On March 20, the Federal Circuit issued its much-anticipated decision on the U.S. Patent and Trademark Office's attempted implementation of four new patent rules in Tafas v. Doll. In a split ruling, the majority decided that the new rules are procedural rules that are within the scope of the USPTO's rulemaking authority, vacated the district court's invalidation of the new rules except Final Rule 78, and remanded the case for further proceedings. Although it remains to be seen how the remaining new rules and other unaddressed issues will be decided on remand or possibly on an en banc hearing by the Federal Circuit, the ruling potentially gives the USPTO the authority to make rules it has been seeking for the purpose of reducing its backlog of unexamined applications.
