Major Cases

Obtained defense judgment in Clark County Nevada on behalf of teacher's pension fund accused of breach of fiduciary duty. Won defense verdict in San Diego Superior Court on behalf of a high-rise developer accused of defrauding condominium purchasers. Obtained dismissal of federal anti-trust and fraud lawsuits filed in San Diego and Riverside against national homebuilder and mortgage company. Litigated against the county of San Diego to close and landscape the San Marcos landfill. Successful arbitration defense of rescission claim arising from $80 million land contract in Vallejo. Defended multiple construction defect and construction delay claims involving more than $150 million in claims.

Practiced as a trial lawyer in San Diego since 1985. Represented clients in a broad spectrum of business and real estate cases involving contracts, business tort claims, construction defects, construction delays and extras, legal malpractice, malicious prosecution, antitrust, condemnation, professional licensing and discipline, subdivision law, environmental contamination, land use entitlements, unlawful detainer and administrative law. Clients include pension funds, national homebuilders, public and private real estate development companies and individual investors. Partner in Allen Matkins' San Diego office since February 2009.

Personal Background

Raised in San Diego. Graduated from Point Loma High. Married 24 years with two children. Lives with his family in an historic Banker’s Hill home once owned by San Diego’s first resident federal judge, Jacob Weinberger.
