The primary focus of my insurance practice is handling complex, high profile coverage and bad faith litigation matters on behalf of insurers. My experience is broad-based and ranges from handling all aspects of property and casualty insurance coverage litigation (including related bad faith actions) to professional liability (D & O, E & O, EPLI) and life, health and disability matters. I also have extensive trial experience defending officers, directors and corporations in cases involving claims for defamation, false advertising, trade libel, alter ego liability, intentional interference with contract, unfair competition and unfair business practices under Business & Professions Code Section 17200 et seq. My experience in the area of business tort litigation includes successfully defending a corporate officer/director in a seven-month bench and jury trial (12-0 defense verdict) in a private consumer class action lawsuit seeking damages in excess of $30 million.

I have lectured extensively regarding bad faith litigation, including litigation involving first and third party mold claims. I have trial, appellate, mediation and arbitration experience in both state and federal court defending insurers in all aspects of insurance coverage and bad faith litigation. My recent publications include: CEB Action Guide, "Handling Mold Litigation in California" (October 2005), CEB Action Guide, "Handling Mold Litigation in California" (Summer 2003), Defense Research Institute, "Beyond Bad Faith -- Upping The Ante With Class Action And Unfair Business Practices Claims" (February/March 2004).

I am a faculty member of the National Institute for Trial Advocacy (NITA) and a regional instructor for NITA's intensive trial skills program and deposition workshops. I am also a member of the Defense Research Institute's Life, Health and Disability Insurance Committee, the Enright Inns of Court and the Southern California Chapter of the National Association of Insurance Women (NAIW). Additionally, I was listed in the Fall 2005 issue of Bay Area Lawyer Magazine as one of the "Best Lawyers in the Bay Area" in the area of Insurance.

I relocated to San Diego in May 2005 after practicing in the San Francisco Bay Area since 1989. I am the co-chair of Gordon & Rees' Insurance Practice Group in the San Diego office. My husband is also an attorney and we have two daughters (ages 5 and 8).

Our oldest daughter, a senior at the University of Arizona, deserves a medal for pitching in while I have been regularly detained by my cases. After I finished my undergraduate degree, I was commissioned as an officer in the United States Marines. I served for three years as an infantry officer. I then went to law school in Kansas. I prosecuted an odometer fraud case on an $8,000 vehicle that resulted in a $140,000 settlement, inclusive of attorneys' fees and costs. I was co-counsel in a trial against Mercedes-Benz where plaintiff was awarded full rescission of the sales contract, payment of a $15,000 civil penalty and reimbursement of attorneys' fees and costs. I was co-counsel in a trial against a used-car dealership that disclosed accident damage, but hid the existence of a "salvage title." In that case, plaintiff was awarded full rescission, $20,000 in punitive damages, and reimbursement of attorneys' fees and costs. After the dealership filed for bankruptcy, I made a successful claim on the dealership's bond.

I have practiced almost exclusively in the area of civil litigation since 1992 and have tried several jury trials and bench trials. Since 1999, I have dedicated my practice to representing plaintiffs in consumer protection cases, including lemon law, automobile fraud, debt collection harassment cases and Fair Credit Reporting Act cases.

I report on Song-Beverly Consumer Warranty Act Jury Instructions for the Jury Instruction Committee of the Litigation Section of the State Bar of California. I had the privilege of assisting the van Dam family in obtaining insurance settlements from David Westerfield's homeowners and auto insurers for the wrongful death of their daughter, Danielle. I also had the honor of representing a former San Diego Charger in obtaining insurance benefits from Lloyd's of London on a disability claim when Lloyd's denied coverage.

I started out working as a legal secretary in 1976. In 1979 I began working for Dan White at Rhoades & Hollywood, who convinced me I should go to law school. I applied for and won a scholarship to go to law school with the help of a recommendation letter from Dan White. I worked as a paralegal while going to law school, and after law school I worked as a law clerk. I moved from San Diego to Reno, Nev., where I worked as a law clerk for 8.5 years. I moved back to San Diego when I passed the bar exam (11 years after graduating from law school) and started my law practice here. I worked on the insurance defense side of law for 16 years, but I've been working with and for plaintiffs since 1995.

I recently represented Guardian Media Technologies, Ltd., in a major victory over four major technology conglomerates -- Sony, Mitsubishi, Matsushita and Thomson Inc. -- in a multimillion-dollar consumer products patent licensing dispute.

I represented the California Interscholastic Federation in a landmark decision concerning eligibility. The Court of Appeal concurred with CIF in holding the right to play interscholastic high school sports is not a constitutional right.

I currently represent the homeowners in a case entitled The Oaks Management Corp. v. Avocado Crest Condominiums, LLC in a bitterly contested multimillion-dollar construction defect case. There are 47 plaintiffs involved and there has been extensive television coverage related to the plight of the homeowners.

I am an avid Little League baseball mom and scorekeeper, amateur watercolorist, flautist, physical fitness/yoga buff, former Girl Scout Leader and a member of Foothills United Methodist Church in La Mesa, where I play in the band "Witness" as often as possible with some spectacular musicians and singers (present company excepted!).

Personal background

I was born in Detroit, Mich., to the most supportive parents I could have had, Ed and Molly Wolfe, and have one brother, Brian Wolfe, who inspired me to be an attorney fighting for justice for the "underdog." I have been married to the love of my life, attorney Lester McDonald, for 19 years and we have two wonderful children, Molly, age 17, and Thomas age 13.
