Elia was born in Baghdad, Iraq, and immigrated to the United States in 1982 at the age of 6. He is of Chaldean descent, a Catholic Iraqi minority group. His family settled in El Cajon, where he was raised, attended high school, college and law school, and where he currently runs his practice. While in college, he met his then future wife Viva who is expecting the birth of their first child. The two happily married in 2005 and live in San Diego.
