engineering Division concludes that the Rabbitt Property project could have a significant environmental effect in the area of BIOLOGICAL RESOURCES but that those effects were previously examined in Del Mar Mesa Specific Plan MEIR (LDR NO. 95-0353) and the project would not result in any additional significant effects on the environment beyond those identified in the MEIR No. 95-0353.  It recommends that the lead agency make findings that no additional significant environmental effect will result from the project, no additional mitigation measures or alternatives are required, the project is within the scope of MEIR No. 95-0353, and no substantial changes have occurred with respect to the circumstances under which the MEIR was certified or there is no new information which was not known and could not have been known at the time the MEIR was certified.  The proposed project is considered to be within the scope of analysis of the Specific Plan as examined by the MEIR and are presented in the MEIR Subsequent Project Findings pursuant to CEQA Sections 15177 and 15179.
