Employers hoped the California Supreme Court’s long-awaited ruling in Brinker v. Superior Court of San Diego would put an end to class actions alleging violation of California’s meal period laws. It did not.
From its earliest days as an evening bar preparation program at San Diego High School in the 1920s, California Western School of Law has focused on ensuring its graduates are ready for the practice of law. That work continues to produce results, including the most recent listings of San Diego’s best and brightest Young Attorneys.
The California Bar is set to consider how it might implement a recommendation that law students take 15 hours of “practice-based, experiential” course work prior to bar admission. (I’m assuming the trustees will adopt the recommendation.) For many students, such a requirement won’t change much. Most schools, mine included, offer many clinics, courses and externship programs that fit that bill. Lots of students take them. The requirement will be a change for others, but I think it will be a good one. There is a lot to be said for learning by doing. We need to get implementation right, of course, but we will. The recommendation was meant to nudge us, and we have been nudged.
Because of budget constraints, litigation generally is becoming more expensive and difficult to manage.
The federal government is aggressively seeking damages against employers who fail to pay interns for the work they perform. Under the Fair Labor Standards Act, covered, non-exempt individuals who are “permitted” to work must be compensated for their services. Unless an internship in the “for-profit” private sector meets all of the criteria listed here, it will most often be viewed as employment. Interns qualifying as employees must be paid at least the minimum wage and overtime for hours worked over 40 in a workweek.
