Companies rely on patents to provide intellectual property assets that can be leveraged to advance business goals. For the biotechnology industry, this reliance on the patent system is especially important because it offers the company a period of exclusivity for a patented product or process to recoup costs associated with the innovation. The patent laws, including case law, define the right of exclusivity that can be conferred. The law, however, is dynamic; businesses must adapt and develop creative approaches to changes in the law that alter these rights.
