Gov. Jerry Brown has signed AB 1565, the NECA sponsored legislation that would require school districts to perform pre-qualification of electrical contractors on large school construction projects.
Due to the prolonged economic downturn, many school districts have been receiving bids from electrical contractors who have never performed school construction and in some cases; school districts receive bids from contractors who have never worked on a public works project in general. Since state law requires the use of the lowest bidder on school construction projects, theses contractors are being awarded school construction contracts even though they may not be qualified to perform the work.
AB 1565 will require that on school construction projects valued at over one million dollars that the general, mechanical, electrical, and plumbing contractors be pre-qualified.
The bill's provisions become operative Jan. 1, 2014.
